'/ ecJ AN ORDIN,ANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROVIDING SPECIFICATIONS FOR STREET WORK; REGULATING, THE WIDTH OF STREETS, ALLEYS AND PARKWAYS AND ALSO REGULATING THE INSTALLATION OF WATER MAINS IN NE~ SUBDIVISIONS IN SAID CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA roES ORDAIN AS FOLL0\7S: SECTION ~. That the public interest end convenience require and necessity demands that all new subdivisions hereafter laid out in said City of Arcadia shall conform to the following: (a) All streets must be not less than sixty (60) feet in width, and shall be improvEld with curbs to a width of thirty-six (36) feet or more. Said improvement to consist of Oil Macadam pre-mix or other pavement of / , ~WlE"-\)tI)similar quality as Dlay be detennined by said City Council, and such pave- OR\). Cast iron pipe, Class 150, Government Specifications, or Cast iron pipe equivalent in quality thereto, where water pressure is not in excess of 150 pounds to the square inch, and cast iron pipe, Class 200, Government Specificlltions, or Gast iron pipe equivalent in quality tbereto wbere water pressure is in excess of 150 pounds to tbe.square inch, or 2. Cement Asbestos pressure pipe, Class 150, or Cement pipe it-t~o~equiValent in qualit:y tbereto, \yhere water pressure is not in excess of ~ ~ \\0. All water mains in excess of twelve (12) inches in diameter shall be of: 1. 3/16 inohes riveted or welded steel wrapped pipe, or steel pipe equivalent in quality thereto, or 2. Cement asbestos pressure pipe, or cement pipe equivalent in quality thereto. The entirl3 cost of installing suoh water mains shall be borne by the proprietors, ()wners, or sellers of such subdiVision. ~o~ (d) Whenever any .water mains and service connections are ~~~Il.\\. <:\,:~.required to be installed in arty new subdivision as provided in this ..(\I..Ordinanoe, the proprj~etors, owners or sellers of any such subdivision shall file a uritten application \nth the ~ater Superintendent of said City of Arcadia for the installation of such water mains and service connectionS whereupon said Water Superintendent shall submit to such proprietor, owner or seller a written estimate of the cost of same. (e) Vfuenever a uater connection is requested on any street which is paved and same requires tbe tearing up and replacing of any -2- -',~ \~Q""" o.,d. i)if' portion of such pavement, the person, firm or corporation requiring such connection shall p~ to said City of Arcadia the s= of Five ($5.00) Dollars per square yard for same in addition to the established charge for such water connection. SECTION 2. If the proprietors, ovmers or sellers of said subdivision shall request said City Council to accept water mains or approve the Map or Plat thereof prior to the actual completion of any of the work hereinabove specified, then said City Council may accept and approve said Map or Plat and/or accept said water mains if such proprietors, o\mers or sellers shall execute a good and sufficient. surety ,company's bond to said City of Arcudia for the benefit and security of the purchaser or purchasers of lots 1n such subdivision, in an amount which shall equal the estimated cost of the \./ork hereinabove described; and conditioned that all of the work required hereunder in said subdivision shall be completed within such time as shall be designated by a resolution duly adopted by said City Council at any regular meeting thereof; and conditioned further that such mrk shall be <ione in accordance with the provisions of this Ordi- nance and any Specifications of the City of Arcadia relating thereto and on file in the office of said Street Superintendent. If said o\mers, proprietors or sellers shall neglect OD fail for any reason to perform such work, in said subdivision within the time designated by said City Council, as hereinabove specified, said bond shall be declared forfeited and the amount received or collected thereon shall be used by said City for the improvement of said subdivision as herein required, and the surplus, if any, shall be returned to the owners, proprietors or sellers who executed and filed said bond, provided however, that i~ said Map or Plat and/or said water mains shall be accepted and approved by said City Council prior to the actual performanoe of such \rork, such proprietors, owners or sellers shall include in each and every deed to the purChaser or purchasers of any lot or parcel of land within said subdivision a stipulation or clause to the effect that all of the work required to be done hereunder shall be performed in accordOOlce with the provisions of this Ordinance and any ordinances amendato~r thereof. SECTION 3.. Any right accrued to the City of Arcadia under the provisions of Orcinance No. 193 of said City or any -3- amendment ,., \ '.\ . (},/Lc! '1fP - thereto before this Ordinance takes effect is not affected by this Ordinance. SECT10N .~. The following Ordinances are hereby repealed except as 11mi ted by Section 3 hereof: OrdinanCEI 'No. 193, passed am approved March 2, 1927, OrdinancE! No. 307, passed and approved May 7, 1935, OrdinancE' No. 444, passed and approved September 3, 1940. SECTION :;j. Tbe City Clerk shall certify to the adoption 0 f this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be pUblished once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. I hereby certify that the foregoing Ordinance was adopted at a refJu1ur meeting of the City Council of the City of Arcadia, held on the 21~t day of Jll1y , 1942, by the affirmative vote of at least three Councilmen, to-wit: AYES: Councilmen, Adcocl:, Jonos. MAINS IN NEW SUBDIVISIONS IN SAID CITY OF ARCADIA. .THE CITY COUNCIL\.OF THE CITY OF ARCADIA DOES OR- DAIN AS FOLLOWS; SECTION 1.
