HomeMy WebLinkAbout0841 ORDINANCE NO.84l AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CAIIFORNIA, AMENDING ORDINANCE NO.737 OF SAID CITY BY AMENDING SUBSECTION (a) OF PARAGRAPH 1 OF PART 53 OF SECTION 23 THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. That subsection (a) of Paragraph 1 of Part 53 of Section 23 of Ordinance No.737 of the City of Arcadia entitled: aAN ORDINANCE OF THE CITY COUNCIL OF THE IUTY OF ARCADIA, CALIFORNIA, LICENSING THE TRANSACTION AND CARRYING ON OF CERTAIN BUSINESSES, TRADES, PROFESSIONS, CALLINGS AND OCCUPATIONS IN THE CITY OF ARCADIA, FOR THE PURPOSE OF RAISING MUNICIPAL REVENUES, AND PROVIDING A PEN- ALTY FOR THE VIOLATION THEREOF AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH.", passed, approved and adopted November 16, 1948, be and the same is hereby amended to read as follows: "SECTION 23 LICENSE RATES. PART 53 PEDDLING AND SOLICIT- ING CERTAIN TYPES OF SALES. 1. (c) No person shall, in the disseminating, distri- buting, passing out, giving away, handing out, selling, offering for sale, or soliciting for the sale of any of said materials described in the foregoing subsection (a), interfere with or cause interfer- ence with the normal flow of traffic upon the City streets of Arcadia. For the purpose of preventing congestion in traffic upon the public streets of the City of Arcadia the location occupied by such per- ( Bon in the conduct of such business, whether such location be on pUblic or on private property, shall be subject to the approval of the Chief of Police of the City of Arcadia; prOVided, however, that any person aggrieved by the decision of the Chief of Police under this subsection may appeal to the City Council, in which event the City Council by order of the majority of its members en- I tered upon the Council Minutes, may affirm~ ~odify or reverse such decision of the Chief of Police, and the Council's action in such (' matter shall be final; provided, further, however, that i~ shall be unlawful for any person at any time in the City of Arcadia to disseminate, distribute, pass out, give away, hand out, sell, offer -1- OA-C/ # \+-~ F5// for sale or solicit for the sale of any of said materials des- cribed in the foregoing subsection (a) either in violation of any provision of Ordinance No.840 of the City of Arcadia, or in, on, or from that portion of any street in the City of Arcadia custom- arily travelled by motor vehicles; and provided further that it ,,," shall be unlawful for any person to disseminate, distribute, pass out, give away, hand out, sell, offer for sale or solicit for the : I sale of the said materials described in the foregoing Subsection \ \ (a) at any place within the City of Arcadia within the hours of \ 4:00 P.M. and 7:00 P.M. on any day. The violation of any provision \' \ \ of this subsection shallin addition to any other penalty be grounds for the cancellation by the City Council of any license issued pursuant to this Section. SECTION 2. This Ordinance is hereby declared to be an emergency measure necessary for preserving the public peace, health and safety and shall take effect immediately upon its adoption. The following is a statement of the facts constituting, and the reasons for its urgency: Ordinance No.840 of the City of Arcadia has been enacted to cope with the unique local traffic prOblems. To insure the integration of said Ordinance No.840 with Ordinance NO.737 as hereby amended, and to remove possible conflict and inconsistencies between said Ordinances, it is necessary that this Ordinance take effect immediately. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof shall cause the same to be published once in the Arcadia Bulletin, a newspaper of general circulation, pUblish- ed and circulated in the City of Arcadia.
