No. 8''10 ORDINANCE NO. 889 ( .-,' ...-.#.....,;..... ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CAL U'ORN lA, APPROVING THE ANNEXA- TION TO SAID CITY OF CERTAIN TERRITORY DESIGNATED AS FOOTHILL BOULEVARD ANNEXATION NO. :!! THE CITY COUNCIL OF THE CITY OF ARCADIA, CALU'ORNIA, DOES DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That pursuant to the provisions. of the "Annexation of Uninhabited Territory Act of 1939,m as amended, the City Council of the City of Arcadia did on its own motion on the 18th day of March, 1952, adopt Resolution No. 2224, entitled "L RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GIVING NOTICE OF THE PROPOSED ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS WITH THE PRESENT CITY LIMITS OF THE CITY . OF ARCADIA, THE SAME BEING SITUATED NEAR THE NORTHWEST PORTION OF THE CITY OF ARCADIA", which resolution recited that the proceed- ings for the annexation of the territory hereinafter described were initiated on the said council's own motion, and stated the reasons for which the said council desires to annex c9rtain territory~ and which resolution further specifically described the boundaries of the territory sought to be included in the said city~ and fixed Tuesday, the 6th day of May, 1952" at the hour of 8:00 o'clock p.m. in the Council Chambers 01' the City Hall 01' the City of Arcadia, . 240 West Runtington Drive, Arcadia, Cali1'ornia, as the day, hour and place when and where any person owning real property within such territory so proposed to be annexed and having any objections to the proposed annexation might appear be1'ore said City Council and show ~ause why such territory should not be annexed. SECTION 2. ,That at a regular meeting 01' said City Coun- cil held May 6, 1952, at the hour of 8:00 o'clock p.m. in the t - 1 - "f. 0('(01 f'? Y IHIlDiD . Council Chambers of the City Hall in the City of Arcadia as afore- said, said City Council did find and determine that the publication of said Resolution No. 2224 had been made as required by Section 353ll of the Government Code of the State of California, in the Arcadia Bulletin, a newspaper of general circulation published in the City of Arcadia at least twice but not ,oftener than once a week, and in the Pasadena Star News, a newspaper of general circulation published outside the City of Arcadia but in the County of Los . Angeles at least twice but not oftener than once a week, each and all of which said publications were completed at least twenty days prior to the 6th day of May, 1952, the date set for the hearing on said annexation; that written notice of such proposed annexation had been mailed to each and every person entitled to notice under Section 353ll of said Government Code as required thereby; that no person has filed his nmne or address or the designation of lands in which he has any interest, either legal or equitable, with the City Clerk of the City of Arcadia; that no part of said territory is owned by a county; that the annexation of said territory is not prohibited by either Section 35002.5 or Section 35326 of said Govern- . . ment Code; that the property hereinafter described consists of a street or highway; that the cities of Sierra Madre, Monrovia and Pasadena are the only cities situated wi thin three miles of the boundaries of the territory hereinafter described; that the legis- lative bodies of the cities of Sierra Madre, Monrovia and Pasadena have, by resolution duly and regularly adopted respectively by each of them, consented to the annexation by the City of Arcadia of the property hereinafter described; that all of the real property here- inafter described was and is uninhabited and contiguous to the City of Arcadia and that no protests or objections were made to said annexation by aqyperson; that the proposal to the annexation of such uninhabited territory to the City of Arcadia had been sub- mitted to and reported favorably upon by the Boundary Commission of . - 2 - {7~! f' f'.f the County of Los Ange~s with respect to the definiteness and cer- tainty of the proposed boundaries, pursuant to Section 35002 of the Government Code of the State of California; SECTION 3. That under and pursuant to and in accordance with the provisions of an act of the legislature of the state of California entitled "Annexation of Uninhabited Territory Act of li939," as amended, the annexation to the City of Arcadia of that certain uninhabited territory contiguous to said city and known and designated as Foothill Boulevard Annexation No. 1 be and the same is hereby ratified, confirmed and approved and the same is hereby ordai ned to be annexed to and made a part of the City of Arcadia, California. SECTION 4. That a specific description of the boundaries of said territory is as follows: Those portions of Lots 66 and 67 of Tract No. t 808, as per map recorded in Book 16, pages 82 and 83, of Maps, Records of the County of Los Angeles, described as follows: Beginning at the intersection of t he boundary line of the City of Monrovia with the Westerly line of said Lot 66, as said lines are shown on said Map of Tract No. 808; thence along said Westerly line South 0022'53" East 58.60 feet; thence parallel with said Boundary line North 89036'45" East 440.78 feet to the intersection thereon with the Easterly line of said Lot 67, thence along said Easterly line North 0023'09'" West 58.60 feet to the intersection thereon with said Boundary line; thence along said Boundary line South 89036t~5n West 440.77 feet to the point of beginning. SECTION 5. That the boundaries of the City of Arcadia, . California,. be and the same are hereby altered to include the above described territory, the annexation of which is hereby approved and ordained herein and incorporated in the City of Arcadia, Cali- fornia. SECTION 6. The City C~rk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (l5) days from the passage thereof shall cause the same to be published once in the Arcadia Bulletin, a newspaper of general circulation pub- t l1shed and circulated in the City of Arcadia, and thirty (30) days - 3 - o~~ PEY /; . from and after the final passage thereof said Ordinance shall take effect and be in force.
