That Section 57-L-2 of Ordinance No. 33, be and the same ill hereby amended to read as follows: SZCTION 57-L-2: "Taxes" as used in this Section, includes all taxes and e,ssessl!lents and annual installments of assesaments \\tl'E.MtD OliO, \10. t..13( charged on the tax roll. That Ordinance No. 33 be and the same is hereby amended by adding thereto a new Section to be numbered Section 57-I.!-3, and to read as follows: SECTION 57-111-3: "Taxes," as used in this Section, includes all taxes and assessments and an~ual installments of assessments charsed on the tax roll. -1- OA c"/ :YP? \I~?~ 0\\1). .. 45~ In all cases where real estate has been sold to the City on or before July 6, 1938, for delinquent taxes, and the City has not disposed of the same, the person whose estate has been sold, his l1eirs, executors, administrators, or other successors in interest, may, on or before Jipril 20, 1940, elect to pay such delinquent taxes in installments. .. DurtnB the time such installments are paid as prescribed in this Sectic>n, together with current City taxes, the period of redemption of such real estate is extended and there shall be no sale of the property at auction as provided in Section 40 of said Ordinance No. 33 and no deed to the City as pro~ided in Section 43 of said Ordinance No. 33, and in the event such property has been deeded to the City, the resale of such real estate by the City as provided in Section 66 of said Ordinance No. 33, shall be postponed. Such payments in installments shall be made as follows: (a) The first payment shall consist of ten per cent, or more, of the ~nount of unpaid taxes, as defined in Section 57-0-2 of Ordinance No. 33, .plus interest on the whole amount of unpaid taxes at seven per cent per annum beginning July 1, 1936, to date of such payment. Before such first payment is made there must be paid the amount; of taxes, penalties and costs clue and payable for the fiscal year in which such payment is made. (b) Further payments shall be made not later than April 20 in each succeedini fiscal year and each payment shall consist of ten per cent, or more, of the whole amount of unpaid taxes, plus interest at seven per cent per annum from the date of the preceding payment on the balance 01' the o.CilOunt of unpaid taxes remaining unpaid after the previous payment. Upon conplying with subdivision (a) of this Section, possession of the property by the City shall cease and deternine until such time as there may be a default un::ier the terms of this Section. If each installment is paid as prescribed and if redeoption of the property is made on or before the tnentieth day of April, 1949, the amounts previously paid ond credlt3d are a credit on the amount to be paid for such redemption. Property deeded to the City for taxes, except property sold to the City for taxes during or before 1930 shall not be sold under the provisions of Section 66 of Ordinance No. 33 of the City of Arcadia until AW:ust 20, 1939. -3- ate';: ';;->P7 In 1939 the notice on the delinquent list OIFosite L1,b( property solc5, five years previously shall be in substance and may be in fOrm as follows: liTe oe deeded to the City of Arcadia, See No. in addenda to this list.1I In 1939 in addenda to the delinquent list instead of the otherwise required notice of sale at public auction of property sold to the City five years rreviously, the notice shall specify: (a) That it is a notice of disposal of property for delinquent taxes. (b) Description of the property. (c) The assessee of the property. (d) The amount for which the property was sold to the City of Arcadia. (e) That five years or more have elapsed since the property was sold to the City of Arcadia. (f) That unless the property is redeemed or unless the deed is postponed by a payment which oy law postpones the deed, the property will be deeded to the City of Arcadia. SECTION 4. This Ordinance is hereby declared to be an .,).0$ \;\.... urgency measure necessary r'or the immediate preserve.tion of the public peace, health and safety, and the facts that constitute such necessity are os folJows: Due to the widespread depression, many taxpayers have been unable to pay their taxes, or to redeem their nroperty from sale to the City of Arcadia for delinquency. By permitting redeMption with reduced penalties, and payment of delinquent taxes in instalDnents, many taxpayers will be enabled to redeem their property, restore the same to the t~ rolls and thereby add needed revenue for the operation and Inaintenance of government. SECTJON 5. The City Clerk shall certify to the adoption of this Ordinance and cause the same to )e published once in the j,rcadia TribunE', a newspaper of ~eneral circulat ion, publtshed and circulated in said City of Arcadia, and thereupon and there- after the same shall take effect and be in force. -4- a(-c/ S7}? .rtllLEll 1".~"'. 46., .
