HomeMy WebLinkAbout0891 -- ORDINANCE NO. 891 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIroRNIA, APPROVING THE ANNEXA- TION TO SAID CITY OF CERTAIN TERRITORY DESIG- NATED AS FOOTHILL BOULEVARD ANNEXATION NO. 1 THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND ORDAIN AS FOLLOi'iS: . SECTION 1. That pursuant to the provisions of the "Annexa- tion of Uninhabited Territory Act of 1939," as amended, the City Council of the City of Arcadia did on i~own motion on the 20th day of May, 1952, adopt Resolution No. 2248 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GIVING NOTICE OF THE PROPOSED ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS WITH THE PRESENT CITY LIMITS OF THE CITY CF ARCADIA, THE SAME BEINS SITU- ATED NEAR THE NORTHWEST PORTION OF THE CITY OF ARCADIA, AND AMENDING RESOLUTION NO. 2224"', which resolution recited that the proceedings for the annexation of the territory hereinafter described were initi- ated on the said council'S own motion, and stated the reasons for . which the said council desires to annex certain territory, and which resolution further specifically described the boundaries of the terri- tory sought to be included in the said city, and fixed Tuesday, the 24th day of June, 1952, at the hour of 8:00 o'clock p.m. in the Council Ghambers of the City Hall of the City of Arcadia, 240 West Huntington Drive, Arcadia, California, as the day, hour and place when and where any person owning real property within such territory so proposed to be annexed and having any objections to the proposed annexation might appear before said City Council and show cause why such territory should not be annexed. SECTION 2. That at a regul~ meeting of said City - 1 - cYuJ. py/ 1~D;xm t . CounciL held J~ ~ 1952, at the hour of 8:00 o'clock p.m. in the Council Chambers of the City Hall in the City of Arcadia as afore- said, said City Council did find and determine that the publica- tiOD of said Resolution No. 2~8 had been made as required by Section 35311 of the Government Code of the State of California, in the Arcadia Bulletin, a newspaper of general circulation pub- lished in the City of Arcadia at least twice but not oftener than once a week, and in the Pasadena Star News, a newspaper of general circulation published outside the City of Arcadia but in the County of Los Angeles at least twice but not oftener than once a week, each and all of which said publications were completed at least twenty days prior to the 24th day of ~~ 1952, the date set for the hee.ring on said annexation;; that written notice of such proposed annexation,had been mailed to each and every person entitled to notice under Section 35311 of said Government Code as required thereby; that no person has filed his name or address or the desig- nation of lands in which he has any interest, either legal or equitable, with the City Clerk of the City of Arcadia; that no part of said territory is owned by a county; that the annexation of said territory is not prohibited by either Section 35002.5 or Section 35326 of said Government Code; that the property hereinafter described consists of a street or highway;. that the cities of Sierra Madre, Monrovia and Pasadena are the only cities situated within three miles of the boundaries of the territory hereinafter described; that the legislative bodies of the cities of Sierra Madre, Monrovia and Pasadena have, by resolution duly and regularly adopted respectively by each of them, consented to the annexation by the City of Arcadia of the property hereinafter described; that all of the real property hereinafter described was andis unin- habited and contiguous to the City of Arcadia and that no protests or objections were made to said annexation by any person; that the proposal to the annexation of such uninhabited territory to the . - 2 - (/J Py/ City of Arcadia had been submitted to and reported favorably upon by the Boundary Commission of the County of Los Angeles with respect to the definiteness and certainty of the proposed boundaries, pursuant to Section 35002 of the Government Code of the state of California; SECTION 3. That under and pursuant to and in accordance with the provisions of an act of the legislature of the state of California entitled "Annexation of Uninhabited Territory Act of 1939", as amended, the annexation to the City of Arcadia of that certain uninhabited territory contiguous to said city and known and designated as Foothill Boulevard Annexation No.1 be and the same is hereby ratified, confirmed and approved and the same is hereby ordained to be annexed to and made a part of the City of Arcadia, California. SECTION 4. That a specific description of the boundaries of said territory is as follows: . A portion of the County of Los Angeles, State of California, comprising the right of way of Foot- hill Boulevard between the east line of Baldwin Avenue and the west line of Second Avenue, being all the territory included within the following described exterior boundary line: Beginning at an angle point in the boundary line of the City of Arcadia, as now established;. said point being the intersection of the north line of Foothill Boulevard, 80 feet in width, with the east line of Baldwin Avenue, 60 feet in width; thence easterly along the boundary line of the City of Arcadia and following its various courses to an angle point in said boundary at the west line of Second Avenue; thence south along said boundary line 50 feet to an angle point; thence west along said boundary line to its intersection with the southerly prolongation of the east line of Baldwin Avenue, 60 feet in width; thence northerly along said prolongation to the point of beginning. . SECTION 5. That the boundaries of the City of Arcadia, California, be and the same are hereby altered to include the above described territory, the annexation of which is hereby approved and ordained hereiD and incorporated in the City of Arcadia, California. t - 3 - cd py/" . SECTION 6. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be pUblished once in the Arcadia Bulletin, a newspaper of general circulation pub- lished and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance Shall take effect and be in force. . The City Clerk shall thereupon, on the taking effect of this Ordinance, make and certify under the Seal of the City of Arcadia and transmit to the Secretary of state of the State of California, a copy of this Ordinance giving the date of its passage.
