HomeMy WebLinkAbout0964 ORDINANCE NO. 964 AN ORDINANCE OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING, ,CALLING, PRO- VIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF ARCADIA ON THE 6TH DAY OF NOVEMBER, 1956, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID, CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT, AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE GEN.ERAL ELECTION, TO BE HELD ON SAID DATE. WHEREAS, the City Council of the City of Arcadia, California, did on the 21st day of August, 1956, by a vote of more than two-thirds of the members of said City Council, adopt Resolution No. 2801 , entitled "Resolution of the City Council of the City of Arcadia, California, determining that the pUblic interest and necessity demand the acquisi- tion and construction of a certain municipal improvement, and making findings relating thereto," which said resolution was duly signed and approved by the Mayor of said City and attested and certified by the City Clerk of said CitYj NOW, THEREFORE, the City Council of the 'City of Arcadia DOES ORDAIN as follows : , , Section 1. That a special election be held, and the same is hereby called to be held, in the City of Arcadia, California, on the 6th day of November, 1956, for the purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city l/iU5-Wl therefor, in the 'amount hereinafter set forth', and for the object and purpose set forth in said resolution and herein- after stated. Section 2. That the object and purpose for which said indebtedness is to be' incurred and bonds issued therefor is as follows: The acquisition and construction by the City of Arcadia of a certain municipal improvement, to, wit: (a) the opening and improvement of a public street from the present northerly terminus of Baldwin Avenue at Colorado Street northerly to Foothill Boulevard, (b) an underpass to carry said Baldwin Avenue as extended by said public street under Colorado Street, (c) an underpass to,carry said public street under the Santa Fe Railroad right of way, and (d) ramps for the interchange of . traffic between Colorado Street and said BaldWin Avenue, including the acquisition of all land, rights of way and other property necessary for any of the foregoing. Section 3. That the estimated cost of the municipal improvement described in Section 2 hereof is the sum of $675,000 and that the amount of the principal of the indebtedness to be incurred therefor is the sum of ~675,000. That the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law, to wit: six per cent (6%) per annum, payable annually 2. the first year and semiannually thereafter, the actual rate or rates of interest on said bonds to be determined at the time of the sale or sales thereof. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit, two-thirds of the votes of the qualified elec- tors voting on said proposition, bonds of said city, in not exceeding the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth in said proposition. Section 4. That the polls for said election shall be opened at seven o'clock, A.M., of the day of said election and shall remain open continuously from said time until seven o'clock, P.M., of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (+) ON BALLOT ONLY WITH RUBBER STAMP j NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voti~ s~uare after the word "YES" or after the word NO'. All marks, except,the.cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the. ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election ~nd obtain another. On absent voter's ballots mark across (+) with pen or pencil. 3. Section 5. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided , . shall,be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word "NO" , , in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 6. That the special municipal election hereby called to be held in the City of Arcadia on the 6th day of November, 1956, shall be and is hereby ordered consoli- dated with the statewide general election to be held on 4. said date, and within the City of Arcadia the precincts, polling places, voting booths and officers of election for the special municipal election hereby called shall be the same as those prOVided for said statewide general election. The Board of Supervisors of the County of Los Angeles hereby is requested to order the consolidation of the special municipal election hereby called with said statewide general election, and said Board of Supervisors is authorized hereby to canvass the returns of the speCial municipal election hereby called, and said elections shall be held in all respects as if there were only one election, and only one form of ballot shall' be used. Said Board of Supervisors shall certify the result of the canvass of the returns of such special municipal election to the City Council of the City of Arcadia who shall thereupon declare the result thereof. Section 7. That the City Clerk shall certify to the passage and adoption of this' ordinance by a vote of more than two-thirds of all of the members of the City Council of said City, and shall cause said ordinance to be published once a week for two weeks in the ARCADIA TRIBUNE AND ARCADIA NEWS, a weekly newspaper of general cir'culation in said city. No other notice of such election need be given. Section 8. This ordinance shall take effect upon adoption.
