Wray, Deputy Director of Development Services/City Engineer PIS SUBJECT: AUTHORIZE THE CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT WITH CONVERSE CONSULTANTS FOR TESTING, AND MONITORING OF HAZARDOUS MATERIALS IN UPPER AND LOWER CITY HALL IN THE AMOUNT OF $22,000 AND INCLUDE A 10% CONTINGENCY Recommendation: Approve AUTHORIZE THE CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT WITH AMERICAN TECHNOLOGIES, INC. FOR THE ASBESTOS ABATEMENT IN UPPER AND LOWER CITY HALL IN THE AMOUNT OF $19,000 AND INCLUDE A 10% CONTINGENCY Recommendation: Approve SUMMARY On June 21, 2011, the City Council entered into a contract with CA Construction for the Energy Efficiency Retrofits to City Hall. The construction started in early October and is currently in progress. On October 26, 2011, the contractor discovered an asbestos wrapped pipe which required abatement above the old structural ceiling in upper City Hall. Staff instructed the contractor to stay out of the area and contacted Converse Consultants to provide assistance on the inspection and removal of the asbestos. Converse also advised the City on the treatment of an asbestos wrapped pipe in lower City Hall and proposed air testing in all buildings for airborne materials. Converse Consultants has submitted a proposal for the testing and monitoring services in the amount of $22,000. Staff authorized Converse to proceed immediately with the work for the safety of everyone in the building and to minimize construction delays. Converse made recommendations for the abatement and also recommended American Technologies, Inc. (ATI), a certified hazardous materials abatement contractor, to Staff Report December 6, 2011 Page 2 perform the work. ATI submitted a proposal for the abatement in the amount of $19,000. Staff recommends that the City Council authorize the City Manager to enter into a Professional Services Agreement with Converse Consultants and ATI. DISCUSSION During the design phase of the Energy Efficiency Retrofits to City Hall, the City retained the services of Converse Consultants through a formal selection process to perform inspection and testing of potentially hazardous materials in both upper and lower City Hall. Converse Consultants is a highly qualified firm in the field of hazardous materials inspection, testing, and monitoring and has proposed competitively on previous City projects. Their inspection and testing identified some asbestos in the mechanical room and lead paint on the window frames. This information was included in the project bid specifications with instructions to the contractor to remove the materials. On June 21, 2011, the City Council entered into a contract with CA Construction for the Energy Efficiency Retrofits to City Hall. The construction started in early October at the north end of upper City Hall and is progressing through both buildings. In late October, the contractor abated the asbestos in the mechanical room and the post abatement testing was successful. On October 26, 2011, while performing demolition of the old ceiling in the south portion of upper City Hall, the contractor discovered an asbestos wrapped pipe above the old structural ceiling. Only cursory inspections were previously conducted above the structural ceiling. Due to the uncertainty of the extent of the exposure and the length of pipe, the contractor was instructed to stay out of a relatively large area of upper City Hall until the City could inspect and contain the problem. Staff contacted Converse Consultants to provide assistance on the inspection and removal of the asbestos. Converse was selected because of their previous work on and familiarity with City Hall, and their immediate availability. Converse responded on October 27, 2011, with a thorough inspection of the pipe and the asbestos and provided the City with abatement options. They were also asked to perform air testing within the public spaces and employee workstations to check the levels, if any, of asbestos, fiber glass, and dust. Staff also consulted with Converse on the disposition of two abandoned, asbestos-wrapped water lines in lower City Hall. The asbestos wrap is in good condition and no abatement is necessary; however, Converse did recommend as an option to encase the ends to further protect the material in place. Converse Consultants has submitted a proposal for the testing and monitoring of the asbestos and the air testing throughout in the amount of $22,000. Staff authorized Converse to proceed immediately with the work for the safety of all those in the buildings and to minimize construction delays. Based on Converse's recommendations, staff decided to completely abate the pipe in upper City Hall and encase the pipe in lower City hall. Converse also recommended American Technologies, Inc. (ATI), a Staff Report December 6, 2011 Page 3 certified hazardous materials abatement contractor, to perform the work based on their experience under similar circumstances and their competitive prices. ATI submitted a proposal for the abatement in the amount of$19,000. Staff authorized ATI to proceed. The Air tests for the employee and public spaces showed no measurable amounts of asbestos and the fiberglass and dust amounts were well below the state and federal standards. Now that the old ceiling has been removed entirely in both buildings and the space above thoroughly inspected, no additional hazardous materials issues are anticipated beyond the window paint. FISCAL IMPACT There are sufficient funds available in the project budget to cover these costs. The project was budgeted in both the fiscal year 2009/10 and 2010/11 Capital Improvement Programs and there are sufficient funds available for these services. RECOMMENDATION Authorize the City Manager to enter into a Professional Services Agreement with Converse Consultants for testing, and monitoring of hazardous materials in upper and lower City Hall in the amount of$22,000 and include a 10% contingency. Authorize the City Manager to enter into a Professional Services Agreement with ATI for the asbestos abatement in upper and lower City Hall in the amount of $19,000 and include a 10% contingency.
