AN ORDINANCE OR T~ CITY COUNCIL OF THE CITY OF'AR,CADIA
'ORDINANCE NO. 170 of SAID CITY OF ARCADIA, APPROVED MARCH
PURSVANT TO THE PROVISIONS OF SECTION 4 TFffiREOF.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLO';iS:
SECTION 1. A petition signed ,by Ranchq Santa,Anita, Inc., dated
April 23, 1940, 'having heretofore been 'filed in 'the office of the Planning
Commission of the City of Arcadia, pursuant to Section 4 of Ordinance No.
170, entitled IlAN Ordinance oJ the City of Arcadia, California, providing for
the establishment 'or erection in' 'said City of seven zones consisting of
various districts and prescribing the classes of buildings,' structures,
improvem~nts and occupancy in said sever,al zones, . and the uses thereof;
the percentage of area,that may be covered by improvements and the heights
to whichbuilding~ may be erected; defining the terms used therein, and
prescribing the penalty for the 'violat~on of the provisions thereof,ll
asking that the property described in said petition be excepted from
Zone IlAIl of Ordinance No. 170 of the City of Arcadia, for the purposes' set
out in said petition,' and recommendation having been made by the Planning
Commission to this Council that said petition b~ approved and that the

exception requested be granted by this Councilj and a full investigation

and consideration of the facts having, been made by this Council pertinent
to such petition, this Council determines that there' are exceptional or

extraordinary circumstances or conditions applicable to the property

involved that do not genorally app+y to'the. property or classes of! uses

in the same zone or district in which said p~operty is located; that in
order to prevent substantial property rights.of applicant from being
curtailed said property shoula. be excepted f:rom the provisions of Zone IlA"
of Ordinance 1/0. 170 of 'said bit~ of Arcadia, but only insofar as hereafter
set forth.
,This Council therefore, ,excepts from the prOVisions of Zone "All
of Ordinance No. 170 of said City of Arcadia, the property hereinafter

County; also, a portion of Colorado street vacated, as desc~ibed in
Ordinance no. 233 of said City of Arcadia and recorded in Book 9568,
page 282 of Official Records of said County, describ.ed as a whole as

,Beginning at a point in the Northerly line. of, said Lot 1, said
point being the Westerly termination of that curve in the Northerly
line of Colorado street (80 feet in width), as described 'in deed to
said City of Arcadia and recorded in Book 9396, page 145 of Official
Records of said County, as beins' concave to the Southwest and having a
center line radius of 716.78 feet and, a length of 751.29 feet; thence
Southeasterly along the curved Northeasterly line of said Colorado
street,' a distance of 678.04 feet to a point (a radial line to said
point bears North 5.10 47' 04\1 East); thence N. 5~028115" Ei '508.08 feet,
more 01' less, to a "point in the Hortherly line' of said. Lot 1, said
point being distant S 89033100" E along the North line of said Lot 1,
1012.23 feet from the point of beginning; thence N 89033'00" W along
said NortherlY,line of Lot 1, 1012.23 feet to the point of beginning.
The above described parcei of land has a calculated area (net)
of 2.542 acres.,
to be used and occupied for the purpose of:

(a) The growing and selling of Iris, Orchids and other
flowering plants and bulbs, and necessary space for the parking of
automobiles in COnnection with the, operation of the business desijnated.
(b) The erection and use of a rancho type stucco building for
an office'building to be used in connection with the operation of the
business designated.
This'exception is granted upon the followinz conditions:
(a) That no building per~it shall be granted for the construction
or erection of any building u~on said 'property uniess'the plans and
specifications be first submitted to the Building Ihspector of the City
of Arcadia, and that. saj.d plan,S. and specifications for said building shall
in all particulars comply with the buildingOrd~nance and sanitary
regulations of the City of Arcadia~

(b) That construction of a building to be occupied for the
purpose of conducting the business described herein shall begin within

a period of. six (6) months from' and aft,erthe effective date of this
Ordinance', and that said building shall be completed within a period of
six (6) months from and l1-fter' the foundation of any building has been laid.
(c) That said property shall not at any time be used for any
purpose or purposes not specified in this Ordinance.
, (d)' That in c?seany of the provisions of 'this Ordinance are
violated the property above described .in t:lis Ordinance sball revert to Zone
"A" of Ordinance No. '170, arid the rights and, privileges herein granted s~1all
terminate and cease, in the event that any such violation is not terminc.ted
within thiEty days, or such further time as the City Council may decide
that the o\mer of said property, in the exercise of due diligence, requires
to correct such violation, after the owner of ' said property has been
given written notice by the City Council of such violation.
, SECTION 2. The City Clerk' shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15'). days from
the passage thereof, shall cause the same to be published once, in the
Arcadia Tribune and News, a newspaper of general circulation, published
and c1rcula ted in the Ci'ty of Arcadia, and thirty (30) Jays from and after
the final passage thereof said Ordinance sballtake effect and be in force.
