AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
;,rAKING AN EXCEPTION TO CERTAIN PROVISIONS OF ORDIHANCE NO. 439

SECTION 1. Petition of Edith J. Bartron, having been
filed in the office of the Plannins Commission of the City of
Arcadia, pursuant to the provisions of Ordinance No. 439 of said
City, adopted June 28, 1940, asking that an exception be made
affecting the property described in said petition, and setting
forth the specific reasons therefor and the circumstances in
connection therewith, and recomnendation having been made by the
Planning Commission to this Council, and a full investisation and
consideration of the facts havin(l been made by this Council
pertinent to this petition; this Council determines that there are
exceptional or extraordinary circumstances or conditions applicable
to the property involved and to the intended uses thereof that do
not generally apply to the property or classes of uses in the same
zone or district in which said property is located, an1 will not
be inconsistent with the 3eneral purposes of Ordinance No. 439,
and that said property shoul'J be excepted from the provisions of
the zone created by said Ordinance No. 439 affecting said property,
but only so far as hereinafter set forth; and the requirements of
said Ordinance No. 439 pertainin~ to the consent of adjacent
property owners having been complied with;
This Council, ther efore, excepts from the prov isions of
the respective zone of Ordinance No. 439 of the City of Arcadia,
the property hereinafter described, but only inso.far as such
exception is necessary to permit the erecting and maintaining on
the followinG described property, to wit:
A part of Lot 1, Tract 4090, as per map recorded in
Book 43, at Pae;e 47 of r.laps, records of Los An3eles
COWity, State of California, which property is more
fully described as follows:
Beginning at the, southwest corner of Holly Avenue, and

Duarte Road, thence south along the westerly line of
Holly Avenue a dista~ce of 362.61; thence westerly one
hundred eighty-seven (187') feet; thence northerly,
parallel to Holly Avenue, to the south line of Duarte
Road; thence easterly along the south line of Duarte
Road, to the point of beginning,
of a Methodist Church, and the use and occupancy of said property
for religious purposes.
This exception is granted upon the following conditions:
(a) That no building permit be granted for the construction
or erection of any building upon said property unless the plans and
specifications be first submitted to the Building Inspector of the
City of Arcadia, and that said plans and specifications and said build-
ing shall in all particulars comply with the building ordinance and
sanitary regulations of the City of Arcadia.
(b) That said property shall not at any time be used for any
purpose or pl~poses not allowed in Zone R-l of the City of Arcadia,
except as provided in this Ordinance.
(c) That the southerly sixty (60') feet of said property shall
not be used for parking of motor vehicles.
(d) That in case any of the provisions of this Ordinance are
violated, the property above described shall revert to Zone R-l as
defined in Ordinance No. 439, and the rights and privileges herein
granted shall terminate and cease, in the event that any such violation
is not terminated vdthin thirty days, or such further time as the City
Council may decide that the owner of said property, in the exercise of
due dili~ence, requires to correct such violation after the ovmer of
said property has been given written notice by the City Council of
such violation.
SECTION 2. The City Clerk shall certify to the adoption
of this Ordinance and prior to the expiration of fifteen (15) days
from the passage thereof, shall cause the same to be published

once in the Arcadia Tribune and Arcadia News, a newspaper of
general circulation, published and circulated in the City of
Arcadia, and thirty (30) days from and after the final passa~e
thereof said Ordinance shall take effect and be in force.
I hereby certify that the fore~oing Ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the mn-day of
