AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
;,IAKING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE NO.
439 OF SAID CITY OF ARCADIA, PURSUANT TO SECTION 25 THEREOF.
THE CITY COUNCIL OF TIill CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:
SECTION 1. A petition signed by Elizabeth B. Smith,
having been filed in the office of the City Planning Commission pursuant
to Section 25 of Ordinance N o. 439, entitled "An Ordinance of the City
Council of the City of Arcadia, establishing in said City of Arcadia,
zones or districts and regulating therein the use of property, height
of bui~dings and requiring open spaces for light ~~d ventilation; to
regulate and restrict the location of trades and industries and the
location of buildings designed for specified uses; providing for the
enforcement and prescI'ibin8 penalties for the violation thereof.",
adopted on the 28th day of June, 1940, asking that a conditional variance
be made affecting the property described in said petition and setting
forth the specific re~sons therefor and the circumstances in connection
therewith, and recommendation having been made by the Planning Comrrassion
to this COcIDcil, and a full investigation and consideration of the facts
having been made by this Council pertinent to such petition; this Council
determines that there are exceptional or extraordinary clrcwnstances or
conditions applicable to the property involved and to the intended use
thereof that do not generally apply to the property or classes of uses in
the same zone or district in which said property is located, and will not
be inconsistent with the general purposes of Ordinance No. 439;
ThisCouncil therefore grants a conditional variance from
the provisions of said GTdinance No. 439, but only so far as such
variance is necessary to permit the following described real property,
to-wi t:
The Southerly forty (40) feet of Lots 2 and 3 of
Tract 6985 in the City of Arcadia, County of Los
Angeles, State of California, as shown on Map re-
corded in Book 106 at Page 53 of Maps in the office
of the County Recorder of Said County;

to be used for the purpose of manufacturing wooden toys on said
premises.
This conditional variance is granted upon the follovang
terms and conditions:
1- That the property be used for the purpose of manu-
f~cturing wooden toys as described herein, and for such other purposes
as are permitted by the zone or district in Imich the property is now
situated, and for no other purpose or purposes.
2- That the rights a~d prfuvileges granted by this Ordinance
are accepted by the person affected thereby upon the express condi ti on that
this Ordinance granting the privileges herein specified shall terminate,
\ close and have no further effect after June 30th, 1948.
3- That no additional buildings be erected on said
premises in connection with such use of said property and that no
building now on said property be enlarged in connection with such use.
4- That upon any violation of any of the provisions of
this Ordinance, the uses herein permitted shall cease and terminate
and the property above described shall revert to and become a part of
the zone in which the property is now situated.
SECTION 2. The City Clerk shall certify to the adoption
of this Ordinance and prior to the expiration of fifteen (15) dews from
the passage thereof, shall cause the same to be published once in the
Arcadia Tribune and Arcgdia News, a newspaper of general ~irculation,
published and circulated in the City of ArCadia, and thirty (30) days
from and after the final passage thereof said. Ordinance shall take
effect and be in force.
I hereby certify that the foregoing Ordinance was adopted at
a regular meeting of the City Council of the City of Arcadia, held on
