Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, January 24, 2012, at 7:00 p.m., in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Baerg presiding. PLEDGE OF ALLEGIANCE Chairman Baerg led the Pledge of Allegiance. ROLL CALL PRESENT: Commissioners Baderian, Beranek Chiao, Parrille and Baerg ABSENT: None OTHERS ATTENDING Deputy Development Services Director /City Engineer, Phil Wray Community Development Administrator, Jim Kasama Senior Planner, Lisa Flores Associate Planner, Tom Li Assistant Planner, Nick Baldwin Senior Administrative Assistant, Billie Tone SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS There were none. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE PLANNING COMMISSION ON NON - PUBLIC HEARING MATTERS — Five - minute time limit per person There were none. PUBLIC HEARING 1. CONDITIONAL USE PERMIT NO. CUP 11 -19 26 E. Duarte Road Chao Jia The applicant is requesting a Conditional Use Permit to allow a Chinese language tutoring school for children ages 6 through 12 with a maximum attendance of 20 students at one time in a 1,020 square -foot commercial unit in a C-2 /General Commercial Zone. RESOLUTION NO. 1849 A Resolution of the Planning Commission of the City of Arcadia, Califomia, approving Conditional Use Permit No. CUP 11 -19 for a 1,020 square -foot Chinese language tutoring school for children ages 6 -12 with a maximum attendance of 20 students at one time at 26 E. Duarte Road. RECOMMENDATION: Conditionally approve CUP 11 -19 and adopt Resolution No. 1849 Mr. Baldwin presented the staff report. Commissioner Chiao asked if there will still be sufficient parking if the martial arts studio next door to the proposed tutoring center also gets the required permits. Mr. Baldwin explained that sufficient parking will still be available if that martial arts studio remains. Chairman Baerg asked if the auto repair shop that is located to the east of the donut shop is part of the same lot. Mr. Baldwin said it is not. Chairman Baerg asked if anyone would like to speak in favor of this project. No one stepped forward but the applicant indicated his presence. Commissioner Baderian asked the applicant if the schedule for the tutoring center would be the same as the schedule for the Arcadia schools. Mr. Jia, the applicant, speaking through an interpreter confirmed that his schedule will be the same except the tutoring center will remain open during the public school summer and vacation breaks. They will be closed during the spring break. Commissioner Baderian asked Mr. Jia if he read and understood all the conditions of approval and if he would be able to comply with them. Mr. Jia said that he understood the conditions and would comply with them. Chairman Baerg asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Chiao to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Parrille to approve Conditional Use Permit No. CUP 11 -19 subject to the conditions in the staff report and to adopt Resolution No. 1849. ROLL CALL AYES: Commissioners Baderian, Beranek, Chiao, Parrille and Baerg NOES: None There is a five (5) working day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Wednesday, February 1, 2012. 2. TENTATIVE TRACT MAP NO. TTM 71815 845 -851 W. Huntington Drive SGV Property Fund, LLC The applicant is requesting approval of a Tentative Tract Map to consolidate two Tots for a 10 -unit residential condominium subdivision. RECOMMENDATION: Conditional Approval Mr. Li presented the staff report. PC MINUTES 1 -2412 Page 2 Chairman Baerg asked if anyone would like to speak in favor of this project. There were none. Chairman Baerg asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Parrille to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Baderian to approve Tentative Tract Map No. TTM 71815 subject to the conditions in the staff report. ROLL CALL AYES: Commissioners Baderian, Beranek, Chiao, Parrille and Baerg NOES: None There is a ten (10) calendar day appeal period after the approval /denial of the subdivision. Appeals are to be filed by 4:30 p.m. on Friday, February 3, 2012. CONSENT ITEM 3. GENERAL PLAN CONSISTENCY NO. GP 12 -01 Review for Right -of -Way Vacations on Third Avenue and St. Joseph Street for the construction of the Gold Line Tight rail. Commissioners Baderian and Parrille asked for more information on this item. Mr. Wray explained that there are pieces of right -of -way that appear on assessor's maps as City -owned but are actually located within the rail right -of -way. He noted that there will be more of these items as the Gold Line project progresses. He said that the purpose of this action is to clarify ownership and to make a finding of conformance with the General Plan that these rights of way should be vacated for other uses. Commissioner Baderian asked if a general timeline had been established for these vacations. Mr. Wray explained that the funding is in place for the Gold Line extension per Measure R, a sales tax increase supports the project, and was approved by voters a few years ago. He said that contracts have been awarded and orders issued to proceed with construction. Mr. Wray explained that more vacations will follow within the next six months and a major vacation of Front Street from St. Joseph to Santa Clara for the parking structure, probably won't occur for another year, when the Gold Line Authority is ready to begin that construction. Commissioner Parrille asked about easement issues and right of reverter. PC MINUTES 1 -24-12 Pape 3 Mr. Wray said that the Gold Line Authority is doing the groundwork to make sure there are no issues with others who might claim an interest in these properties. He said that when a street is vacated, the ownership reverts to the adjacent owners only, not to anyone who claims a need for it or simply wants it, and the Gold Line Authority already owns the adjourning properties. Commissioner Beranek asked if the construction would begin in Pasadena and proceed to Azusa, or in the opposite direction. Mr. Wray said that the plans are to begin construction in Azusa and work westward to Pasadena. He noted that there are some issues yet to be resolved in Azusa; for example, there is a freight line that has to remain active, but must be relocated before the Gold Line can go through, and they need to reconstruct the bridge across the San Gabriel River. RECOMMENDATION: Recommend approval to City Council MOTION It was moved by Commissioner Baderian, seconded by Commissioner Chiao, to find that the vacations are consistent with the General Plan and to recommend approval to the City Council. MINUTES OF JANUARY 10, 2012 RECOMMENDATION: Approve MOTION It was moved by Commissioner Baderian, seconded by Commissioner ParriIle, to approve the minutes of January 10, 2012 as presented. MODIFICATION COMMITTEE AGENDA Chairman Baerg reported that a modification application for a garage remodel project was approved at the Modification Committee meeting. PC MINUTES 1 -24-12 Pape 4 MATTERS FROM STAFF & UPCOMING AGENDA ITEMS Mr. Kasama said that there are no items for the February 14 agenda at this point so unless something comes up, the meeting will be cancelled, but the cut -off date is Monday, January 30.
