ORDINANCE NO. 541.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
MAKING AN EXCEPTION TO CERTAIN PROVISIONS OF ORDINANCE NO. 439 OF
SAID CITY OF ARCADIA, ADOPTED JUNE 28, 1940.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Petition of Rancho Santa Anita, Inc., a corporation,
having been filed in the office of the Planning Commission of the City of
Arcadia, pursuant to the provisions of Ordinance No. 439 of said City,
adopted June 28, 1940, asking that an exception be made affecting the
property described in said petition, and setting forth the specific
reasons therefor and the circumstances in connection therewith, and

recommendation having been made by the Planning Commission to this
Council, and a full investigation and consideration of the facts having
been made by this Council pertinent to this petition; thi.s Council

uses thereof that do not generally apply to the property or classes of
uses in the same zone or district in which said property is located,
and will not be inconsistent with the general purposes of Ordinance No.
439, and that said property should be excepted from the proVisions of
the zone created by said Ordinance No. 439 affecting said property,
but only 00 far as hereinafter set forth; and the requirements of said
Ordinance No. 439 pertaining to the consent of adjacent property owners
having been complied with;
This Council, therefore, excepts from the prOVisions of the
respective zone of Ordinance No. 439 of the City of Arcadia, the
property hereinafter 'described, but only so far as such exception is
necessary to permit the following described property to wit:
That portion of Lot 6 of Tract No. 949, in the City of

shown on map recorded in Book 17, Page 13 of Maps, in the
office of the Recorder of said County, described as follows:
Beginning at a point in the westerly line of said Lot 6,
said point being the southwest corner of that parcel of land

conveyed to Times-Mirror Company and described in deed re-
corded in Book 18465 Page 372 of Official Records of said
County; thence following the south boundary line of said
parcel of land so described as follows: N 890 01' 55" E,
317.87 feet;S 00 58' 05" E. 30 feet; N 890 01' 55" E, 225
feet to the southwest corner of said parcel of land; thence

shown on map recorded in Book 262 Pages 47 and 48 of Maps,
Records of said County, 219.73 feet; thence N 890 01' 55" E
along the southerly line of said Tract No. 12900, 30 feet;
thence S 00 58' 05" E along the southerly prolongation of the
center line of Placiente Road ( 60 feet in width) as the same

is shown on said map of Tract No. 12900, 210.27 feet; thence
S 890 011 55" W, 572.87 feet to the west line of Lot 6 of said
Tract No. 949; thence N 00 58' 05" W, along the west line of
said Lot 6, 460 feet to the point of beginning;
EXCEPTING therefrom any portion thereof within that parcel
of land conveyed to City of Arcadia described in deed
recorded in Book 18120 Page 208 of Official Records of said
County;
RESERVING therefrom an easement for Road and utility purposes

over the southerly 30 feet thereof, and the easterly 30 feet
of that portion thereof lying south of the south line of
said Tract No. 12900, together with the right to dedicate
same to the public use without f~ther consideration.
The above described parcel of land has a calculated area of
5.298 acres,
to be used and occupied in connection with the restaurant and bungalow-
hotel which were constructed and are now being operated pursuant to
exceptions granted by Ordinance No. 421 of the City of Arcadia, adopted
on the 10th day of October, 1939, and Ordinance No. 458 of the City of
Arcadia, adopted on the 22nd day of April, 1941, for the following
purposes:
(a) The constructing, maintaining and establishing of sixyY

(60) bungalow hotel living units, more or less, and garages for use
in connection therewith.
(b) A curio shop; beauty and barber sh0p, for use in rendering
personal service to guests of said bungalow hotel.
(c) A swimming pool, badminton and tennis courts.
This exception is granted upon the following conditions:
(1) That any and all buildings erected on said property shall
be of a similar style and type of architecture as have already been
constructed under the provisions of Ordinance No. 458 of the City of
Arcadia.
(2) That no building permit be granted for the construction
or erection of any building upon said property unless the plans and
specifications be first submitted to the Building Inspector of the

City of Arcadia, and that said plans and specifications and said
building shall in all particluars comply with the building ordinance
and sanitary regulations of the City of Arcadia.
(3) That said property shall not at any time be used for any
purpose: or purposes not specified in this Ordinance.
(4) That in case any of the provisions of this Ordinance are
violated, the property above described shall revert to Zone R-l as
defined in Ordinance No. 439, and the rights and privileges herein
granted shall terminate and cease, in the event that any such violation
is not terminated within thirty days, or such further time as the
~~City Council may decide that the owner of said property, in the exercise

~~f due diligence, requires to c~rrect such violation after the owner of
~ said property has been given written notice by the City Council of such
violation.
SECTION 2. The City Clerk shall certify to the adoption of this
Ordinance and prior to the expiration of fifteen (15) days from the
passage thereof, shall cause the same to be pUblished once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,
published and circulated in the City of Arcadia, and thirty (30) days
from and after the final passage thereof said Ordinance shall take effect
and be in force.
