HomeMy WebLinkAbout0813 ORDINANCE NO. 813 '" t~\.~~ '01 q,.~~ \\1>- ",q,.'\)' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REGULATING AND RESTRICTING THE USE OF WATER IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES: ORDAIN AS FOLLOWS: SEOTION 1: It is hereby deolared to be unlawful within the City of Arcadia, and contrary to the regulations of the Arcadia Water Department,. wherever water is served by the City of Arcadia, to use or permit the use of water for the watering or sprinkling of lawns or ornamental;. plants.. trees or shrubbery, between the hours; of eight o'olock A.M. and four o'olook P.M. of any day, and between the hours of nine o'olock P,M. of any day snd six o'clock A.M. of the following day. Provided, however, that any water oonsumer shall have the right to make applioation to the Water Superintendent for permission to use water for such watering or sprinkling during the hours specified, and if in the opinion of the Water Superintendent such permission is nec- essary to prevent damage to or the destruction of the property of the consumer, the Water Superintendent shall have the power in his dis- cretion to permit the temporary use of water for such purposes during , t\\\.\.\)~I~ A.,S ~o' .<;)~~' .') , the hours specified, subject to the approval of the City Counoil. \\~.c..~' Q" o~ll. .' SECTIOW 2: Any person, firm or corporation, who, or which, shall, violatethe terms of this Ordinance shallbe deemed guilty of a misdemeanor, and upon conviction thereof shallbe punished by a fine not exceeding Five Hundred Dollars ($$OO.OO), or imprisonment in the City Jail, or in the County Jail, at the discretion of the Committing magistrate, for a term not exceeding six (6) months; or by both such fine and imprisonment. SECTION 3: It is hereby'deolared that this Ordinance is an urgency Ordinance for the immediate preservation of the public health and safety and shall take effect upon ita passage. The facts con- stituting such urgency are as follows: The conservation of water is a matter of paramount necessity to ths health, welfare and safety of ~ ~I~ 4::"" ~o' ",:;; &\' <::,'li' ~90~O \1'. -:n.- Clrc/ rJ3 the public in the City of Arcadia and there is now no legislation adequate to control or prevent its use betwee~ the hours herein ment- ioned. In order that the public health will not be menaced by a lack of water, it is therefore neoessary that this Ordinance take effect upon its: passage. SECTION 4: The City Clerk shall certify to the adoption of this Ordinanoe and prior to the expiration of fifteen (1.5) days from the passage thereof shall oause the same to be published once in the Aroadia Bulletin, a newspaper of general circulation, published and circulated in the City of Arcadia. I HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the City Council of the City of Aroadia, held on the 20th day of June, 19.5~, by the affirmative vote of at least four Counoilmen, to wit: AYES: Councilmen Kennett, Klom?, Nottingham, :Schinockerand Sullivan NOES: None ABSENT: None City Clerk of the City of SIGNED AND APPROVED THIS 20th day of June, 19.50. adia.
