AN ORDINANCE OF THE CITY IXlUNCIL OF THE CITY OF ARCADIA, CALIFORNIA J
RE-ADOPTING THE UNIFORlI BUIWING CODE 1949 EDITION WITH REVISIONS
AND REPEALING ORDINANCES 518,536,541, 578, 609,6~6, 668, 681, 701,
736 AND 822 OF SAID CITY.
THE CITY lXlUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLCJiS I
SECTION 1. That a certain documsnt, three copies of which are on fUe
in the office of the City Clerk of the City of Arcadia, for the use and examina-
tion of the public, and being marked and designated as "Uniform Building Code,
1949 Edition," Volumes 1 and 2 adopted October, 1927 by Pacific Coast Building
Off:l.cials Conference, with revisions and adoptions approved at the 26th annual
meeting held October, 1948, including all Appendices thereof and thereto, but
excepting the following portions thereof I
Section 2204, Exception No. 3 reading as follOllllI
"3. A one-story building (except a Group I occupancy) which does not
exceed four hundred square feet (400 sq. ft.) in area, including
additions, may be constructed without a masonry or concrete foundation
if the walls are supported on a wood IIDldsill."
and excepting that portion of Section 2521, subdivision D reading as follOllllI
"ane-story buildings having a total floor area of not more than four
hundred square feet (400 sq. ft.) may have exterior walls of vertical
one-inch (1") boards and battens without studs."
are hereby .referred to, adopted and made a part hereof as if fulJ;y set out in
this Ordinance.
SECTION 2. That Section 301 (b) of aforesaid Uniform Building Code,
1949 Edition, as hereinbefore adopted, be and the same is hereby further amended
and augmented by the addition thereto of a neJr subdivision 6, the same to read
as f 01l0llll :
"CHAPTER 3, Section 301, Subdivision (b) Subsection 6. A statement
of the names and addresses of all subcontractors and materialJlien
who are to perform any work upon or supply any materials to or for
the improvement or structure for which a permit is thus applied for.
No final inspection or certti"icate of Qccupancy shall be given or
issued unless and until the general contractor shall, upon completion
of the improvement or structure for which final inspection is sought

or required, filed in duplicate with the building official, 'a
verified statement containing the names and addresses of all sub-
contractors and materialmen, other than those set forth in the
or~inal permit application, who shall have performed work or
furnished materials to or for the improvement or structure for which
final inspection or certificate of occupancy is sought or required."
SECTION 3. That aforesaid Uniform Building Code, 1949 Edition, as
hereinbefore adopted, be and the same is hereby amended and augmented by the
addition thereto of a new Chapter to be designated as Chapter 52 thereof, the
same to read as followsl
"CHAPTER 52 VARIANCE OF CODE PROVISIONS. Upon written application
by tJ!q interested person, stating the variance requested and the
reason therefor the City Council, by motion or resolution passed or
adopted by the vote of at least three members of the City Council
entered upon the minutes, msy, upon the written recommendation of
the City Engineer and the Building Superintendent of said City, and
upon the written recommendation of the Fire O:Iief of said City when-
ever a variance of any of the provisions of Chapter 16 of said
Uniform Building Code, 1949 Edition, or any other section thereof
involving fire protection or fire hazards, is requested, grant a
variance from the requirements of any one or more of the provisions
of this Ordinance end all ordinances amendatory hereof, upon the
terlll5 and conditions specified in the written recommendation of the
City Engineer and the Building Superintendent, and the written
recommendation of the Fire O:Iief when his recommendation is required.
Upon receipt of such application, the City Clerk shall
forthwith refer the same to the City Engineer and to the Building
Superintendent, and to the Fire Chief if his recommendation is re-
quired by the preceding paragraph for investigation and written report
by them to the City Council within fifteen days, and shall forthwith
mail to the owners of any real property which adjoins and is within
fifty feet of the property concerned for which such variance applica,tion
is made, notice that an application

for a variance from the provisions of this Ordinance and all
ordinances amendatory hereof has been made end stating the time
and place of the hearing to be held upon such application. Such
hearing shall be held at the first regular meeting of the City
Council held fifteen or more dqs after the filing of such epplica-
tion, but such hearing maybe continued from time to time for good
cause. Nothing herein contained shall preclude of the holding of
a Special !.!eeting of the City Council at any time for the purpose
of hearing and passing upon such an application. providing that at
least three dlliYB written notice shall have' been given to the awners
of any real property which adjoins and is within fifty feet of the
property for which variance application is made. No notice ,shall
be required when the applicant is the owner of all real property
which adjoins and is within fifty feet of the real property for
which such a variance is requested and such fact is disclosed in
the application, or when the owners of all real proper~ which ad-
joins and is within fifty feet of the property for which such
variance application is made waive notice by written waiver signed
by such party or parties and filed with the City Clerk, in either
such events the City Council may hear and pass upon such application
at any time upon receipt of the written report o.f the City Engineer
and the Building Superintendent, and of the Fire Chie! when his
recommendation is required by the foregoing provisions of this C2lapter."
SECTION 4. The City Clerk shall certify to the adoption of this
Ordinance and prior to the expiration of fifteen (15) dlliYB from the passage there-
of shall cause the same to be published once in the Arcadia Bulletin, a newspaper
of general circulation, published and circulated in the City of Arcadia.
I HEREBY CERTIFY that the foregoing ordinance was adopted at a regular
IDeeting of the City Council of the City of Arcadia held on the 2nd dq of
January, 1951, by the affirmative vote of at least three Councilmen. to witl
