THE CITY COuNCIL OF THE CI'ry OF ARCADIA DOES ORDAIN AS POLLO.:S: SECTION 1. That a certain document, three (3) copies of qhich are on file in the office of the City Clerk of the City of Arcadia, being marked and desiJnated as "Uniform Buildin3 Code, 1940 Edition, published Llay 1, 1940, by Paeific Coast BuildinG Officials I Conference, II tOGether uith Section 802 (e), to be found on page 290 in the Appendix portion of said Code, relatin~ to reviewinG stands; and Section 2204, to be found on pages 290, 291 snd 292 in the Appendix portion of said Code, relatinG to foundation requirements; and Section 2312, to be found on pages 292 to 206 in the Appendix portion of said Code, relatin~ to lateral bracin~; and Soction 2529, to be found on pages 297 and 298 in the Appendix portion of said Code, relating to termite prevention; and together \'Ii tb Chapter 47, Sections 4701 to 4721, both inclusive, to be found on pages 301 to 312, both inclusive, in the Appendix portion of said Code, relating to plastering; and excepting Secti:ms 303, 304 and 305, to be found on paGes 28 and 29 of said Code, relatinc; to violations and penalties, and subsection "(a)1I of Section 1601, to be found on paGe 72 of said Code, relating to the establish- n~nt of Fire Zones, uhich are hereby expressly excluded from said Code and are not hereby adopted; be and the same is hereby adopted as the Building Code of the City of Arcadia for re3ulatinr; the erection, constr1.lc- tion, enlargement, alteration, repair, moving, removal, conversion, dom~ olition, occu~ancy, equipment, use, beight, area and maintenance of all buildinGS or ~truct\~es in the City of Arcadia; and each and all of the regulations, provisions, penalties, conditions and terms of such IIUniform Building Code 1940 Edition, published Day 1, 1940, by Pacific Coast Build- ing Officials' Conference,1I includin.:; such portions of the Appendix thereof, heretoforo specifically reforred to on file in the office of the City Clerk, are hereby referred to, adopted, and made a part horeof as if fully set 0 ut in this Ordinance. Section 2. Such notice shall be at once transmitted to the City Council, Imich City Council shall arrange for a hearinG on the particular point raised. Such v:ritten notice shall be accompanied by the sum of Pive (CS.OO) Dollars, ptlyable to the City. If the appeal is denied such fee shall be retained by the City, otherwise the fee shall be returned to the appellant. SECTION :;" In order to determine the suitability of alternate materials and types of conntruction and to provide for reasonable interp- retations of the provisions of this Code, the City Cotlncilshall con- stitute a Board of Examiners and Appeals. The Board shall adopt reasonable rules ani re0ulations for conductin~ its investi=ations and shall render all de~isions and findin~s in writing to the Building Inspector I"/ith a duplicate copy etb the appellant. The Board of Exmainers and Appeals may interpret the provisions of this Code to COVEll' a special case, if it appears that the provisions of this Code do not definitely cover the point raised or that a manifest injustice mi~ht be c~one, provided that evory such decision shall be by unan~Qns vote of tr.e Board of Examiners and Appeals. Decisions as to the use of alternate materials and types .of construction shall be by majority vote and if not permitted by this Code shall become effective only when authorized by an amendment to this Code. SECTION 4. It shall be unlawful for any person, f.irm or corpor- ation to erect, construct, enlarGe, alter, repair, move, remove, demolish, convert, equip, use or occupy or maintain any building and structure or any pODtion of any blulding and structure in the City contrary to or in violation of any provision of this Code or to cause, permit or suffer the same to be done. Any person, firm or corporation violating any of the provisions of this Code shall be deemed:;uilty REPIALED '" J r~r 1\G. .., I of a misdemeanor. and each such person -2- llWiXiP aed r~y' . :.. -:.. ~. ." .. shall be deemed Guilty of a separate offense for each and every day or portion thereof durinG uhich any violation of any of the provisions of this Code is corrmitted, continued or permitted, and upon the conviction of any such violation such person shall be punishable by a fine of not more than (;300.00, or by imprisonment in the city jailor in the County Jail of the County of tos Anceles, ror not more than three months, or by both such fine and imprisonment. The issuance or GrantinG of a permit or approval. of plans and specifications shall not be deemed or construed to be a permit f.or, or any approval 01' any violation of any of the provisions of this Code. No permit presuming to Give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use uhich it authorizes is lauful. The issuance of a permit upon plans and specifications shall not prevent the Buildin~ Inspector from thereafter requirinG the. cor- rection of errors in said plans and specifications or froJY. preventing buildin3 operations beinG carried on thereunder ~hen in violation of this Code or of any other ordinance of the City. :every permit issued by the BuildinG Inspector under the pro- visions of this Cod'3 shall expire by limitation and become null and void, if the buildin:; or -:fork authorized by such permit is not commenced \7ithin 90 days from the date of such psrmit, or if the building or \"fork authorized by such permit is s'.lspended or abandoned at any time after the ,10rk is commenced for a pe riod of 90 days. Before such \fork can be recommenced a ne\'! permit shall be flrstobtainod so to do and the fee therefor shall be one-half the amolmt required for a new permit, provided no chanGes have been made or uill be made in the oriGinal plans and specifications for such work; and prov~ded, further, that such suspensiOn or abandolliucnt has not exceeded one year. SECTION 5" That Ordinance lJo. 385 of the City 0 f Arcadia, adopted on. the 16th day of September, 1938, is hereby repealed. SECTION 6.. That the entire incorporated area of the City of Arcadia is hereby de,clr.red to be and is hereby established as a Fire District and said fire district shall be knO'.m and designated as Fire -3- 'NnfllE~ such territory or IlEl'EALEO...r g ORO. 110. The follorlinl3 Ordinances are hereby specifically repcajled: Ordinanc€ No. 256 of the City of Arcadia, adopted on the 16th day of June, 1931; Ordinance No. 296 of the City of Arcadia, adopted on the 3rd day of September, 1935j Ordinance No. 344 of the City of Arcadia, adopted on the 4th day of November, 1936j Ordinance No. 414 of the City of Arcadia, ado~ted on the 1st day of August, 1939. SBCTION 8~ The City Clerk s'1811 . certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of General circuxation, published andcirculuted in the Oity of Arcadia, and thir'ty (30) days from and after the final passage thereof said Ordinance shall bake effect and be in force, I hereby certify that the foro::;oing Ordinance '.,as adopted at a regular meetin~ of the City Council of the City of Arcadia, held on the 21st day of October , 1941, by the affirmative .vote of at least throe Councilmen, to-\7it: AYES: Courwilmen, Adcock, Bolz, Leeper, Ormsby and Perkins.
