HomeMy WebLinkAbout0995 ORDINANCE NO. 995 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REGULATING FLYING ACTIVITIES. . THE CITY COUNCIL OF THE CITY OF ARCADIA DOES DETERMINE AND ORDAIN AS FOLLOWS: SECTION' 1., That the landing and taking off of aircraft, within the City of Arcadia) upon and from private and public property not ordinarily used or designated as a landing field, airport) air- field or landing strip does create an extremely dangerous and hazard- ous situation involving possible multiple loss of life and extensive property damage. That in particular) Santa Anita Race Track) by rea- son of its size and accessibility) encourages careless pilots, as well as pilots of emergency landing aircraft, to use the track facili- ties as a landing strip. That pilot qualifications, the airworthi- ness of aircraft, and safe flying practices are not subjects'of general knowledge and by virtue of the techincal aspects involved are under the control of federal) state and county aeronautic commis- sions. That in addition to the controls afforded by federal, state and county laws and ordinances, supplemental city ordinances are re- quired to insure, safeguard and protect the welfare) life and prop- erty of the residents of the City of Arcadia from said emergency and indiscriminate flying of aircraft. 995 SECTION 2. Aircraft shall mean any contrivance used or designed for navigation of) or flight in the air, but shall not in- clude any machine capable of vertical ascent or descent such as a helicopter. SECTION 3. Upon receipt of notice that an aircraft has for any reason landed upon public or private property within the City of Arcadia, the Chief of Police shall do the following: a. Cause to be erected around such landed aircraft a -1- barricade consisting of boards, ropes, chains or by appropriate signs or other means sufficient to indicate that said aircraft is grounded by order of the Chief of Police. b. Notify representatives of the Civil Aeronautics Au- thority and County Sheriff's Aero-Squadron of the landing and the circumstances involved in said landing. c. Request authorities.listed in Section 3-b above to conduct an investigation relative to violations of any federal, state or local law or ordinance as to condition of the aircraft and qualifications of the pilot; and determine proper steps to be taken to insure safe removal of the aircraft. SECTION 4. It shall be unlawful for any person or per- sons, other than personnel of the Police Department, Fire Department, Civil Aueronautics Authority representatives or other law enforce- ment officers or persons authorized by any of the named personnel, to enter the aircraft by forcibly or otherwise passing through the barricaded area surrounding the grounded aircraft. SECTION 5. It shall be unlawful for any person or persons to fly, taxi or attempt to do either by entering said aircraft with- out prior approval of the Chief of Police and the Civil Aeronautics Authorities. SECTION 6. Any person violating or permitting or responsi- ble for the violating of an~ of the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than Five Hundred Dollars ($500.00) or by imprisonment in the City Jail of the City of Arcadia, or in the County Jail of the County of Los Angeles, California, as the com- mitting magistrate may direct, for a period of not more than six (6) months, or by both such fine and imprisonment. Every such person continuing, committing or permitting the violation of any provisions of this Ordinance shall be deemed guilty of a separate offence for -2- 995 each and every day or portion of any day during which any violation of any provision of this Ordinance is committed or permitted. SECTION 7. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage hereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general cir- culation published and circulated in the City of Arcadia.
