ORDINANCE NO. 353
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA
AMENDING ORDINANCE NO. 170 OF SAID CITY OF ARCADIA, APPROVED
1~RCH 3, 1936, PURSUANT TO THE PROVISIONS OF SECTION 4 THEREOF.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:
SECTION 1:
An application signed by Alfred A. Kirk having
heretofore been filed in the office of the Arcadia Planning Commis-
sion, pursuant to Section 4 of Ordinance 170 entitled "An Ordinance
of the City of Arcadia, California, providing for the establishment
or erection in said City of seven zones consisting of various dis~
tri~ts and prescribing the class of buildings,. structures, improve-
ments and occupancy in said seven zones and the use thereof: the
percentage of area that may be. covered by improvements and the height
to which buildings Inay be erected: defining the terms used therein and
prescribing the penalties for the violation of the provisions thereof",
asking that exception be made affecting the property in said applica-
tion and setting forth the specifiC reasons therefor and the circum-
. stances in connection .therewi th, and recommendation having been made
by the Planning COIDnlission to this Council, and a full investigation
having been made and consideration of the facts having been made by
this Council bearing upon such application; this Council determines
that the granting of the request made therein will not be materially
detrimental to the public welfare or injurious to the property or im-
provements within the zone and district within which said property ill
located, and will not be inconsistent with the general purpose of the

said Ordinance No. 170, and that unless such request is eranted, sub-
stantial property rights of the applicant will be curtailed, and that
this Council therefore excepts from the provisions of Zone D of
Ordinance No. 170 of the City of Arcadia, the property hereinafter
described, but only so far as such exception is necessary to permit
the following described property, to-wit:

The South half of Lot One (1), Tract 6985, as per map
bool' 106, pa~e 5:5 of j,;aps, Records of Los An3eles County,
to be used for the follow!.ne purposes and no others:
(A) Any use permitted in Zones A, H, C and D.
(B) Nttomobile tire repair and sales shop.
(C) For m01l1dine;, manufacturi.ng and retreadinc: automobile
tires from old tires and tire casin~s.
This exception is granted upon the followin~ conditions:
(a) That said property shall not at any time be used for any
purpose or purposes not specified in this Ordinance.
(b) That there shall not be any old tires, casines, automobiles,
ooltowobile parts, nor any materials of any kind or character deposited,
left upon, placed upon, nor permitted upon any part of the lot, other
than inside the building.
(c) That the bl1siness shall be conducted in such a manner as not
to const).tute a nuisance.
(d) That Alfred A. Firk shal], not sublease, shall not sublet,
shall not sub-rent, shall not sell the business, shall not enter into
any ~orkin~ agreement of any kind or character, whereby any person,
other th~n Alfred A. Kirk shall have the possession, mana3ement or
control of the premises or business.
(e) That the se.id Alfred A. Kirk shall be permitted to install
and use not more.than one mould for the purpose of moulding, heatine
and treatine; automobile tires.
(f) In case any of the provisions of this Ordinance are violated,
the privilec;es herein e;ranted shall terminate and cease without notice.
In case Alfred A. K1rk sells or transfers the business or vacates, re-
moves from the premises or in any manner discontinues control and
exclusive management of the premises, then the privile8es herein
[lranted shall ter..,tinate and cease and this Ordinance becomes null and
void.
(g) That this Ordinance shall be in effect and force for a

period of two (2) veal'S from 1'ay 1st, 1937 and any and all privi-
le.::E's e;ranted hereunder shall expire and terminate on May 1st,
1939, and said Alfred A. K:i.rk shall discontinue mouldine; and re-
treading automob:i.le tires on and after .May 1st, 1939, upon the
property above described.
SECTI01:'f 2:
The City Clerk shall certify to the anoption
of this Ordinance and shall cause the same to be published once in
the Arcadia Tribune, a d.aily newspaper publlshed and circulated in
said City of Arcadia, and thirty days from and thereafter the same
Rhall take effect and be in force.
