HomeMy WebLinkAbout0895 ORDINANCE NO. 895 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING THE ANNEXA- TION TO SAID CITY OF CERTAIN UNINHABITED TERRI- TORY DESIGNATED AS ARCADIA ANNEXATION NO. 10 - HIGHLAND TERRITORY NO. 2 THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That pursuant to the provisions of the "Annexa- tion of Uninhabited Territory Act of 1939" as amended, a verified petition of the owners of the property hereinafter described was filed with the City Council of the City of Arcadia, requesting the annexation to the City of Arcadia, State of California, of that cer- tain uninhabited territory adjacent to and contiguous with the present city limits of the City of Arcadia, California, designated as ;!'Arcadia Annexation No. 10 - Highland Territory No. 2" and more particularly described hereinafter in Section 11 hereof. SECTION 2. That the property hereinabove described and proposed to be annexed to the City of Arcadia is uninhabited terri- tory as defined by Section 35303 of the Government Code of the State of California; that the above described property is contiguous to the territory contained within the corporate boundaries of the City of Arcadia; that said verified petition was signed by the own- ers of not less than one-fourth of the assessed value of subject ter~itory according to the last preceding equalized assessment roll . of the County of Los Angeles, to-wit; by the owners of all of the assessed value of subject territory according to the last equalized assessment roll of the County of Los Angeles. SECTION 3. That said proposal for the annexation of the above described uninhabited territory to the City of Arcadia has heretofore been submitted to ~nd reported upon favorably to the proponents thereof by the Boundary Commission of the County of Los . Angeles, with respect to the definiteness and certainty of the - 1 - 895 proposed boundaries thereof, as required by Section 35002 of the said California Government Code. SECTION 4. That the above described property presently lies within the corporate boundaries of and presently is a portion of the City of Monrovia. That there has heretofore been tiled with the City of Monrovia the written consent of at least two-thirds of the freeholders within such territory, holding at least two-thirds in value of the real property in such territory, to-wit: the written consent of all of the freeholders within such territory consenting to the detachment from the City of Monrovia, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" as amended, of the territory proposed to be annexed to the City of Arcadia; that the City of Monrovia has heretofore, by reso- lution of its City Council, duly and regularly passed, approved and adopted, consented to the detachment of aforesaid territory from the City of Monrovia and its annexation to the City of Arcadia. . . SECTION 5. That at a regular meeting of the City Council of the City of Arcadia, held on the 20th day of April, 1954, Reso- lution No. 2488, entitled "A ,RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GIVING NOTICE OF THE PROPOSED ANNEXA- TION OF CERTAIN TERRITORY ADJACENT TO AND CONTIGUOUS WITH THE PRESENT CITY LIMITS OF THE CITY OF ARCADIA, THE SAME BEING SITUATED NEAR THE NORTHEASTERLY PORTION'OF THE CITY OF ARCADIA AND DESIGNATED AS I ARCADIA ANNEXATION NO. 10 - HIGHLAND TERRITORY NO. 2 I ", was adopted by said City Council, giving notice of and fixing the first da~ of June, 1954, at 8:00 o'clock p.m., in the Council Chambers of the City of Arcadia as the day, hour and place when and where all persons owning real property in said territory so proposed to be annexed, and having any objection to the proposed annexation, might appear before the said City Council of the City of Arcadia and show cause why such territory should not be so annexed. That a copy of said Resolution No. 2488 was published in the Arcadia Tribune, a . - 2 - An" newspaper of general circulation published in the City of Arcadia, at least twice but not oftener than once a week, which said publica- tions were completed at least twenty days prior to June 1, 1954, the date set for the hearing on said annexation; and a copy of said Reso- lution No. 2488 was also published in the Pasadena Star News, a newspaper of general circulation published outside of the city of Arcadia but in the County of Los Angeles at least twice, but not oftener than once a week, which said publications were completed at least twenty days prior to June 1, 1954, the date set for the hearing on said annexation. SECTION 6. That written notice of such proposed annexa- tion was given to each person owning land within the territory thus proposed to be annexed in accordance with and as required by Section 35311 of the Government Code of the State of California. SECTION 7. That no person has filed his name, address or the designation of the lands in which he has any interest, either legal or equitable, with the City Clerk of the City of Arcadia. That no persons owning real property in said territory proposed to be annexed to the City of Arcadia appeared before the City Council at the hour and day and place fixed in said Resolution No. 2488, who had any objection to such annexation to the City of Arcadia, SECTION 8. That on the 11th day of December, 1954, there was filed with the City Clerk the written consent of the petitioners, as owners of all of the property so proposed to be annexed to the . City of Arcadia, wherein consent was given that the said property, after its annexation to the City of Arcadia, may be taxed equally with the property within the City of Arcadia to pay the bonded in- debtedness of the City of Arcadia, both interest and principle, out- standing on the date of such annexation. heretofore authorized and issued by the City Council of the City of Arcadia, to-wit: 1914 Street Bonds 1914 Water Bonds 1919 Water Bonds 1924 Street Bonds 1927 Water Bonds 1929 Library Bonds 1946 Sewer Bonds . - 3 - 8g;) , t SECTION 9. That the annexation of the above described territory is not precluded by Section 35002.5 of the said California Government Code. That no portion of the territory proposed to be annexed is owned by a public _sency. That all proceedings concerning Arcadia Annexation No. 10 - Highland Territory No, 2 have been in conformity with the law applicable thereto. . SECTION 10. That under and pursuant to and iD accordance with the provisions of the Annexation of Uninhabited Territory Act of 1939, as amended, the annexation of that certain uninhabited terri- tory contiguous to said City of Arcadia and known and designated as "AReAD>>' ANNEXATION NO. 10 - HIGHLAND TERRITORY NO.2", be and the same 18 hereby ratified, confirmed and approved, and the same is hereby ordained to be annexed to and made a part of the City of Arcadia, California, and that such property after its annexation to the City of Arcadia shall be taxed equally with the property within the City of Arcadia to pay the bonded indebtedness of the City outstanding on the date of such annexation heretofore author- ized and issued by the City of Arcadia, as described in Section 8, . hereinbefore. SECTION 11. That a specific description of the boundaries of said territory is as follows; Beginning at the north quarter section corner of Section 15, Township 1 North, Range 11 West, S.B.B. & M., thence easterly along the north line of said section to its first intersection with the boundary of the parc~l of land (Santa Anita Wash Debris Basin) described as Parcel 19 in Final Judgment in Case No. 578534 of the Superior Court of the State of California in and for the County of Los Angeles and recorded in Book 38542, page 214 of Official Records in the office of the Recorder 'of said County; thence southeasterly along said boundary and following the same in all its various courses to its intersection with the north and south quarter section line of said section; thence northerly along quarter section line to the point of begiDning. SECTION 12. That the boundaries of the City of Arcadia, California, be and the same are hereby altered to include the above- described territory, the annexation of which is hereby approved and ordained herein and incorporated in the City of Arcadia, California. - 4 - RO'f:: SECTION 13. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof shall "cause the same to be published once in the Arcadia Tribune, a newspaper of general circulation published and circulated in the City of Arcadia, and thirty days from and after the final passage thereof said Ordinance shall take effect and be in force. The City Clerk shall thereupon, on the taking effect of . this Ordinance, make and certify under the Seal of the City of Arcadia and transmit to the Secretary of State, of the State of California, a copy of this Ordinance giving the date of its passage. I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 6th day of July , 1954, by the affirma- tive vote of at least three Councilmen, to-wit: AYES: Councilmen Camphouse.
