ORDINANCE NO. 996
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
A~ffiNDING SECTIONS 194 AND 195 OF
ORDINANCE NO. 775.

THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Ordinance No. 775 entitled "AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROVIDING FOR THE ESTAB-
LISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THEREFOR,
DEFINING THEIR POvffiRS AND DUTIES, PRESCRIBING REGULATIONS FOR FIRE
PROTECTION AND FIRE PREVENTION AND LIFE SAFETY IN CONNECTION WITH
HAZARDOUS MATERIALS AND PROCESSES IN SAID CITY: PROVIDING PENALTIES
FOR THE VIOLATION THEREOF: AND REPEALING CERTAIN PARTS OF ORDINANCE
NO. 323 OF THE CITY OF ARCADIA, ADOPTED SEPTEMBER 17, 1935, AND ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH", adopted
July 19, 1949, be and the same is hereby amended by amending Sections
194 and 195 thereof, the same to read respectively as follows:
"SECTION 194. After September 30, 1957, no person shall
ignite, set fire to, burn, or cause or permit to be ignited or burned,
any combustible rubbish, garbage or miscellaneous debris within the
City of Arcadia, California."
"SECTION 195. Notwithstanding any other provision of Ordi-
nance No. 775, as amended, burning is not prohibited in multiple
chamber incinerators, prOVided:
a. That a building permit be obtained from the Building
Department prior to construction of such multiple chamber incinerator;
b. That approval of the Chief of the Arcadia Fire Depart-
ment be obtained approving the location of such multiple chamber in-
cineratorj and
c. The written approval of the Air Pollution Control Offi-
cer of LoS Angeles County is obtained, authorizing the construction

and use of such multiple chamber incinerator, as provided by the
Air Pollution Control Act and regulations of the Los Angeles County
Air Pollution Control District.
SECTION 2. This Ordinance is hereby declared to be neces-
sary as an emergency measure for preserving the public peace, health
and safety, and shall take effect immediately upon its adoption. A
statement of the reasons for its urgency are as follows: The dis-
posal of rubbish, trash, debris and other discarded combustible
materials is a matter of great public concern, in that improper con-
trol of such matters can lead to air pollution, fire hazards and
other problems affecting the health, welfare and safety of the resi-
dents of this and surrounding cities. That heretofore burning of com-
bustible materials in incinerators has not been prohibited by law.
That the Los Angeles County Air Pollution Control District has issued
pertinent regulations, effective October 1, 1957, under the authority
of the Air Pollution Control Law, banning all single chamber incin-
erator burning of combustible materials within their jurisdiction.
In order effectively to control air pollutants, it is necessary that
all surrounding cities adopt comparable regulations concurrently with

said effective date of October 1, 1957. Therefore, it is necessary
for this city to adopt the within Ordinance and that it become effec-
tive concurrently with the aforesaid regulations of the Los Angeles
County Air Pollution Control District.
SECTION 3. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passage thereof, shall cause the same to be published once in
the Arcadia Tribune and Arcadia News, a newspaper of general circu-
lation published and circulated in the City of Arcadia.
I HEREBY CERTIFY that the foregoing ordinance was adopted
at a regular meeting of the City Council of the City of Arcadia,
