CEH'l'hIN PROVISIO;;S OF ORDIIIANCE NO. 439 OF SAID CITY OF ARCADIA,
ADOPTED JUNE 28, 1940.
THE CITY COUHCJ:L OF THE CITY OF AR.CADIA DOES ORDAIN AS
FOLLO\'1S:
SECTION 1. Petition of David P;P.Vienna, having been filed in
the office of the PlanninG Commission of the City of Arcadia, pur-
suant to the provisions of Ordinance No. 439 of said City, adopted
June 28, 1940, asking that an exception be made affecting the property
described in said petition, and settin::; forth the spec:Lfic reasons
therefor and the circumstances in connection therewith, and recolmnenda-
tion having been made by the Plannine; Commission to this Council, and a
full investigation and consideration of the facts having been made by
this Council pertinent to this petition; this Council determines that
there are exceptional or extraordinary circumstances or conditions
applicable to the property involved and to the intended uses thereof that
do not generally apply to the pt'operty or classes of uses in the same
zone or district in which said property is located, and will not be
inconsistel"t with the general ]Curposesof Ordinance No. 439, and that said
property should be excepted from the prOVisions of the zone erected by
said Ordinance No. 439 affecting said property, but only so far as herein-
after set forth; and the requirements of said Ordinance No. 439 per-
taining to the consent of adjacent property owners having been complied
with;
This Council, therefore, excepts from the provisions of the
respective zone of Ordinance No. 439 of the City of Arcadia, the property

hereinafter described, but only so far as such exception is necessary to
permit the following described property, to-wit:
Lot 22, Tract No. 6641, in the City of' Arcadia, County of
Los An::;eles, State of California, as shovm on map recorded in Book
126, PaGe 67 of Maps, in the office of the County Recorder of said
County,
to be used and occupied for the following purposes, to-wit:
A general escrow business; real estate brokera~e bus~ness;
the business of insurance, loans, building and loan association and

banking business; professional and business offices; and private
automobile parking lot thereon for use of customers or clients of
the business or profession beins conducted on said property.
The uses described herein are in addition to and shall not be
a limitation upon the uses heretofore allowed under the provisions of
Ordinance No. 407 of the City of Arcadia, adopted July 5, 1939.
This exception is granted upon the following conditions:
(a) That no building pe~lit be granted for the construction or
erection of any building upon said property unless the plans and specifi-
cations be first submitted to the Building Inspector of the City of
Arcadia, and that said plans and specifications and said building shall
in all particulars comply with the building Ordinance and sanitary
regulations of the City of Arcadia.
(b) That said property shall not at any time be used for any
purpose or purposes not specified in this Ordinance.
(c) That in case any of the provisions of this Ordinance are
violated, the property above described shall revert to Zone R-l as
defined in Ordinance No. 439, and the rights and privileges herein
granted shall ter~inate and cease, in the event that any such violation
is not terminated within thirty days, or such further time as the City
Council may decide that the owner of said property, in the exercise of
due diligence, requires to cOrrect such violation, after the owner of
said prope rty has been given writ ten notice by the City Council of such
violation.
SECTION 2. The City Clerk shall certify to the adoption of this
Ordinance and prior to the expiration of fifteen (15) days from the
passage thereof, shall cause the sarre to be pUblished once in the Arcadia
Tribune and Arcadia News, a newspaper of general circulation, pub-
lished and circulated in the City of Arcadia, and thirty (30) days from
and after the final passage thereof said Ordinance shall take effect
and be in force.
