That Section 44 of Ordinance No. 323 of the City of Arcadia, entitled "I~ Ordinance of the City Council of the City of Arcadla relatine to fire protection and fire prevention, re8ulating the burninG of brush, rubbish or other materials, for tho protection of fire hose, fire apPsNltus and the water system of said City of Arcadia, pro- hibi tins tbe tak:l.nc; of I'Jater ui thou.t permis sion of an authorized officer of said City, establishing an int'\iners.tor d<.strict, creatin~ the office of Chief of the Fire Department, establishinG a district north of Foothill Boulevard as a fi~e hazard, providing for incinerators in.residential districts, repealinG Ordinances lIos. 120, 154, 199 and all Ordinances in conflict hereuith and providin[5 a penalty for the violation thereof.", adopted Septer,lber 17, 1935, be and the same is. hereby arnEl'nded to read as follows: rsECT10,~ 44. It shall be unlawful for any person to maintain or use, or cause or penlit to be maintained or used any portable Gasoline filled tank or bUB3Y that has a capacity of more than fifty (50) Gallons, or that is not constructed and approved as provided in this :3ection. The gasoline shall be pumped directly into the reservoir or tank of the motor vehicle from such porto.ble fillin ~ tank or bug::;y. Before any such portabl;:; fillin:; tank or buSt3Y or any such pump is used, the same, and the desien and type thereof, shall be approved by the Chief of the Fire Department. SECTION 2. ~~at Ordinance No. 323 of said City be further amended by addin:; thereto a new section to be known and numbered as Section 44.1, and to read as follows: SEC'l'IOH 44.1. It shall be unlawful for any person to store or keep, or cause or permit to be stored or kept, or to deliver or cause to be delivered for stora13e more than one (1) [\allon ,of ~asoline \7ith- in o.ny public cara.;e, auto'lobile fillin::; sta'c.i.on, auto!'Jobile -1- Il\lf\rY".... parking sto.tion, dotd, 19? ,... ~-. private rosidence.. court, apartment house or hotel, or \1ithin any buildin~ or struc.;ure, or upon any premises, except such :;asoline as may be contained In the tank of a motor lIlehlcle, except as hereinbefore provided, or in the. follo\1in~ manner: . (a.) All gasoline shall be stored in a tank or tanks outside of any buildin3, 6nd every such tank or tanks shall be thoro~hly tested for leaks and coated \"Ii th tar or other rust resistinG material before being set in place. Before any such stora:;e tank is used, the sane shall be approveu by the Chief of -the Fire Department. (b) Every such stora~e tank shall be buried under Ground. The top of each tar~ shall be at least four (4) feet belo~ the surface of the zround and. e,t 10ast one (1) foot below the lowest floor level of any buildin~ on the premises. The space ~bove the top of each such tank shall be filled \"lith earth so as to be level with the surface of tile surroundinJ ground. ( c) Ho such sto ra[!;e tank or piping shall be covered \7i th e:r th or any other material until after the same shall have been inspected by the Chief .of the Fire Department. (d) Every p~p or device used for extracting 60.s01ine from such stor8.3e tanks shall be set upon and firmly affixed to a solid foun- dation subject to,the approval of the Chief of the Fire Department. It shall be unla\"Tful to install or maintain any type of clear vision or visible ;:;asoline pump or dispenser inside of any building. (e) All pipe used shall be Julvanized iron. Every pipe shall lead out of tee top of the tank with which it is connected, except when connected \rlth a pressure tank. A vent pmpe from each such tank -2- .'DliXaI d~ ~9? _. .. ,~'" ..... ..--- shall extend up to the outside of the buildin~ to a point not less than ei~hteen (18) inches above the roof, fire \/all, or any obstruction on such builuin3, and in no case shall the Vent pipe pe less than twelve (l2) feet in hei~ht, and such vent shall be provided I'uth a standard. return ell and provided with a copper or brass Gauze not coarser than thirty mesh. Such vent pipe shall be of not less than one (1) inch inside diameter, and shall not extend into said storace tank for a distance of :cnore than one (1) inch. (f) Vfuere a series of tanks are installed which are desi~ned and inten1ed to be used to store the same type of fuel, \ent pipes may run into a main riser. Individual pipes shall be connected hov/ever to the riSl3r not less than one (1) foot above the level of the top of the hijhest tank or reservoir. Tho main vent pipe throush which t\70 or more tanks are vented shall not be less than one and one-quarter (li) inch in diame~er. (g) A f~lling pipe shall be connected fdth each and every such storaGe tank. Every such pipe shall extend up to the 3round level, and shall be capped with a \7ater ti..:ht SCllew cap. (h) Nothing in this section contained shall be deemed Or construed to prohibit the storage of gasoline or other motor fuel above c;round by any' person enBa~ed in the business of sellinc; or distrib- uting gasoline or other motor fuel at I'Tholesale, provided, that all such stor!l3e tanks shall be constructed of the materials and si1all conform to the rules, regulations and requirements of the Board of Fire Underwriters and the State Fire ~arshal; provided, that the code of the Board of Fire Underwriters, and the rules, regulations and requirements of the state Fire ~arshal stlall govern and control the installation and main- tenance of all gasoline stora~e tanks not specifically covered by the provisions of this Ordinance. SECTION :S. PEHAL'l'Y FOR VIOLl,TIOIl OF THIS ORDIN.iII~CE. That any person, firm or corporation violating any of the grovlsions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be plmishable by a fine not exoeeding 0300.00 or by imprisonment in the City Jail of said City of Arcadia or in the County Jail of the County cf Los An3eles, s.tate of California, at -3 - ..,OEXe,l) the discretion acL 19t ._' '.-.. -~ of the co~ittinBma3istrate, for a period not exceeding three months, or by both such fine and imprisoIlI'lent. SECT lOll 4.
