HomeMy WebLinkAbout0540 ORDINANCE NO. 540 AN ORDINANCE OF THE CITY COUJlKJIL OF THE CITY OF AHCADIA, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR, ~iD GIVING NOTICE OF A SPECIAL ELEC- TION TO BE HELD IN THE CITY OF ARCADIA ON THE 8TH DAY OF h~Y, 1945, FOR THE PURPOSE OF SUru~ITTING TO THE ~UALIFIED VOTERS OF SAID CITY A PRO- POSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN Arrn~ICIPAL IMPROVEMENT. ~rlEREAS, the City Council of the City of Arcadia, California, did, on the 6th day of February, 1945, by a vote of more than two-thirds of the members of said City Council, adopt Resolution No.1359 entitled "Resolution of the City Council of the City of Arcadia, California, determining that the public interest and necessity demand the acquisition and construction of a certain municipal improvement, and making findings relating thereto," which said resolution was duly signed and approved by the 1myor of said City and attested and certified by the City Clerk of said City; NOW, THEREFORE, the City Council of the City of Arcadia DOES ORDAIN as follows: Section 1. That a special election be held, and the same is hereby called to be held, in the City of Arcadia, California, on the 8th day of May, 1945, for the purpose of submitting to the qualified voters of said city the proposition of incurring indebtedness and issuing bonds of said City therefor, in the amount hereinafter set forth, UI.~O VA-ell ...? T6 and for the objects and purposes set forth in said reso- lution and hereinafter stated. Section 2. That the objects and purposes for which said indebtedness is proposed to be incurred and bonds issued therefor are as follows: (J....... ,I !: '1 ,.J The acquisition and construction by the City of Arcadia of a certain municipal im- )cr- sewage treatment and disposal works, including \ I \ rilL ',L I I , provement, to wit, main trunk line sewers and the acquisition and construction of buildings, structures, and equi~nent, and the acquisition of all rights of way, pipe, labor and material necessary or convenient therefor. Section 3. That the estimated cost of the proposed lnunicipal improvement described in Section 2 ~ hereof is the sum of seven llundred fifty thousand dol- lars ($750,000.00); that the amount of the principal of the indebtedness to be incurred therefor is the sum of seven hundred fifty thousand dollars ($750,000.00), and that the maximum rate of interest to be paid on said indebtedness shall not exceed three and one-half per cent (3!%) per annum, payable semiannually. That if the proposition for the incurring of said indebtedness so submitted receives the requisite number of votes, to wit, two thirds of the votes of the qualified voters voting on said proposition, bords of said city in not exceeding the principal amount stated in such proposition shall be issued and sold for the objects and pUl'poses set forth herein. 2. \"'~ (;lA~ 0-1~ Section 4. That the pOlls for said election shall be opened at seven olclock. A.M., of the day of said election, and shall remain open continuously from said time until seven o'clock, P.M., of the sa~e day, when said polls shall be closed; provided, however, that if at said hour of closing there are any voters in any polling place or in line at the door thereof who are qualified to vote, and have not been able to do so since appearing, the polls thereat shall be kept open a suffi- cient time to enable them to vote, but no one who shall arrive at any polling place after seven olclock, P.M., of said day shall be entitled to vote although the polls thereat may be open when he arrives. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: Mark cross (X) on ballot ONLY WITH RUBBER STAI~; never with pen or pencil. INSTRUCTIONS TO VOTERS. To vote on any measure, stamp a cross (X) in the voting square after the word "Yes" or after the word "No." All marks, except the cross (X), are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear, or deface this ballot, return it to the inspector of election and obtain another. . . . . PROPOSITION: Shall the City of Arcadia incur a bonded indebtedness in the principal sum of $750,000.00 : for the acquisition and construction :YES by said city of a certain municipal improvement, to wit, main trunk line sewers and sewage treatment and dis- : posal works, including the acquisi- : tion and construction of buildings, structures, and equipment, and the - acquisition of all rights of way,pip~: NO labor, and material necessary or : convenient therefor? . . . . : . . . . : . . . '. : . . : : 3. ~o vAJ.-51?J A cross (X) stamped in the voting square after the word "YES" shall be counted in favor of the adoption of the question or proposition. A cross (X) stamped in the voting square after the word "NO" shall be counted against the adoption of the question or proposition. Section 5. That for the purpose of holding said election, there shall be and are hereby established seventeen election precincts, designated as hereinafter stated; that the polling places for the respective pre- cincts shall be the places hereinafter designated, and that the persons hereinafter named, being competent and qualified electors and residents of said city and of their respective election precincts, are hereby appointed offi- cers of election for their respective election precincts, and they shall hold said election and make return thereof in the manner provided by law. Voting Precinct A shall consist of regular elec- tion precinct No.14 in the City of Arcadia as now estab- lished for the holding of state and county elections. Polling Place: Raymond A. That in all particulars not recited in this ordinance, said election shall be held and con- ducted as provided by law for holding municipal elections in said city. Section 7. That the City Council of said City shall meet at its usual place of meeting in the City Court Room in the Police and Fire Department Station building at 50 \Vheeler Street in said City, on May 15, 1945, at 8:00 o'clock, P.M., of said day, and proceed to canvass the election returns and declare the result of said election. Section 8. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two-thirds of all of the members of the City Council of said City at an adjourned regular meeting of 9. \t{\..~ cd. 64/0 said Council, and its approval by the Mayor of said City, and shall cause said ordinance to be published once a week for two (2) weeks in THE ARCADIA TRIBUNE AiID NEWS, a weekly newspaper of general circulation in said city. No other nOD ice of such election need be given. Section 9. This ordinance shall take effect upon its passage.
