HomeMy WebLinkAbout0384 ORDINANCE NO. ~H4 AN ORDINANCE OF THE CITY COUl:CIL OF THE CITY OF ARCADIA MAKING A CONDITIonAL VARIbNCE TO CERTAIN PROVISIONS OF ORDINANCE NO. 170 OF SAID CITY OF ARCADIA AS AMENDED APPROVED MaRCH 3, 1926, PURSUANT TO SECTION 4 THEREOF. . THE CITY com~CIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOW~: SECTION]: An application signed by otto Smith baving heretofore been filed with the Planning COlllll1ission of the City of Arcadia pursuant tc' Section 4 of Ordinance No. 170 as amended, en- titled "An Ordinance of the City of Arcadia, California, providing for tbe establishment or erection in said City of Seven zones con- sistinG of various districts and prescribing tbe class of buildings, structures, improvements and occupancy in said several zones and the use thereof; the percentage of area that may be covered by improve- ments and the heig:l:1t to whicb buildings may be erected; defining the terms used therein" and prescribing the penalty of the violation of the provisions theI'eof", adopted March 3, 1926, asking that a condi tion- al variance be madE' from the provisions of the above Ordinance affect- ing the property dEl scribed in said application and setting forth the specific reasons therefor and the circumstances in connection there- with; this Council after having received a report from the Planning Commission of the City of Arcadia and after having f~rst investigated the subject of the application, determines that there are exceptional or extraordinary c:l.rcumstances or condi tibns applicable to the property involved and to thE' intended use thereof that do not apply generally to the property or classes of uses in the same zone and district; that the granting of the request made therein will not be materially detri- mental to the publJ.c welfare or injurious to the property or improve- ments within the zone and distDict in which said property is located and will not be inClonsistent with the ,5eneral purposes of Ordinance No. 170 as amended;: This Council therefore grants a conditional variance from the provisions of said Ordinance No. 170 as amended, but only so far -1- Chc/ <Y.Y,i as such variance 18 necessary to permit the following described real property, to-wit: The Nor1;herly 60 feet of Lot 1, Tract 10994 as per map book 197, page 47 of Maps, Records of Los Angeles County; to be used for thE! purpose of conducting a general real estate business. This conditional variance is granted upon the following terms and conditions: 1- That; the property be used for the purpose of conduct- i~a general real estate business and for such other purposes as is permitted by the 20ne or district in which the property is now sit- uated, and for no other'purpose or purposes. 2- That there shall be no buildings or structures of any nature erected and no alterations, additions or improvements made unless there has oeen first obtained a permit from the Building In- spector of the City of Arcadia. 3- That upon any violation of any of the provisions of this Ordinance the uses herein permitted shall cease and terminate and the property a~ove described shall revert to and become a part of the zone in which 'the property is now situated and any anu all uses granted and permit~ed by this Ordinance shall cease and terminate. 4- That this Ordinance shall be valid for a period of one (1) year from and after the effective date hereof and void thereafter. SECTION ~l: The City Clerk shall certify to the adoption of this Ordinance (md shall cause the same to be published once in the Arcadia Tribune, a dll.:ll.y newspaper published and circulated in said City of Arcad1.a and thirty (30) days from and after the passage hereof the same she,ll take effect and be in force.
