ORDINANCE No.873 AN ORDINANCE OP THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING PORTIONS OF CORNELL DRIVE AND WINDSOR DRIVE, AND DIRECTING EXECUTION AND DELIVERY OF .CONVEYANCE OF SUCH VACATED PORTIONS. THE CITY COUNCIL OF THE CITY OF ARCADIA OOES DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. After a publiC hearing, regularly held and duly noticed pursuant to Resolution No.2374 of the City Council adopted May 19, 1953, the City Council does hereby find and determine that the public interest and convenience require a.vacation of those portions of Windsor Drive and Cornell Drive, public streets in the City of Arcadia, adjacent to Lot 15 and Lot 26 ~f ~act No.17329 per map recorded i~ Book 446, Pages 26 ahd 27 of Maps in the office of the County Recorder of Los Angeles County, as hereinafter des- cribed; upon the evidence received at said hearing that equity re- quires that the portions of said.streets to be vacated be deeded to the Arcadia Christian Church, the owner of the adjoining property, in consideration for the dedication by said Arcadia Christian Church of property in lieu of that to be vacated and for the realignment of said streets. SECTION 2. That that portion of Cornell Drive and that portion of Windsor Road, in the City of Arcadia, County of Los Angeles and State of California, (said Drive. and Road being shown on map of Tract No.17329, recorded in Book 446, Pages 26 and 37 of Maps, in the office of the County Recorder of said County) which lies south- erly of a line which is 50 feet southerly from, and parallel with, the south line of Lot 14 of said Tract No.17329; said parallel line is to be prolonged easterly to the east line of Windsor Road and Westerly to the southwest line of Cornell Drive, be and the same are hereby vacated. SECTION 3. Pursuant to the findings made in Section 2 of said Resolution No.2374, the City of Arcadia reserves and accepts unto itself the right and easement at any time, or from time to time, to construct, maintain, operate, repair, replace, remove or renew sanitary sewers, water and storm drains, electric poles, wires, cross arms, guy wires and conduits, gas mains and lines, water mains and lines, and any other utility, together with all structures _~f.~ ....Q........ , I necessary or pertinent to any thereof, in, on, upon, over and across said portions of Windsor and Cornell Drive hereinafter described and vacated. SECTION 4. Subject to the afore said reservation of ease- ment and ACCEPT~NCE, THAT PORTION OP Cornell Drive and that portion of Windsor Road, in the City of Arcadia, County of Los Angeles and State of California, (said Drive and Road being shown on map of Tract No.17329, recorded in Book 446, Pages 26 and 27 of Maps, in the office of the County Recorder of said Connty) which lies souther- ly of a line which is 50 feet southerly from, and.parallel with, the south l1ne of Lot 14 of said Tract No.17329; said parallel line is to be prolonged easterly to the east line of Windsor Road and wester- ly to the southwest line of Cornell Drive, be and the same are here- bY vacated and the Mayor and City Clerk are hereby authorized and directed to convey said portions or Cornell Drive and Windsor Road to the ~rcadia Christian Church, upon delivery to and acceptance by the City of Arcadia of a good and sufficient conveyance vesting in . ~ the 'City of Arca~ia the title to the new streets to be opened in lieu of the portions of the streets hereby vacated, and the improve- ment of said new streets in accordance with all applicable standards ~ . and regulations of the City of Arcadia. SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of Pifteen (15) days from the passage thereof shall cause the same to be published once in the Arcadia Bulletin, a newspaper of general circulation~ published and circulated in the City or Arcadia.
