A Petition of Rancho Santa Anita, Inc., having been filed in the, office of the Planning Commiss ion of the City of Arcadia, pursuant to the provisions of Section 25 of Ordinance No. 439 of the City of Arcadia, adopted June 28, 1940, askin~ that the' property described in said petition be excepted from Zone R-l of said City as established by said Ordinance No. 439, to permit the construction and maintenance of a Bun~alo~ Hotel, and recommendation havin~ been made by the Pl~nnin~ Commission to this Council th~t said exception be granted, and a full invosti;ation and consideration of the facts havin~ been made by this Counc:l.l pertinent to such petition, t:lis Council determines there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended use of the property t~at do not apply generally to the property or class of uses in the s~ne zqne or district in ~hich said property is located; that in order to :?revent substantial property ri~hts of applicant from being curtailed said property should be excepted from the provisions of Zone R-l of Ordinance No. 439 of said City of Arcadia, but only so far as hereinafter set forth. Above described parcel of land ,1as a calculated area of 5.558 Acres~ to be used and occupied for the purpose of operating and maintaining a bunJalotl hotel consistin~ of t\'lelve (12) buildin:;s containin~ sixty (60) units; two (2) dressing rooms and a ~ara~e with a capacity of housing t\'lenty-t\'lo (22) automo~iles, a swimming pool with infiltration plant, shuffle board courts, badminton courts and a croquet ground, to be used and operated in connection \"Ii th the operation of said bun.;alo\"l hotel. This exce'ption is ,'~ranted upon the follo\"lin'i condit ions: ~~) That no buildin:; permit be ~ranted for the construction \ or erection of any bui~1:tng upon said !1rODerty un:bessthe plans and rNJ)~D a,..c/, .l./.5?' -2- specifications be first submitted to the Building Inspector of the City of Arcadia, and that said plans and specifications and said building shall in all particulars comply .7ith the buildinr:; Ordinance and sanitary re3ulations of the City of Arcadia. (b) That no building permit be granted for the construction or erection of any buildinss upon said property unless the total reasonable value of said buildings be not less than One Hundred Thousand (\,nOO,ooo.OO) Dollars. (c) That construction of the buildin~s to be occupied and used for the purposes of conducting the business described herein shall be~in ~ithin a period of six (6) months fr~m and after the effective date of this Ordinance, and that said buildin~shall be completed within a period of six (6) months from and after the foundation of any buildin~ has been laid. (d) That said property shall not at any time be used for any purpose or purposes not specified in this Ordinance. (e) That in case any of the provisions of this Ordinance are violated, the property above described shall revert to Zone R-l as defined in Ordinance No. 439, and the rights and privileges herein granted shall terminate and cease, in the event that any such violation is not terminated ~ithin thirty days, or such further time as the City Council may decide that the owner of said property, in the exercise of due dili3ence, requires to correct such violation, after the o~ner of said property has bean ~iven written notice by the City CoUncil of such violation. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and prior to the expi~ation of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia Neus, a neuspaper of ;\eneral circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passa~e thereof said Ordinance shall take -3- \ , """'1-.:.':'" (J/f-~.! ~?~.JY effect and be in force.
