HomeMy WebLinkAbout0843 \'< ORDINANCE No.843 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REPEALING ORDINANCE NO. 541 OF SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Pursuant to the recommendation of the Planning Commission of the City of Arcadia, and in accordance with the re- quest of the owner of the property affected, that Ordinance No. 541 of the City of Arcadia, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA MAKING AN EXCEPTION TO CERTAIN PRO- visions of ordinance no.439 OF SAID CITY OF ARCADIA, ADOPTED JUNE 28, 1940.", adopted March 20, 1945" be and the same is hereby repealed, and the variance thereby granted be and the same is hereby rescinded. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and prior to the expiration of fifteen (15) days from the passage thereof, shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general circulation, published and circulated in the City of Arcadia, and thirty (30) days from and after the final passage thereof said Ordinance shall take effect and be in force. WHLREAS, upon application duly made and after public hearings regularly held after notice Given as required by law, this Commission by its motion adopted on February 28, 1945, recom- mendai to the City Council that a variance be granted affeoting the following desoribed property in the City of Arcadia, to wit: That portion of Lot 6 of Tract lio. 949, in the City of Arcadia, County of Los AnGeleB. state of California, as shown on map recorded in Book 17, Page 13 of Maps, in the office of the Recorder of suid County, describud as follows: Beginning at a point in tho westerly line of sa~d Lot 6, said point belng the southwest corner of that parcel of land conveyed to Times-Mirror Company and described in dbed recorded in Book 16465, Page 372 of Official Records of said County; thence following the south boundary line of said parcel of land so described as follows: N 890 01' 55" E, 317.87 teet; S 00 58' 05" E, 30 feet; N 8g0 01' 55" 1::. 225 feet to the southwest corner of said parcel of land; thence S 00 58' 05" E alonG the west line of Tract ~ro. 12900, as shown 01l map recorded in Book 262, Pages 47 and 48 ot Haps, Records ot said County, 219.73 feet; thence N 890 011 55" E along the southerly line of said Tract No. 12900, 30 feet; thence S 00 56' 05" E along the southerly proloneation of the center line of Placiente noad (60 feet in width) as the sa:ne is shown on said map of ':'ract lro. 12900, 210-27 feet; thence S 890 01' 55" W, 572.67 feet to the west line of Lot 6 of said 'l'raot No. 949; thence :r 00 56' 05" W, along the weet line of said Lot 6, 460 feet to the point of beginning: hXC~PTINO therefrom any portion thereof within that parcel of land conveyed to City of Arcadia described in deed recorded in Book 18120. The above described parcel of land has a calculated area of 5.296 acres. to be used and occupied in connection with the restaurant and bungalow-hotel which were constructed and are now being operated pursuant to exceptions granted by Ordinance ~o. 421 of the City of Arcadia, adopted on the lOth day of October, 1939, and Ordinance No. 458 of the City of Arcadia, adopted on the 22nd day of April, -1- /l:io. /70, ,tj~7 6 ~t' ~// (;f/ l~.l, to~ the tollowing purpo...s (a) The constructing, maintaining and establishing ot sixty (60) bungalow hotel living unita, more or less, and Garages for use in conneetion therewith, (b) A curio shop; beauty and barber shop, for use in rendering personal service to guests of suid bungalow hotel, (0) A swimming pool, badminton and tennis courts, pur- suant to which the City Council of' the City of Arcadia did on March 20, 1945, pass, approve and adopt its certain Ordinance No. 541 entitled RAn Ordinance of' the City Council of the City of Arcadia Making an Exception to Certain Provisions of Ordinance No. 439 of Said City of J.rcad1a, Adopted Juno 26, 1940," wherein and whereby the variance recommended by the Commission ':J<i,> :;:.~qnted; Ilnd WHEREAS, Rancho Santa Anita, Inc.; the owner of the above-described property, has requested that the aforesaid variance be cancelled. NOW, THEREFORE, the City Planning Commission ot the City of Arcadia, California, does hereby find, determine and resolve as tallows: SECTION 1. That tho property affected by aforesaid variance is in the prooess of subdivision; that when the property 1s subdivided, the variance will not only not be of use. but will become oontrary to the spirit and intent of the Zoning Ordinanoe and be detrimental to the area; that good oause exists fer the oancellation of said variance, and the cancellation thereof will not be detrimental to the publio welfare nor injurious to the adjoin- ing property. SECTION 2. That this Commission does hereby recommend to the City Council of the City of Arcadia t~t the abov&-descrlbed variance here1nbefore Branted be oancelled and that said Ordinance No. 541 be repealed. RESOLVED FURTI~RJ that the Secretary shall certify to the adoption of this Resolution. and shall forward a copy of the same to the City Council of the City ot Arcadia.
