ORDINANCE NO. 491.
AN ORDIN.IlliCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
fJAKING A CONDITIO~tL VARIANCE TO CERTAIN PROVISIONS OF ORDIKANCE NO.
439 OF SAID CITY OF ARCADIA, PURSUANT TO SECTION 25 THEREOF, AND
REPEALING ORDINANCl~ NO. 72 AND ORDINANCE NO. 124 OF SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLO:IS :
SECTION 1. A petition signed.by Daniel W. Jackson and
Claudine Jackson, having been filed in the office of the City Planning
Corr.r,lission pursuant; to Section 25 of Ordinance No. 439, entitled "An
Ordinance of the C1.ty Council of the City of Arcadia, establishing in
said City of Arcadia, zones or districts and regulating therein the use
of property, height of buildings and requiring open spaces for light and
ventilation; to regulate and restrict the location of trades and industries
and the location of buildings designed for specified use; providing for
the enforcement and prescribing penalties for the violation thereof.",
adopted on the 28th day of June. 1940, asking that a conditional variance
be made affecting the property described in said petition and setting forth
the specific reasons therefor and the circumstances in connection there-
with, and recommend:9.tion having been made by the Planning Commission to
this Council, .and a full investigation and consideration of the facts huving
been made by this Council pertinent to such petition; the Council determines
that there are exceptional or extraordinary ci rcums tanca s or condi tions
applicable to the property involved and to the intended use thereof that do
not generally apply to

This Council, therefore, grants a conditional variance from the
provisionaof'said Ordinance No. 439, but only so far as such variance is
necessary to permit the following described real property, to-wit:
A portion of Arcadia Acreage Tract described as commencing at
the southeast corner of Lot 31 of said Tract; thence northerly a distance
of 117 feet along the west line of Second Avenue; thence in a westerly
direction a distance of 210 feet parallel to the south line of said Lot 31;
thence in a sO'.ltherl:r direction a distance of 117 feet parallel to the V/est
line of said Second Avenue up to and adjoininz the south line of said Lot
31; and thence in an easterly direction a distance of 210 feet

south line of said Lot 31 to the point of beginning, as per Book 10,
Page 18 of Maps, Records of Los An~eles County, California,
to be used for the purpose of conducting a private boarding home for
abnormal children.
This conditional variance is granted upon the following terms
and conditions:
1. That the property be used for the purpose of conducting a
private boarding hrnne for abnormal children as described herein, and for
such other purposes as are permitted by the zone or district in which the
property is now situated, and for no other purpose or purposes.
2. That as a prerequisite to the use' of said property as a private
boarding home for abnormal children, it shall be necessary for the operator
of said home to obtnin and hold a valid license issued by the County of
Los Angeles 01' the State of California public body having charge of the
issuance of licenses for the care of abnormal minors.
3. That no enlargement of the facilities on said premises shall
be made in order to care for'a greater n~ber of persons, without written
permission of this Council having been first obtained.
4. ~~at the rights and privileges granted by this Ordinance
are accepted by the persons affected thereby ~pon the express condition
that this Ordinance granting the privileges herein specified shall terminate,
cease and have no further effect after five years from the effective date
of this Ordinance.
5. That upon any violation of any of the provisions of this
Ordinance, the uses herein permitted shall cease and terminate and the
property above described shall revert to and become a part of the zone in
which the property is now situated.
~ION 2. That Ordinance No. 72, heretofore adopted on the 7th
day of November, 19l'7, and Ordinance No. 124, heretofore adopted on the
2nd day of May, 1923. are hereby repealed.
SECTION 3. The City Clerk shall certify to the adoption of
this Ordinance and. pl~ior to the expiration of fifteen (15) days from the
passage thereof., shall cause the same to be published once in the Arcadia
and. Arcadia Ilews, a newspaper of general circulation, published and

circulated in the City of Arcadia, and thirty (30) days from and after
the final passage thereof said Ordinance shall take effect and be in
force.
