ARCADIA PLANNING COMMISSION
Tuesday, January 10, 2012, 7:00 P.M.
Arcadia City Council Chambers
The Planning Commission of the City of Arcadia met in regular session on Tuesday, January 10,
2012, at 7:00 p.m., in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive
with Chairman Pro Tempore Parrille presiding.
PLEDGE OF ALLEGIANCE
Chairman Pro Tempore Parrille led the Pledge of Allegiance.
ROLL CALL
PRESENT: Commissioners Baderian, Beranek and Parrille
ABSENT: Commissioners Baerg and Chiao
MOTION
It was moved by Commissioner Baderian, seconded by Commissioner Beranek to excuse
Commissioners Baerg and Chiao from the meeting. Without objection the motion was
approved.

PUBLIC HEARING
1. TENTATIVE PARCEL MAP NO. TPM 11 -07 (Map No. 71791)
609 S. Second Avenue
Sun Homeland, Inc.
The applicant is requesting approval of a Tentative Parcel Map for a 3 -unit residential
condominium subdivision.
RECOMMENDATION: Conditional Approval
Mr. Li presented the staff report.
Chairman Pro Tempore Parrille asked what the City requirements for guest parking are for
this project. Mr. Li said that one -half space is required per unit, or in this case one and a
half or two spaces. He confirmed that the parking requirement will be met.
The Public Hearing was opened
Chairman Pro Tempore Parrille asked if anyone would like to speak in favor of this project.
Mr. Ed Eckert of Gilbert Engineering represented the applicant and offered to answer any
questions the Commissioners might have.
Chairman Pro Tempore Parrille asked if anyone would like to speak in opposition to this
project.
There were none.
MOTION
It was moved by Commissioner Beranek, seconded by Commissioner Baderian to close the
Public Hearing. Without objection the motion was approved.
MOTION
It was moved by Commissioner Beranek, seconded by Commissioner Baderian to approve
Tentative Parcel Map No. TPM 11 -07 (Map No. 71791) subject to the conditions in the staff
report.

There is a ten (10) calendar day appeal period after the approval /denial of the subdivision.
Appeals are to be filed by 4:30 p.m. on Friday, January 20, 2012.
2. TENTATIVE TRACT MAP NO. TTM 71793

The applicant is requesting approval of a Tentative Tract Map for an 11 -unit residential
condominium subdivision.
RECOMMENDATION: Conditional Approval
Mr. Li presented the staff report.
The Public Hearing was opened.
Chairman Pro Tempore Parrille asked if anyone would like to speak in favor of this project.
Mr. Hank Jong of EGL Associates, Inc. represented the applicant and offered to answer any
questions the Commissioners might have. He said that the applicant is prepared to comply
with all conditions.

Commissioner Beranek asked how many guest parking spaces will be provided and Mr.
Jong said that there will be six guest parking spaces and they are all located outside the
buildings.
Chairman Pro Tempore Parrille asked if anyone would like to speak in opposition to this
project.
Ms. Barbara Campanella said that her backyard backs up to the project site and that she is
concerned that her privacy will be compromised because the proposed building will be
closer to the property line than the existing building.
Mr. Rob Mathias said he is also an adjacent neighbor and that he shares Ms. Campanella's
concerns. He said he would like to know more about the location of windows on the
proposed building. He also expressed surprise that a two story, multi - family building would
be permitted adjacent to R -1 Tots.
Ms. Catherine Long said that she is a tenant in the existing building and that the other
tenants share her feelings. She said they are upset that they were given only sixty days to
vacate the building and she asked if this time frame was in compliance with California Civil
Code regarding condominium conversions. She pointed out that some of the tenants have
been living there for over ten years and they feel they deserve more consideration.
Commissioner Baderian asked Ms. Long if her only concern was the length of time given the
tenants to vacate. She explained that a longer term would be the least they would expect
given the length of time they've lived there.
Chairman Pro Tempore Parrille asked if the tenants are entitled to relocation assistance.
Mr. Kasama explained that since this is a new project as opposed to a condo conversion,
they are not entitled to any relocation assistance.
Mr. Mario Comego, also a tenant, said that the plans were developed long before the
tenants were notified. He asked if the tenants were entitled to any type of assistance since
they were being forcibly evicted.
Mr. Kasama explained once more that no assistance is applicable and that only the terms of
the lease agreements apply.
Commissioner Baderian asked Mr. Comejo if he had a month-to -month lease and what it
stated in terms of notice before having to move. Mr. Comejo said that his understanding is
that it is month-to -month with 30 days notice.
Chairman Pro Tempore Parrille asked the applicant if he would like to speak in rebuttal.
Mr. Jong explained that the project has been through the design review process and
approved. He added that the owner is entitled to build new buildings without a public
hearing and that the purpose of this hearing was only to review the subdivision. Mr. Jong
said that all the current tenants have month -to -month leases and that the property owner
has hired a management company to negotiate new lease agreements with each tenant if
they are interested.
Commissioner Baderian asked if the neighbors were notified when the project was in the
design review phase. Mr. Jong said that he understood that staff would notify the neighbors.
Mr. Kasama explained that there is no notification process for design review.

Commissioner Baderian asked if the new owners or the developers had contacted the
tenants or neighbors and Mr. Jong said he did not know.
MOTION
It was moved by Commissioner Baderian, seconded by Commissioner Beranek to close the
Public Hearing. Without objection the motion was approved.
Commissioner Baderian stated that, according to staff, this is a new project and not a
condominium conversion and therefore the tenants are entitled to only the notice as per their
lease agreements. Further, staff has no requirement to notify adjacent neighbors of the
design review application. Mr. Kasama confirmed this.

Tentative Tract Map No. TTM 71793 subject to the conditions in the staff report.

the minutes of December 13, 2011 as presented.

MATTERS FROM STAFF & UPCOMING AGENDA ITEMS
Mr. Kasama said that the next agenda will include a Tentative Tract Map for a ten -unit
condominium in the 800 block of Huntington Drive and a General Plan Consistency
Determination for a street project.
