AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
REGULATIHG THE DISCHhRGE, USE AND SALE OF FIRE:'.IORKS IN
REPEALING ORDINANCE NO. 221 OF SAID CITY, AND ALL ACTS
THERETO. .

SECTIONl.That it shall be unlawful for any person, except
as hereinafter specified, to light, fire, discharge, explode or set off
any fireworks or blank cartridges or small fire arms or anything containing
any proportion ,of' any substance of an explosive nature', within the
corporate limits of said City of Arcadia.

corporation, association or organization to make a public display of
fireworks, and for, that purpose to use and disc~ar,ge fireworks at such
times and such places in the City of' Arcadias.1tuate south of Foothill

Fire Department of said City at least fif~een (15) days in advance of

~~~:'qo1, SECTION 3. The public generally may use and discharge such
firelvorks as are perl)1itted by. the laws 0'( th:i.s' State, on the 4th day of
July of each and every year in th~ City of Arcadia situate south of
Foothill Boulevard, provided that if said .4thday of July in any year
falls on Sunday said fireworks'may be used and discharged as in this
Section specified, on the 5th day of Jv.ly instep.d of said 4th day of July.
SECTION 4. It shall be unlawful for any' parent, guardian, or
other person having the legal care and custody of any child in s~id City
of 'Arcadia under the age of fourteen ('14) years, .to allow, permit or
suffer such child to light, fire, discharge, explode, or set off any fireworks
or blank cartri'jges or small arms or anything containing any proportion
of any substance of an explosive nature. Provided, however, this

provision shall not apply to said 4th day of July of any year (or the 5th
day of July of any year .as provided in ~ection. 3 of this Ordinance.)
,.\.t\\~U) ~o1 SECTION 5. It shall be unlawful for any person, firm or' corporation

to sell or'cause or permit to be sold fireworks of any kind within said

City of Arcadia except that the City Council may permit such fireworks to
be sold within said City of Arcadia upon the 2nd, 3rd and 4th days of July
of each and every year, provided however, that if said, 4th day of July
in any year falls upon Tuesday, then such fireworks may be permitted to
be sold on the 1st day of July in such year~ and provided further, that

a written application for permit to sell; cause or permit to be sold, said
fireworks is filed with the Chief of the Fire Department of said City
not less than thirty (30) days in advance of the date or d8tes upon which
said fireworks are desired to be sold. It ,shall be the duty of the Chief
of the Fire Department to whom'the application for permit is made, to make
an investi3ation and submit a report of his findings and his recommendations
for or against the issuance of the permit together with his reasons the!efor,
to said City Council. The City Council shall have power in its discretion
to grant or deny the permit.
SECTION 6. That any person, firm or corporation violating any
of the provisions of this Ordinance shall be deemed guilty of a misdemeanor
and upon conviction thereof shall ~e punishable by a fine not exceeding
$300.00 or by imprisoninent in the City Jail of said City qf Arcadia or in
the County Jail of the County of Los Angeies, State of California, at the
discretion of the Conmitting Magistrate, for'a period not exceeding three
months, or by both such fine and imprisonment.
,SECTION 7. The following Ordinances are hereby specifically,
repealed:
Ordinance No. 221 passed and approved February 20, 1929;
Ordinance No. 406 passed and approved May 2, 1939

SECTION 8. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) qays from the
passage thereof, shall cause the same to be published once in the
..
Arcadia Tribune and Nevrs,a newspaper of general circulation, published
and circulated in the City. ~f Arcaia, and thirty days from and after the
final passage thereof said Ordinance shall take effect and be in force.
I hereby certify that the foregoing Ordinance was adopted at
regularly adjourned
