AN ORDINANCE OF'THE CITY COUNCIL OF.THE CITY OF ARCADIA PROHIBITING TRESPASS UPON AND LOITERING ABOUT CERTAIN CLASSES OF PROPERTY IN SAID CITY. ' FOLLOWS: THE CITY COu~CIL OF THE CITY OF ARCADIA DOES ORDAIN AS SECTION I. Declaration of Purpose.. Public I?afety is hereby declared.to require that 'the uninterrupted operatio:(l of certain industries essential to national defense, such as the aircraft manufacturing industry, and' of companies 'or agencies supplying water:, gas, electric and other essential services, be protected by ,preventing the intrusion upon the propertl.e s thereof of idle, c'ur i-ous or malic'ious persons and of persons . . , . whose presence ther~on is not necessary,' and by prohlbi ting the loitering , , ' . about such places by persons capable of inflicting harm or of impeding the operation conducted'thereon~ SECTION 2.. SECTION' 3. Posting, - Where Permitted. The places' which may , be so posted are the following: (a) Every reservoir, cj.am,. pumping station, ,aqueduct, main canal or pipe line, of a public wat;ersystem; -1- \l\\la.f9, '. ad, )/9"z y (b) Every reservoir, dam, generating plant, receiving station, distributing station and, transmission line of' a company or a:;ency' fur- nishing electrical energy; (c) Every gas generating .plant, compressor plant, gas bolder, gas tank, gas valve, gas regulator, and gas main used for the production, stora3e and distribution of gas; (d) Every plant or vital part thereof or other principal property essential to rendering telephone or t~legraph service; '( e) Eveq' railroad bridge or tunnel. SECTION 4. Trespassing - a Misdemeanor. 'When any sucb premises is posted as provided in this Ordinance, it shall be unlawful,for any person to go upon or to remain upon anyplace witbin .tbe, posted' botindary of any such premises, or to enter or to :remain in any such posted structure, witbout baving upon his person the expness written consent of, tbe person, ':' .' firm, corpoJ;'ation,department ,or agency lawfully in possession or control thereof. SECTION 5. Loitering';" a Misdemeanor. It shall be unlawful for any person to loiter in the immediate vicinity of anypr.emises posted as provided, in this Ordinance 'while baving in hi~' possession' any explosive; tool, or device, of \'iha teverc harac'ter capable of doing j1arm ordam3{!;e to, any structur'e, machinery, equipment or other property of a similar or dissimilar character, installed or located upon such posted premises or area. SECTION 6. Exemptions. This Ordinance does not apply to any entry in the cou;rse of duty of any peace officer nor to any. pe;r:son , traversing an established 'andexis'ting public sidewalk, street or highway. SECTION 7. Damaging Signs. Every person who tears down, defaces or destroys, or causes to be torn down, defaced or destroyed, :;lny sie;n placed or posted, under the p~ovisions of this Ordinance without .the consent.of the peI1son, firm,' corporation, governmental agency, depart- ment or instrumentalitybaving pbssession or control of the premises on which such sign has, beenerect,ed, is,guilty ~f a:mi~de~eanor. , SECTION' 8. Penalty Clause. Every per son, as principal, agent or otherwise, violating any of the provisions of this Ordinance shall be .- " , , -2- ","' . \~ff'l__,. o~ Ljt/;Z deemed guilty of a misdemeanor and upon. conviction thereof shall be punishable by a fine of riot. to exceed Three Hundred (.$300.00) Dollars, or by imprisonment in the City Jail in. the City of:Arcadia, CaHfornia, or in the County Jail of Los Angeles COlmty, California, for a 'period of not to exceed th:JOee '(3) months, or by both such fine and imprisonment. SECTION 9. If anypro~ision of this Ordinance~ or the application thereof to any person, or circu-lJlstance,. is held invalid, the remainder of the Ordin~nce and the application of such p:JOovision,to other persons or circums tance's shall not be affe,c ted thereby. SECTION 10. The City Clerk shall certify to the adoption of this Or,dinance and' prior to the expiration of fif,te~n '(IS) days from the passage thereof, shall' cause the same to be published once in .'the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, .and thirty (30) days from and after the final effect and be in force. pass age the re of said 'Ordinance shall take I hereby certify that the foregoing Ordinance was adopted at a re.ll:ular meeting of the City Council of the City of Arcadia, held on the 3m day o'f September -' , 1940, by the affirmative vote of at 'least- three, Councilmen, to-wit: '.
