AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA REGUI.ATING STREET SALES.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS:
SECTION 1. That the City Council does hereby find and
determine that the City of Arcadia is confronted with serious and
unique traffic problems. That the City of Arcadia 18 primarily a
residential community, surrounded by other residential, business,
manufacturing and recreational centers. That this fact, coupled
with the presence of large centers of enter~inment in the midst
of and in close proximity to the City of Arcadia, causes vehicular
traffic to, from, through and within the City of Arcadia at times
to attain dimensions totally dis-proportionate to the size and
population of this City. That on frequent occasions the population
within the City 1s increased as much as five-fold in the space of
two hours, and tens of thousands of motor vehicles enter or pass
through portions of the City within an hour, w1th the result that
abnormal traffic problems result which cannot be met or solved by
the mere increase in law enforcement personnel. That any hindrance
of the flow of such vehicular traffic causes delay, traffic con-
gestion, accidents and imminent peril to both life and property
within the City. That the sale of any commodity from a vehicle
or to a person in a vehicle on any major traffic arterial in said
City pecuJarly adds to the local traffic congestion, delay and
hazard to life and property. That strict enforcement of traffic
laws alone is insufficient to cope with the situation; that it
is not pOSSible to employ sufficient Police officers adequately
to control such unique traffic prOblems, not only because of the
present manpower shortage, but particularly because of the fluct-
uating volume of such vehicular traffic. That it is therefore nec-
essary to remove and prevent, so far as is possible, all factors
which contribute to or cause any interference with or retardation
of the movement of vast numbers of motor vehicles in the City of
Arcadia.
SECTION 2. For the purpose of this Ordinance the following

words are hereby defined, and wherever used in this Ordinance such
respective words shall be deemed to and shall be interpreted to
convey the meaning herein ascribed to them;
(a) "Street" shall mean and include any and every public
thor~ughfare, way, street, alley and highway, the curb-
ing, sidewalk and parkWay if any, adjacent thereto, and
any public property bordering upon such thoroughfare,
way, street, alley and highway.
(b) The term "to park" shall mean the tllacing or leaving of
a motor vehicle in a street,as defined in the preceding
SUb-section, in strict compliance with all applicable
State laws and City Ordinances and regulations adopted
pursuant thereto, controlling ,or regulating the parking
of vehicles in streets, and at a location and in a
manner where vehicles.may be lawfully left unattended
for any period of time. The term shall not include:
The standing or leaving of any vehicle in a stree~

(1) J)lU'suant to the order or demand of any law en-
forcement officer.
(2) Pursuant to any traffic control signal or device.
,(3) The temporary standing or stopping of a vehicle
at locations where such standing or stopping is lawful
for the sole plU'pose of receiVing or discharging passen-
gers or merchandise.
(4) The temporary standing or leaving of a vehicle
in the customarily travelled portion of any street.
SECTION 3. That it shall be unlawful for any person, firm
or corporation, by any means, within the City of Arcadia to engage
or participate in the business or practice of dissim1nating, dis-
tributing, passing out, giving out, handing out, selling, offering
for sale or soliciting for the sale of any sheet, dodger, handbill,
circular, letter, booklet, newspapers or any other printed, type-
written, mimeographed or written matter of any kind, or any goods,

wares, merchandise or commodity of any kind whatsoever either,
(a) From any vehicle in a public street, or

(b) To any person or persons within or upon any vehicle
in a public street, or
(c) To or into any vehicle located upon any public street,
unless such vehicle from which, into which, and in or on Which persons
are thus located, be lawfully parked.
SECTION 4. All permittees and licensees holding permits or
licenses heretofore or hereafter issued, shall comply ~th the terms
hereof. All Ordinances in conflict herewith or inconsistent herewith
are hereby repealed to the extent that they are in conflict with or
inconsistent with any provision hereof.
SECTION 5. Any person, firm or corporation violating any of
tho provisions of this Ordinance shall be deemed guilty of a misdemeanor,
and upon conviction thereof shall be punishable by a fine of not more
than Five'Hu.l1.drad ($500.00) Dollars, or by imprisoIl.'nent in the City Jail
of said City of Arcadia, or in the County Jail of the County of Los
Angeles, State of California, at the discretion of the Committing
Magistrate for a period not exceeding six (6) months or by both such
fine and imprisonment.
SECTION 6. This Ordinance is hereby declared to be an
emergency measure necessary for the immediate preservation of the
public peace, health and safety, and shall take effect immediately.
The following is a statement of the facts shoving its urgency: The
conditions, dangers and evils described in Section 1 hereinabove, are
present and will soon become greatly increased and exaggerated by the
opening of the racing season at Santa Anita Park on December 2e, by the
Tournament of Roses Parade on January 1, 1952, the Rose Bowl Football
game on January 1, 1952 and by the seasonal increase in traffic re-
sulting from the forthcoming holidays. Unless this Ordinance take
effect immediately it will be impossible adequately to cope with such
increased traffic problems.
SECTION 7. The City Clerk shall certify to the adoption of
this Ordinance and prior to the expiration of fifteen (15) days from
the passage thereof shall cause the same to be published once in the
Arcadia Bulletin, a newspaper of general circulation, published and
circulated in the City of Arcadia.

I HEREBY CERTIFY that the foregoing Ordinance was adopted
adjourned
at ayregular meeting of the City Council of the City of Arcadia, held
on the 25th day of December, 1951, by the affirmative vote of at
least three Councilmen, to wit:
