LATING THE SUBDIVISION
AND DIVIDING OF LAND IN
SAID CITY, AND REPEALING
ORDINANCES 488, 516, 5R4, 606
AND 807 OF SAID CITY.
The City Council of the City of
Arcadt_8 does ordain as follows:
SECTION 1. AUTHORITY. The
provisions of this ordinance are sup-
plemental to the provisions of Ch'lo-
tel' 2. Part 2 of Division 4 of the
Business and Professions Code of the
state of California (referred to here-
in as the "Subdivision Map Act"),
and in addition to other applicable
provisions of law, and shall apply to

SECTION 2. SUBDIVISION DE-
FINED. As used in this ordinance,
subdivision shall mean any land or
portion thereof, shown on the last
preceding City tax roll as a unit or
as contiguous units, which is divided
for the purposes of sale, contract of
sale, hypothecation or encumbering
in any manner, immediate or future,
by any person,
SECTION 3. COMPLIANCE RE-
QUIRED. No person shall sell, pur-
chase, offer to sell, divide, contract
to sell, contract to purchase, en-
cumber or otherwise hypothecate
any subdivision or any part thereof
or a portIon of any lot as herein-
after defined, unless and until the
requirements of said. SUbdivision
Map Act when applicable, and the
provisions of this Ordinance when
applicable, shall have been complied
with. Person, as the term is used in
this ordinance, shall mean and in-
clude every person, firm, association,
organization, partnership, business
trust, Massachusetts Trust, company
and corporation, and every city,
county, state, federal, governmental,
political, public or quasi-public unit,
body, agency, district Or entity.
SECTION 4. ADVISORY AGEN-
CY. The City PlanrIlng Commis-
sion of the City of Arca.dia is hereby
designated as the "adVisory agency"
referred to in said Subdivision Map
Act, and is charged with the duty
of making investigations and reports
on the design and iIbprovement of
proposed subdivisions. It is hereby
authorized to consider and to rec-
ommend to the City Council the
"
approval, conditional approval or
disapproval of tentative maps of
subdivisions prepared and filed pur-
suant to this ordinance and to - re-
port such action to the City Council.
SECTION 5. REQUIREMENTS.
Each tentative map shall contain
the following information:
A. Tract number of the subdivi-
sion.
E. Suffl.cient legal description of
the land to describe the location of
the proposed subdivision.
C. Name and address of the
owner.
D. Name and address of the reg-
istered civil engineer or licensed sur~
veyor who prepared the map.
E. Approximate a c l' e age and
boundary lines of the subdivision.
F. North point, scale and date.
G. Location, width and proposed
names of all streets within the
boundaries of the subdivision, and
approximate radii of curves.
H. The approximate grade of
any street or part of street within
such subdivision.
I. Location and width of alleys
and easements.
J. Lot lines and approximate di-
mensions thereof.
K. Classification of lots as to I

SECTION 28. DIVIDING OF
LOTS. No person shall sell, offer to
sell, contract to sell, divide, pur-

SECTION 29. SAME. PROCE-'
DURE. Any perl:On desiring a sin-
gle lot, as hereinbefore defined, to
be divided into less than five par-
cels, shall first file with the City
Planning Commission not less than
four copies of a scale drawing show-
ing the size and location of such
lot. the relative location of existing
impro'vements thereon, and the pro-
posed division thereof. The City
Planning Commission ~hall cause
each such application to be inv.esti-
gated, and shall receive all pertinent
evidence relative thereto presented
at a regular meeting of said Com-
mission, and shall thereupon report
its findings and recommendations
thereon, in writing, to the. City
Council. The City Council may, by
the vote of a majority of its mem-
bers entered in the Council min-
utes. approve, disapprove or modify
such proposed division of single

807 of the City of Arcadia and all

in conflict herewith are hel'eby re~
pealed; provided that any such re-
peal shall not affect nor prevent the
prosecution and punishment of any
person, finn or corporation for any
act done 01' committed prior to the
effective date hereof, in violation of,
any ordinance which is hereby r.;-
pealed.
SECTION 32. CERTIFICATION.
The City Clerk shall certify to the
adoption of this Ordinance and prior
to the expiration of fifteen (5) days
from the passage thereof, shall
cause the same to be published once
in the Arcadia Bulletin, a news-
paper of general circulation, pub-
lished and circulated in the City of
Arcadia, and thirty (30) days from
and after the final passage thereof
said Ordinance shall take effect and
be in force.

If said owners, subdividers or sellers
shall neglect or fail for any reason
to perform such work in said sub-
division within the time designated
by said City Council as hereinabove
specified. said bond shall be de-
clared forfeited and the amount of
such bond shall thereby be forfeited
to the City of Arcadia, and the
amount received or collected there-
on shall be used by said City for
the improvement of said subdivision
as herein required, and the surplus,
if any, shall be returned to the
person or persons from whom such
money was received; provided. how-
ever, that if said map or plat shall
be accepted and approved by said
City Council prior to the actual per-
formance of such work, such sub-
dividers, owners or sellers shall in-
clude in each and every deed' to
the purchaser or purcnaserf> of any
lot or parcel of land within said
subdivision a stipulation or clause
to the effect that all of the work
required to be done hereunder shall
be performed in accordance with
the provisions of this Ordinance and
any ordinances amendatory hereof.
SECTION 22. UTILITY CON-
STRUCTION. All underground con-
struction shall be installed before
the streets are paved. if said con-
struction is in streets and would
require open excavation or the street
surface. All work in connection with
the installation or the water system
shall be done under the direction
of and to the satisfaction of the
Water. Superintendent. All other
construction shall be done under
the direction of and to the satis-
faction of the City Engineer. The
cost of employing necessary inspec-
tors or otherwise providing for the
proper inspection of any of the fore.

SECTION 22. FILING OF PLANS.
The City shall be furnished with

division located within a zone which

City, shall conform in minimum
area. width and frontage to the
provisions of said zoning ordinance
or with the following provisions,
whichever is the more restrictive:
A. R-O Zone. Minimum lot area
of 10,000 square feet and a width
of not less than 80 feet at the front
building: line.
a. R-l Zone. Minimum lot area
of 7,500 tquare feet and a width
of not less than 75 feet at the
front building line.
C. R-2 Zone. Minimum lot arC'\
of 7,500 square feet and a width
of not less than 75 feet at the front
building line.
D. R-3 Zone, Minimum lot area
of 7,500 square feet and a width
of not less than 60 feet at the front
building line.
SECTION 25. PARK AND REC-
REATIONAL FACILITIES FUND.
There Lc;. hereby created a special
fund to be known and designated
as the "Park and Recreational
Fund." The City Treasurer shall de-
posit to said fund all sums received
by him under this section. Said fund
shall be used for the acquisition,
improvement or maintenance of
public parks. playgrounds or equip-
ment thereof.
At the time of approval of the
final map of any subdivision, there
shall be paid to the City of Arcadia,
as a fee {or such approval. the sum
of $25.00 per lot for each lot in
said subdivision.
SECTION 26 V A RIA TIONS.
The City Council, upon recommen-
dation of the City Planning Com-
mission, or in the exercise of sound,
reasonable judgment, after proof of
necessity presented therefor and a
finding by a majority of the mem-
bers of the City Council entered in
the Council minutes that a variance
is necessary, may grant such varia-
tions from the requirements of this
ordinance if it thus determines to
be warranted and reqUired by reason
of the size, use, shape, topography
or other conditions of the property
within the subdivision or of property
adjacent thereto; provided, however,
that nO variations may be made of
any requirements imposed by the
SUbdivision Map Act, except as
therein provided.
SECTION 27. LOT DEFINED.
A lot, as the term is hereinafter
used. shall mean one of the follow-

data which it is impossible or im-
prnctical to place upon the tentative
map shall be submitted in writing
with the map.
SECTION 6. APPLICABILITY
OF PROVISIONS. The provisions
of this ordinance shall apply to nIl
subdivisions as defined in said Sub-
division Map Act unless contrary
thereto, and to all subdivisions as
defined herein.
SECTION 7. TENTATIVE MAP.
Seven copies of the tentative map
shall be flied with the City Planning
Commission at least ten days berore
the date at which it is to be consid-
ered by said body. Such filing should
be prior to the completion of final
surveys of streets and lots and be-
fore the start of any grading or
construction work within the pro-
posed subdivision.
After the tentative map has been
considered by the Planning commis-
sion, the planning commission shall
report its findings and recommenda-
tions in writing to the city Council.
Upon receiving such report, the City
Council shall consider and act upon
the same. The City Clerk shall in
writing report to the subdividel' the
Council's approval, conditional ap-
proval. or disapproval of the map
and the conditions on which such
action is based. On the official file
copy, of the tentative map, or at-
tached thereto, a statement shall
be made covering such action. Street
and sewer plans shall be approved
by the City Engineer, and water
11ans shall be approved by the Water
Superintendent before the start of
construction work.
SECTION 8. FINAL MAP. After
approval of a tentative map by the
city council, the subdivider may
cause a final map to be prepared in
accordance with a completed survey
of the subdivision and in substantial
compliance with the Subdivision
Map Act and this Ordinance.
SECTION 9. REQUIREMENTS
OF FINAL MAP. The following
shall be required on all final maps:
A. ~ If more than three (3) map
sheets are used, an index showing
the entire subdivision with lots num-
bered consecutively shall be in-
cluded.
B, Number of tract. date of prep-
aration, north point and scale.
C. Description of land included.
D. Location and names, without
abbreviations, of all: Proposed streets
and alleys. proposed pUblic areas
and easements, and adjoining streets
and subdivisions. Names of proposed
streets shall be approved by the
Planning Commission, only after
report and recommendation of the
City Engineer.
E. Dimensions in feet and deci-
mals of a foot.
F. Dimensions of an lots.
G, Each lot shall be numbered;
each block may be lettered.
H. Center line data including

SECTION 10. SIZE AND MA-
TERIALS. The final map shall be
clearly and legibly delineated upon
tracing cloth of good quality, with-
out folds. All lines, letters. figures,
certificates, acknowledgments and
signatures shall be made in black
waterproof India ink, except tha..t
affidavits, certificates and acknowl-
edgments may be legibly stamped
or printed upon the map with black
opaque ink. The size of each sheet
shall be 18 by 26 Inches. Ii marginal
line shall be drawn completely
around each sheet. leaving an en-
tirely blank margin of one inch.
The scale of the map shall be large
enough to show all details clearly.
Each sheet shall be numbered, the
relation of one sheet to another
clearly shown, and the number of
sheets used shall be set forth on
each sheet. The tract number, tract
name if used, scale, north point and
sheet number shall be shown on
each sheet of the final map.
SECTION 11. TITLE SHEETS.
Below the title shan be a sub-
title consisting of a general descrip-
tion of all the property being sub-
divided, by reference to deeds, sub-
divisions 01' to sectional surveys.
References to tracts and subdivi-
sions shall be spelled out and worded
identically with original records with
complete reference to proper book
and page of the record. The title
sheet shall also show the basis of
bearings. Maps filed for the purpose
of reverting subdivided land to acre-
age shall be conspicuously marked
under the title: "The Purpose of
This Map is a Reversion to Acre-
age."

SECTION 12. CERTIFICATE.
Forms for certificates required by
the "Subdivision Map Act" and this
Ordinance shall be in the form ap-
proved by and made available by
the City Engineer.
SECTION 13. SUR VEYING
DATA FOR LOTS. Sufllc1ent data
shall be shown to enable the ready
determination of the bearing and
length of each line. Dimensions of
lots shall be the net dimensions. No
ditto marks shall be used.
SECTION 14. SURVEY DATA.
The final map shall show the center
lines of all streets; the lengths,
tan1"ent. radii and central angl~s or
radial bearings of all curves; the
total width of each street. the.
width of the portion of each 'street
being dedicated; the width of streets
in existence or dedicated; the width
each side of the center line of all
streets; the width of rights-of-way
of railroads, flood control or drain-
age channels and any other ease-
ments dedicated or existing. Surveys
in connection with the preparation
of subdivision maps as in this Ordi-
nance provided shall be made in
accordance with standard practices
and principles for land surveying. A
traverse of the boundaries of the
subdivision and all lots and blocks
shall close within a limit of error
of one 0) foot in ten thousand
(10,000) feet of perimeter.
SECTION 15. RECORD OF
EASEMENTS. TIle flnal map shall
show the center line data, width
and side lines of all easements to
which the lots are SUbject. If the
easement is not definitely located
of record, a statement as to. the
easement shall appear on the title
sheet. Easements for stOlm drains.
sewers and other purposes shall be
denoted by broken lines. Distances
and bearings on the side lines of
the lots which are cut by an ease-
ment shall be so shown as to indi-
cate clearly the actual length of the
lot lines. TIle width of the ease-
ment. the lengths and bearings of
the lines thereof. and sufflcient ties
to locate the easement definitely
with respect to the subdivision, shall
be shown. TIle easement shall be
clearly labeled and identified, and
if already of record, proper refer-
ence given to such records. Ease-
ments being dedicated shall be so
indicated in the certificate of dedi-
cation.
SECTION 16. EXISTING MON-
UMENTS. The final map shall
show clearly what stakes, monu-
ments or other evidence were found
on the ground to determine the
boundaries of the tract. The corners
of adjoining subdivisions or portions
thereof shall be identified and ties
thereto shown.
SECTION 17. ESTABLISHED
LINES. Whenever the City Engi-
neer has established the center line
of a street or alley, such data shall
i;e considered in making the sur-
ve";s and in preparing the final map.
All monuments found shall be in-
dicated, and proper references there-
of made to field books or maps of
public record. If the points were
reset by ties, that fad shall be
~tated. All City boundaries crossIng
or adjoining the subdivision shall
be cle:\rly designated on the final
map and adequately tied in. The
subdivider's Engineer or Surveyor
shall furnish a set of approved field
notes to the City Engineer showing
the ties to all street center line in-
terEectional points, and to all street
centerl1ne beginning and end of
curve points shown on the final map.
These ties may be made after the
filing of the final map, but must
be made prior to tt.e final accept-
ance of the subdivision by the City.
All tie points shall be a brass tack
ret in lead in the curbs near the
point to which ties are to be made.
SECTION lB. LOT NUMBERS.
The lots -sh~ll be numbered con-
secutively, commencing with the
number one (1), with no omissions
or duplications. Each lot shall be
shown entirely 0:1 one sheet. Blocks
may be ur.ed ,and if used, they shall
be lettered consecutively.
SECTION 19. DEDICATION. All
streets, highways and parcels of
I"nd shown on the final map and
. intended for anv public use' shall
be offered for dedication for public
use.
SECTION 20. IMPROVEMENTS.
Tne subdivider shall make or agree
to make all improvements for all
land desienated for streets, hign-
ways. public ways and easements, as
:1. condition precedent to the ac-
ceptance thereof and to the ap-
proval of the final map. and all
improvements deemed by the City
Council to be necessary for the gen-
eral use of the lot owners in the
subdivision. or for the local neigh-
borhood traffic and drainage needs.
Preliminary plans and specifications
of all proposed improvements shall
be approved by the City Manager,

The following general rules with re-
spect to eg,ch item shall be followed:
A. STREET WIDTHS. M'ijor or
secondary thoroughfares or highways
shall have such minimum width in
excess of 60 feet as may be required
by the City Council. All other
streets shall have a. right-of-way of
60 feet minimum width: provided,
however, that local streets in a steep
hillside wbdivision may have a
lesser width, but not less than 36
feet, in which event the improved
roadway thereof shall not be less
than 24 feet between curbs.
B. GRADING. The street shall
be graded its full width to the ap-
proved grade.
C. DR A I N AG E. Sufficient
c'r'1inage facilities shall be provided
and located in public streets or
designated easements to care for the
local neighborhood drainage needs
in a manner which will assure the
property in the subdivision proper
protection from flood damage and
overflowing street water and from
all upstream areas as though fully
improved, and so designed as to pre-
vent, in the opinion of the City
. Engineer, unnecessary or unreason-
able inundation of adjacent prop-
erties. The City Engineer shall be
. furnished with a Flood Hazard re-
port from the County Flood Control
District regarding the drainage of
the subdivision.
D. ROADWAY WIDTHS AND
SURFACING. The roadway width
for a 60-foot right-of-way shall be
at least 36 feet. and shall be covered
with a permanent type of surfacing
and base designed in accordance
with the California Bearing Ratio
method or by some equivalent meth-
od. and of a thickness to provide
at least ten nO) years' wear. The
subdivider shall furnish soil tests
from an approved laboratory as re-
quired by the City Engineer to de-
termine the required thickness and
type of paving.
E. CURB AND GUTTERS.
Portland Cement concrete curbs and
gutters shall be required in all
cases. Concrete cross gutters shall
be required across all intersections
carrying drainage water.
F. SIDEWALKS. Portland ce-
ment sidewalks shall be constructed
wherever required by the City Coun-
cil.
G. SANITARY SEWERS. Sani-
tllry sewers shall be required in all
subdivisions, including laterals to
each lot from the sewer main to
the edge of the street right-of-way.
H. WATER MAINS AND FIRE
H Y D RAN T S. Adequate water
mains and services and fire hydrants
shall be installed in all caEes.
I. GAS. Gas Ii n e s. including
services to each lot from the main
to back of the curb line', shall be
installed in all cases.
J.. STREET TREES. Street trees
when required by the City Coun-
cil, shall be planted of a type, size,
[pacing, and at the time within a
year after approval of the final
map as specified by the City Engi-
neer.
K. STREET NAME SIGNS.
Street name signs shall be installed
in nccordance with City of Arcadia
standards.
L. STREET LIGHTS. Street
lights shall be installed in accord-
ance with standards established
from time to time bv the City of
Arc"l.dla for the area involved.
SECTION 21. PERFORMANCE
BOND. If the proprietors, owners
or sellers of said subdivision shall
request said City Council to approve
the map or plat thereof prior. to the
actual completion of any of the
work hereinabove specified, then
raid City Council may accept and
approve said map or plat if such
subdividers, owners or sellers shall
execute a good and sufficient surety
