ORDINANCE NO. 528.
AN ORDINANCE OF 'ERE CITY OF ARCADIA ;,lAKING AN EXCEPTION TO
CERTAIN 'PROVISIONS OF ORDINANCE NO. 439 OF SAID CITY OF ARCADIA,
ADOPTED JUNE 28, 1940.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:

suant to the provisions of Ordinance No. 439 of said Ci ty , adopted
June 28, 1940, asking that an exception be made affecting the property
described in said petition, and setting forth the specific reasons
therefor and the circurost~~ces in connection therewith, and recommendation
having been made by tho Plarilling Commission to this Council, and a full
investigation and consideration of the facts having been made by this
Council pertinent to this petition; this Council determines that there
are exceptional or extraordinary circumstances or conditions applicable
to the property involved and to the intended uses thereof that do not
generally apply to the property or classes of uses in the same zone or
district in which said property is loc5.ted, and will not be inconsistent
with the general purposes of Ordinance No. 439, and that said property
should be excepted from the provisions of the zone created by said
Ordinance No. 439 affecting said property, but only so far as herein-
after set forth; and the requirementa of said Ordinance No. 439 per-
taining to t}re consent of adjacent property owners having been complied
with;
This Council, therefore, excepts from the provisions of the
respective zone of Ordinance No. 439 of the City of Arcadia, the property
hereinafter described, but only so far as such exception is necessary to
permit the following described property, to-wit:
That portion of Lot 1 of Tract No. 949, in the City of Arcadia,

County of Los AnGeles, state of California, as shown on map recorded in
Book 17, Page 13 of Maps, in the office of the Recorder of said County;
and of Colorado Street, vacated as per Ordinance No. 233 of said City of
Arcadia, described as a whole as follows: Beginning at the Northeast
corner'of that parcel of land conveyed to Title Insurance and Trust
Company and described in deed recorded in Book 19521, Page 220, Official

Records of said County; thence S 89 33'00" E along the Northerly line
of said Lot 1, 86.10 feet to the beginning of a tangent curve therein,
concave to the South and having a radius of 2839.93 feet; thence
Southeasterly along said curve, 407.71 feet to a point (a radial
bearing to said point bears N 8040132" E); thence S 56028'15" lV,
912.42 feet, more or less, to a point in the Easterly line of Colorado
Street (80 feet in width), as described in deed to said City of
Arcadia and recorded in Book 9396, Page 145, of Official Records of
said County, said point being distant 300 feet Southeasterly,
measured along the Northeasterly line of said Colorado Street, from
the most Southerly corner of the hereinbefore described parcel of
land conveyed to Title Insurance and Trust Company; thence North-
westerly along the Northeasterly line of said Colorado Street, 300
feet to the most Southerly corner of said last mentioned parcel of

land; thence N 56 28' 15" E, 508.08 feet, more or less, to the
point of beginning. Above described parcel of land has a calculated
area of 5.03 acres#
to be used ~~d occupied for the following purposes, to-wit:

The operating and maintaining of a bungalow court and of
garages and service buildings in connection therewith.
This exception is granted upon the following conditions:
(a) That no building' permit be granted for the construction
or erection of any building upon said property unless the plans and
specifications be first submitted to the Building Inspector of the
City of Arcadia, and that said plans and specifications and said
building shall in all particulars comply with the building Ordinance
and sani tary regulations of the City of Arcadia.
(b) That said property shall not at any time be used for
any purpose or purposes not specified in this Ordinance.
(c) That in case any of the provisions of this Ordinance are
violated, the property above described shall revert to zone R-l as
defined in Ordinance No. 439, and the rights and privileges herein
granted shall terminate and cease, in the event that any such violation
is not tenrrinated within thirty days, or such further time as the City
Council may decide that the owner of said property, in

due diligence, requires to correct such violation, after the owner of
said property has been given written notice by the City Council of such
viola tion.
SECTION 2. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passage thereof, shall cause the same to be published once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,
published and ci rcula ted in the City 0 f Arcadia, and thirty (30) days
from and after the final passage thereof said Ordinance shall take
effect and be in force.
I hereby certify that the foregoing Ordinance was adopted at a
regular meeting of the City Council of the City of Arcadia, held on the
17th day of October, 1944, by the affirmative vote of at least three
Councilmen, to-wit:
