THE CITY COUNCIL OP THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: ~ -ORDINANCE NO .869- . AN ORDINANCE OP THE CITY COUNCIL OF THE CITY OF. ARCADIA, CALIFORNIA, ESTABLISHING PROCEDURE FOR THE DISPOSITION OP FOUND PROPERTY. 0' SECTION 1. Every officer and employee of the City of Arcadia, who shall find any lost money or property in or upon any public groWld. street. highway, road. alley. sidewalk as defined by Section 5600 01' the Streets and Highways Code 01' the State of California, public build- ing or other property of the City 01' Arcadia. or when in the course of his duties as a City employee shall otherwise come into the possession 01' any personal property the owner 01' which is unknown, shall deliver the same to the officer or person in charge of the place where such money or property is found, or to the head of the Department in which .- such employee is employed, together with a written statement disclosing . the circumstances 01' the finding including the time and plac" thereof and the address ot the owner or the person entitled to the possession the~eof if known to the finder. SECTION 2. The person to whom such money or property is thus delivered shall cause the same to be delivered to the custOdy 01' the Chief of Police of the City of Arcadia. who shall care tor and protect all such property coming into his possession. The Chief 01' Police shall restore such property or money to its true owner or the person entitled to possession thereot, upon proof of ownership or right of possession satisfactory to him, and upon payment to him of all costs reasonably or necessarily incurred by him in the care and protection 01' such property. SECTION 3. Any such property, other than money. remaining Wl- ~ claimed by its true owner or person entitled to the possession there- of for a period of Six (6) months from and after the date 01' its finding. shall unless otherwise provided by law. be sold by the Chief of Police or some person Wlder his direction, at publiC auction to the highest bidder. Notice ot such sale shall be publiShed at least twice on a newspaper 01' general circulation pUblished in the City 01' &roadia. Immediately upon the completion of any such sale, the Chief of Police shall report to the City Controller the necessary expenses of such sale actualll incurred and a statement of the proceeds of such sale, and shall forthwith pay to the City Treasurer for deposit in the General Fund the proceeds remaining after pay- ment of the expenses actually incurred. SECTION 4. If there be no bids for any item offered for. sale at such auction, it shall be offered for sale with other un- claimed~found property'at the next auction sale. If any item be not sold at the second auction sale at which it is offered, 1t shall be turned over to the City Manager who shall make such dis- position thereof, 1n the public interest,as he shall deem fit. The City Manager shall advise the City Controller of the disposition made of all such property thus received by him, and shall forth- with pay to the City Treasurer all moneys received by him in the disposal of such property. SECTION 4. Any money received by the Chief of Police under Section 1 hereof shall be retained in his custody for a period of Six (6) months. All such moneY:which remains unclaimed by its true owner or the person entitled to possession thereof, for a period of Six (6) months from. the date of its finding, shall be deposited. by the Chief of Police with the City Treasurer for deposit in the General Fund. . SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Bulletin, a newspaper of general circulation, published and circulated in the City of Arcad1a, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force.
