Qr' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA 1~KING A CONDITIONAL VARIANCE TO CERTAIN PROVISIONS OF ORDINANCE NO. 170 OF SAID CITY OF ARCADIA AS M.ffiNDED, APPROv~D MARCH 3rd, 1926, PURSUANT TO THE PROVISIONS OF SECTION 4 THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION l: An applicatIon signed by Rancho Santa Anita Inc., having heretofore been filed with the Planning Commission of the City of Arcadia pursuant to Section 4 of Ordinance No. l70 as amended, entitled "An Ordinance of the City of Arcadia, Cali- fornia, providing for the establishment or erection in said City of seven zones consiflting of various districts and prescribing the class of buildingfi, structures, improvements and occupancy in said several zones and the use thereof; the percentage of area that / may be covered by improvements and the height to which buildings may be erected; defining the terms used therein, and prescribing the penalty for the violation of the provisions thereof", adopted Uarch 3, 1926, asking that a conditional variance be made from the provisions of the above Ordinance affecting the property described in said application and setting forth the specific reasons therefor and the circumstances in connection therewith; this Council after having received a report from the Planning Commission of the City of Arcadia and aft'3r having first investigated the subject of the application, determines that there are exceptional or extraordinary circumstances or conditions applicable to the property involved and to the intended use thereof that do not apply generally to the property or classes of uses in the same zone and district; that the granting of the request made therein will not be materially detrimental to the public welfare or injurious to the property or improvements within the zone and district in vlhich said property is located and will not be inconsistent with the general purposes of Ordinance No. l70 as amended; This Council therefore grants a conditional variance REPEAlEO ORD. Hlh, J) ~ -1- O-A.?~ S? / from the provisions of said Ordinance No. l70 as amended, but only so far ~s such variance is necessary to permit the following de- scribed real property, to-wit: Beginning at the intersection of the North line of Huntington Drive with the Easterly line of Lot l, Tract No. 949 as per map recorded in map book l7, page 13 of Maps, Records of Los Angeles County, thence West along the Northerly line of Huntington Drive 100 feet West, thence North 250 feet, thence East 299.22 feet more or less to the Easterly line of said lot, thence South 380 33' \Vest, thereon 3l9.67 feet lIlore or less to the place of beginning. To be used as a blmgalow court or automobile court. This conditional variance is granted upon the following terms and conditions: 1 - That the property be used for the purpose of erecting, building and constructing and using a bungalow court and automobile court and for no other purpose. 2 - That the buildings erected on this property be of stucco construction and modern in every way. 3 - That the property will under no circumstances be used or permitted to be used as or for a trailer camp; that no particular trailer belonging to any tenant or occupant or the owner or any other person be permitted to remain upon said property for a period of time longer than three days; that no person shall be allowed to occupy or live in Ilny automobile trailer during any period of the three days in which said automobile trailer is permitted to be upon s aid property., 4 - That thel'e shall be no buildings or structures of any nature erected and no alterations, additions or improvements made unless there has belen first obtained a permit from the Building Inspector of the City of Arcadia. 5 - That upon any violation of any of the provisions of this Ordinance the uses herein permitted shall cease and terminate and the property above described shall revert to and become a part of Zone A of this Ordinance and any and all uses granted and permitted by this Ordinance shall cease and terminate. SECTION 2: The City Clerk shall certify to the adoption -2- IU,PEAlEO / :?> G' tJlll. t'~ '-t I dAd 89/ .. of this Ordinance and shall cause the same to be published once in the Arcadia Tribune, a dally newspaper published and circulated in said City of Arcadia and thirty (30) days from and after the passage hereof the same s~all take effect and be in force.
