ORDINANCE NO. 5~2.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
MAKING AN EXCEPTION TO CERTAIN PROVISIONS OF ORDINANCE NO. 439 OF SAID
CITY OF ARCADIA, ADOPrED JUNE 28, 1940.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Petition of Julia S. Durnell, having been filed
in the office of the Planning Commission of the City of Arcadia, pur-
suant to the provisions of Ordinance No. 439 of said City, adopted
June 28, 1940, asking that an exception be made affecting the property
described in said petition, and setting forth the specific reasons
therefor and the circumstances in connection therewith, and reconunen-
dation having been made by the Planning Commission to this Council, and
a full investigation and consideration of the facts having been made by
this Council pertinent to this petition; this Council determines that
there are exceptional or extraordinary circumstances or conditions
applicable to the property involved and to the intended uses thereof
that do not generally apply to the property or classes of uses in the
sane zone or district in which said property is located, and will not
be inconsistent with the general purposes of Ordinance No. 439, and
that said property should be excepted from the prOVisions of the zone
created by said Ordinance No. 439 affecting said property, but only so
far as hereinafter set forth; and the requirements of said Ordinance
No. 439 pertainin8 to the consent of adjacent property ovmers having
been complied with;
This Council, therefore, excepts from the prOVisions of the
respective zone of Ordinance No. 439 of the City of Arcadia, the property
hereinafter described, but only so far as such exception is necessary
to permit the following described property, to wit:
Those portions of Lots 5 and 6 of Tract No. 949, in the
City of Arcadia, County of Los Angeles, State of California,
as shown on map recorded in Book 17, Page 13 of Maps, on file
in the office of the Recorder of said County described as
follows:
Beginning at the northerly terminus of that certain curve

in the centerline of proposed Baldwin Avenue as the same
is shown on County Surveyor's Map No. B 111, Sheet 4,
on file in the Office of the Surveyor of said County as
having a rad~us of 1000 feet, a central angle of 290
441 30" and a length of 519.09 feet; thence southwesterly
along said curve 99.46 feet to the true point of beginning
(a radial bearing to said point bears north 620 591 0111
west); thence North 710 131 20" west, 130.43 feet to the
beginning of a tangent curve concave to the south and having a
radius of 1000 feet; thence westerly along said curve 150.90
feet to a point of intersection with the easterly line of Tract
No. 12786 as shown on map recorded in Book 263, Pages 3 and 4
of Maps, records of said County, said point being the easter-
ly terminus of the centerline of Hugo Reid Drive 60 feet in
width as shown on map of said Tract No. 12786; thence southerly
following the easterly line of said Tract No. 12786, south
100 07' 55" west, 30 feet, south 280 33' 01" west, 161.63
feet, south 20 581 25" west, 93.87 feet to the northwest
corner of that parcel of land described in deed, recorded in
Book 15638, Page 32 of Official Records of said County; thence

south 87 011 35" east along the north line of said parcel of
land 280.93 feet to the northeast corner of said parcel of
land, said northeast corner being a point in the hereinbefore
mentioned curved centerline of said proposed Baldwin Avenue
(a radial bearing to said point bears north 750 16' 59" west);
thence northerly along said curved centerline of said proposed
Baldwin Avenue 214.67 feet to the true point of beginning.
Together with the right to travel over the existing road
within the easterly 40 feet of said Lot 6, between the southerly
line of above described parcel and the northerly line of
Huntington Drive as it now exists. Grantors reserve all
rights, however, to dedicate said road to the public use.
Reserved from the herein first described parcel, however,
an easement for publiC road, drainage and utility purposes

over the\easterly 40 feet thereof and the northerly 30 feet
trereof together with the right to dedicate same to the
public use without further consideration,
to be used and occupied for the following purposes, to wit:
The erecting, constructing, enlarging, altering and repairing
of stables and cO!'rals, and conducting the business of training,
boarding and treating of horses on said property.
This exception is granted upon the following conditions:
(a) That no building permit be granted for the construction
or erection of any building upon said ~operty unless the plans and
specifications be first submitted to the Building Inspector of the City
of Arcadia, and that said plans and specifications and said building
shall in all particulars comply with the building Ordinance and sanitary
regula tions of the City of Arcadi a.
(b) That said property shall not at. any time be used for any
purpose or purposes not specified in this Ordinance.
(c) That in case any of the provisions of this Ordinance are
violated, the property above described shall revert to Zone R-l as
defined in Ordinance No. 439, and the rights and privileges herein
granted shall terminate and cease, in the event that any such violation
is not terminated within thirty days, or such further time as the City
Council may decide that the owner of said property, in the exercise of
due diligence, requires to correct such violation, after the owner of

said ~operty has been given written notice by the City Council of such
violation.
SECTION 2. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passage thereof, shall cause the same to be published once in the
Arcadia Tribune and Arcadia News, a newspaper of general circulation,

published and circulated in the City of Arcadia, and thirty (30) days
from and after the final passage thereof said Ordinance shall take
effect and be in farce.
I hereby certify that the foregoing Ordinance was adopted at
a regular meeting of the City Council of the City of Arcadia, held on
the 20thday of March
