THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN il.S rOLL0\7S: SECTION 1. A petition si~ed by Rancho Santa Anita, Incor- porated, having been filed in the office of the City Plannin~ Commission, pursuant to Section 4 of Ordinance No. 170, entitled "An Ordinance of the City of Arcadia, California, Providing for the Establishment or Erection in Said City of Seven Zones Consistin3 of Various Districts and PrescribinG the Classes of Buildings, Structures, Im- provements and Occupancy in said Several Zones, and the Uses Thereof; The Percenta~e of Area that way be Covered by Improvements and the Height to Hhich :9ui "din~s :Jay be Erected; DefininQ; the Terms Used Therein, and Prescribing the Penalty for the Violation of the Pro- visions Thereof", askinc; that exception be made affecting the property described in said ~etitlon and settin~ forth the specific reusons therefor and the circumstances in connection thereITith, and recommendation havin3 been made by the Planning Commission to this Council, and a full investieation and consideration of the facts having been made by this Council pertinent to such petition; this Council dete"t'minEls that the exception requested \7111 not be materially detrimental to p\wlic welfare, or injurious to the property and improvements within the zone in which the saidrroperty is located, and will not be inconsistent with the general purposes of the said Ordinance No. 17C of the City of Arcadia, and that such exoeption is necessary for preservation and enjoyment of substantial property rights of petitioner, and that t.is Council therefore excepts from the provisions of Zone "A" of Ordinance 170 of the City of JU.cadia, the property hereinafter <'\ei'cri')ed, but only so far as such exception is neceRsary to permit t~e following described property, to-VIi t : That portion of Lot 6 of Tract No. 949, in the City of Arcadia, County of Los 1.n~<31es, State of CalJ.:ornia, as shorm on !.lap recorded -1- O/l.d g~j7 \ in Book 17, puge 13 of lilaps, in the office of the County Recorder of said Count~r, described as follows: Be[linning at a !Joint in the East line of' said Lot 6, as es- tablisbed and shown on County Surveyor I s r:ap B-lll, Sheet 4, on file in the office of the County Surveyor of said Co~nty; distant along said line N 2 desrees 58 minutes 25 seconds E, 1232.25 feet from the North line of lIuntin~:t::m Drive, as described in deed to the City of Arcadia and recorded in Book 9396, PaGe 145 of Official Records of said County; thence N 87 degrees 01 minute 35 seconds IT, 260 feet; thence N 2 degrees 58 minutes 25 seconds E, 200 feet ~ore or less to the Southwest cornar of that parcel of land conveyed to Leslie R. Proud, and desc~ibed in deed recorded in Book 16245, PaGe 148 of Official Recor1s of said County; thence S 87 degrees 01 minute 35 seconds E along the Southerly line of said ~arcel of land, 260 feet to the Southeast corner the~eof; thence S 2 degrees 58 minutes 25 seconds \'l alon,j the Easterly line of said Lot 6, 200 feet, more or less to the po:lnt of beginninG; to be used for the purpose of conducting and maintainin~ a Ridin~ "dademy, includin[l the boardin~ and traininG of horses, renting of horses for l'idin3 ourposes, :;ivinc; ridin:: instructions, and of conductinG and maintaininG a buildin,'l or buildin':s suita1)le for use of said property as herein sneclfied. This exoeption is granted upon the following conditions: A. That no buildins pormit be ~anted for the construction or erection of any buildin~ upon said property, unless the plans and specifications be first submitted to the Building Inspector of the City of Arcadia, and that said plans and sreclfications and said building or buildings shall, in all articulars, comply with the buildin,'~ ordinances and sanitary regulations of the City of A....cadia. B. Thut said building or buildinGS shall be completed with- in a period of nix (6) months from and after the founuation of any building or buiJ.din'ls has been laid. C. That said ~roperty shall not at any time be used for any purpose or purposes not specified in this Ordinance. -2- 0/1.</ BY)? D. That should any of the provisions of this Ordinance be violated the property above described in this Ordinance shall revert to Zone bAil of Ordinance No. 170, and the rights and privileaes herein granted shall terminate and cease, in the event that any such violation is not terminated within thirty days, or such fur- ther time as 1;he City CouncU may decide that the owner Of said property, in the exercise of due dili~ence, requires to correct such violation, after the olVIler of said proporty has been c:iven written notice by the City Council of such violation. ~'ION 2. The City Clerk shall certify to the adoption of this Ordin~mce and cause the same to be publiShed once in the Arcadia Tribur..e, a nevlspaper of generr.l circulation, published and circulated in said City of Arcadia, and thirty (30} days from and after the final passage hereof the same shall take effect and be in force.
