AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER,THE IMPROVEMENT OF OPENING AND EXTENDING LOUISE AVENUE IN SAID CITY FROM ITS PRESENT POINT OF TERMINATION TO A, POINT 1004 FEET, MORE OR LESS, SOUTHERLY THEREFROM, AND THE OPENING AND EXTENDING OF LE ROY AVENUE IN SAID CITY FROM THE EASTERLY, LINE OF SANTA ANITA AVENUE TO A POINT 434.84 FEET, MORE OR LESS, EASTERLY THEREFROM, AND DECLARING THAT THE EXPENSE OF THE IMPRO~vlliNT SHALL BE, ASSESSED UPON A DISTRICT, AND ESTABLISHING THE GRADES OF SUCH PROPOSED OPENING AND ,EXTENDING OF SAID STREETS. WHEREAS, the owners of more than sixty per cent in area of the property subject to being assessed for the proposed improvement of opening and extendiDg Louise Avenue, and the opening and extend- iDg of Le Roy AveDue in the manner and to the extent set forth and described in this ordinance, all within said city, have signed and filed with the City Clerk of said city, said person being the clerk . of the Legislative Body of said city, a written petition for said proposed improvement, pursuant to Part 1 of Division 6 of the Streets and Highways Code of the State of California, which said part is known as the "Street Opening Act of 1903," and which said petition contains a waiver of the provisions of Division 4 of said Streets and Highways Code, which said division is known as "The Special Assessment, Investigation, Limitation, and Majority Protest A~ of 1931," all in accordance with the provisions of Section 2804 of said Code; ,~ . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES amAIN AS FOLLOWS: SECTION 1. That the public interest and convenience require and it is the intention of the City Council of the City of Arcadia to order that the following improvement be made, to wit: The opening and extending of Louise Avenue in said city from a point 194.37 feet, more or less, southerly of the southerly boundary of Christina Street, . {lA,/. Pf~ IN06XJ;O being the present point of termination of Louise Avenue, to a point 1004 feet, more or less, southerly therefrom, and the opening and extending of Le Roy Avenue from the easterly line of Santa Anita A~enue to a point 434.84 feet, more or less, easterly therefrom, all within the City of Arcadia. SECTION 2. That the City Council finds and determines that the land necessary and convenient to be taken for such improvement and the land which will be taken for such improvement is as shown on that certain map No. W-66 (Sheet,2) on file in the office of the City Engineer, which said drawing was approved and adopted by said City Council by Resolution No.'2504 adopted on the 18th day of May , 1954. That said lands to be so taken are more particularly described as follows: Beginning at the Southeast corner of Lot 32, Tract 13252, as per map recorded in Book 345, Pages 6, 7, and 8, of Maps, in the Office of the Recorder of Los Angeles County; thence Southerly 318.13 feet, along a line parallel with the Westerly line of Lot 6, Arcadia Acreage Tract, as per map recorded in Book 10, Page 18, of Maps, in the Office of the Recorder of Los Angeles County, to the beginning of a curve concave to the Northwest and' having a radius of 120 feet; thence Southwesterly along the last mentioned curve 53.18 feet to a pOiDt of reverse curvature; thence Southwesterly 79.77 feet along a curve concave to the Southeast and having a radius of 180 feet to a point of tangency with a line parallel with and 390.92 feet Easterly from the Westerly line of Lot 9 of said Arcadia Acreage Tract; thence Southerly along the last mentioned parallel line to its intersection with the South line of. said Lot 9; ~ence South 80 44' 06" West 88.50 feet to the beginning of a curve concav.e to the Northwest and hav.ing a radius of 15 feet; thence Southwesterly along last mentioned curve 21.17 feet to a poiDt of tangency to the Southerly line of the Northerly 100 feet of Lot 14 of said Arcadia Acreage Tract; thence Westerly along last mentioned Southerly line to the Westerly liDe of said Lot 14; thence Southerly ,along said Westerly line 48 feet; thence Easterly . parallel with the Northerly line of said Lot 14, 434.84 feet; thence Northerly 48 feet parallel with said Westerly line; thence North 80 44' 06" West 101.28 feet to a point in the Northerly line of said Lot 14; thence Northerly parallel with the Westerly line of said Lot 9, 408.86 feet to the beginning of a curve concave to the Southeast aDd having a radius of 120 feet; thence Northeasterly along said last mentioned curve 53.18 feet to a point of reverse curvature; thence Northeasterly 79.77 feet along a curve concave to the Northwest and having a radius of 180 feet to a point of tangency to a line parallel with and 479.90 feet Easterly from the Westerly line of Lot 6, of said Arcadia Acreage Tract; thence Northerly along said last. mentioned t OA-CI P9;2 parallel line to Tract No. 13252; more or less, to its intersection with the Southerly line of said thence Westerly along said Southerly line 60 feet the point of beginning. SECTION 3. That the said proposed improvement in the opinion of the City Council of the City of Arcadia is of more than local or ordinary public benefit and said Council hereby declares that the district in the City of Arcadia to be benefited by said improvement and to be assessed to pay the cost and expense thereof is shown upon that certain map No. W-66 (Sheet 1) on file in the office of the City Engineer of said city, which said map was approved and adopted by the City Gouncil by Resolution No. 2503 on the 18th day of May ,1954, and which said map delineates thereon, by a boundary line, the exterior boundaries of said assessment district. Said map hereby is referred to and shall govern for all details as'to the extent of said assessmeDt district. Said assessrne'nt district includes in general the lots and parcels of land abutting upon the alignment of said proposed opening and extending of Louise Avenue as the same is shown on said Map No. , W-66 (Sheet 2), which said lots and parcels of land all are within that area of said,city bounded on the north by the southerly line of Christina Street, on the south by an easterly extension of the southerly line of Le Roy Avenue,on the east by the westerly line of Santa Anita Avenue, and on the west by the easterly line of First Avenue. SECTION 4. That it is proposed to establish grades, sub- . grades and elevations for said proposed opening and extension of Louise A venue and Le Roy Avenue; reference hereby is made to that certain drawing No. D-92 on file in the office of the City Engineer of said city for said proposed grades, subgrades and elevations for the opening and extending of Louise Avenue and to that certain drawiDg No. D-93 on file in the office of the City Engineer of said city for the proposed . O/Lc'-f py~ grades, subgrades, and elevations for the opening and extension of Le Roy Avenue, which said drawings Resolution No. ~505 , of said City were approved and adopted by . I Y Counc~l on the 18th day of 1954, for full and detailed descriptions of the proposed grades, sub- grades, and elevations for said opening and extension of said streets and which said grades, subgrades, and elevations as are respectively established by said drawings D-92 and D-93, hereby are adopted and established respectively as the official grades, subgrades, and eleva- tions respectively for all purposes in connection with proceedings pursuant to this ordinance of intention. Notice hereby is given that said grades, subgrades, and elevations for the opening and exteDsion of said Louise Avenue and Le Roy Avenue are new grades, subgrades, - and elevations aDd no grades, subgrades, or elevations heretofore have been established for said portions of Louise Avenue or Le Roy Avenue to be opened and extended. . of June SECTION 5. Notice hereby is given that on the 15th day , 1954, at the hour of 8:00 o'clock P.M., iD the Council Chamber in the City Hall of said City of Arcadia, situated at 240 West Huntington Drive, Arcadia, any and all persons haviDg any objec- - tions to the proposed improvement may appear before the City Council and show cause why the proposed improvement should not be carried out in accordance with this ordinance of intention. SECTION 6. The Superintendent of Streets immediately shall . cause to be conspicuously posted along all OpeD streets within the assessment district and along and upon all private proper.ty which is to be 'taken for the improvement of the opening and extending of Louise Avenue and Le Roy Avenue, notices of the passage of this ordinance of _intention in the manner and form prescribed by law. , , The City Clerk hereby is directed to mail notices in the manner and form prescribed by law, notifying each property owner in . O,u!1! P9z the assessment district of the date of passage and number of this ordinance of intention and of the time and place set for the hearing of protests against the improvement. SECTION 7. Any lot or parcel of land belonging to the United States, or to the State of California, or to any county, city, public agent, mandatory of the government, school board, educational, penal or reform institution, or institution for the feeble minded, or the insane. which is in use in the performance of any public fUDction and is included within the assessment district shall be omitted from the assessment to be made to cover the expense of the improvement. SECTION 8. The City Council of the City of Arcadia hereby . declares its election to proceed with the aforementioned improvement pursuant to the provisions of and the powers given under Part 1 of Division 6 of the Streets and Highways Code of the State of California, which said part is known as the "Street Opening Act of 1903." SECTION 9. The City Clerk shall certify to the adoption of this ordinance of intention and shall cause the same to be published twice in the Arcadia Bulletin, a newspaper published and circulated in the City of Arcadia, the first of which publications shall be not less than t en days before the time fixed for hearing, to wit. the 15th day of Rune , 1954.
