AN O~DINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
MAKING A CONDITIONAL V~qIANCE TO CERTAIN PROVISIONS OF ORDINANCE
NO. 439 OF SAID CITY OF A~CADIA, PURSUANT TO SECTION 25 THEREOF.
THE CITY COmrCIL OF THE CITY OF ~qCADIA DOES ORDAIN AS
FOLLO\1S:
SECTION 1. A petition signed by Robert B. McKinney, having
been filed in the office of the City Planning Commission pursuant to
Section 25 of Ordinance No. 439, entitled "An Ordinance of the City
Council of the City of Arcadia, establishing in said City of Arcadia,
zones or districts and regulating therein the use of property, height
of buildings and requiring open spaces for light and ventilation; to
regulate and restrict the location of trades and industries and the
location of buildin3s designed for specified use; providing for the
enforcement and prescribing penalties for the violation thereof.II,
adopted on the 28th day of June, 1940, asking that a conditional
variance be made affecting the property described in said peti tion
and setting forth the specific reasons tberefor and the circumstances
in connection therewith, and recommendation having been made by the
Planning Commission to this Council, and a full investisation and
consideration of the facts having been made by this Council pertinent
to such petition; the Council determines that there are exceptional
or extraordinary circumstances or conditions applicable to the property
involved and to the in~ended use thereof that do not generally apply
to the property or classes of uses in the same zone or district in
which said property is located, and will not be inconsistent with the
general purposes of Ordinance No. 439;
This Council, therefore, grants a conditional variance from
the prOVisions of said Ordinance No. 439, but only so far as such
variance is necessary to parmi t the following described real property
to-wi t:
That portion of Lot 132 of Tract No. 2731, as per map recorded
in Book 33, Page 29 of Maps, records of said County described
as follows: Beginning at the southeast corner of said lot;
thence northerly parallel with the west line of said lot a
distance of 161.95 feet, more or less; thence westerly parallel

with the northerly line of said lot a distance of 65 feet,
more or less; thence southerly parallel with the westerly
line of said lot, a distance of 168.27 feet, more or less;
thence easterly along the northerly line of Duarte Road to
the point of beginning,
to be u$ed for the purpose of establishing and maintaining a real
estate office and the conducting of a real estate business therein.
This conditional variance is granted upon the following terms
and conditions:
1. That the property be used for the purpose of conducting
a real estate office as described herein, and for such other purposes
as are permitted by the zone or district in which the property is
now situated, and for no other purpose or purposes.
2. That not more than one (1) sign pertaining to said real
estate office or business be erected or maintained on said property,
which said sign shall not be larger than 18 inches by 24 inches in
size.
3. That the rights and privileges granted by this Ordinance
are extended to the persons affected thereby upon the express con-
dition that this Ordinance granting the privileges herein specified
shall continue for the duration of the present war in which the
United States of America is engaged and for six (6) months thereafter,
at which time said rights and privileges shall terminate, cease and
be of no further effect.
SECTION 2. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration'of fifteen (15) days from
the passage thereof, shall cause the sa.me to be published once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,
published and circulated in the City of Arcadia, and thirty (30) days
from and after the final pas sage thereof said Ordinance shall take
effect and be in force.

a regular meeting of the City COlillcil of the City of Arcadia, held
on the ~daw of February, 1945, by the affirmative vote of at least
three Councilmen, to-,tit:

ABSENT: Councilman Leeper
