ORDINANCE 1832
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, ADDING AND AMENDING SECTIONS OF THE ARCADIA
MUNICIPAL CODE PERTAINING TO THE D ARCHITECTURAL DESIGN
ZONE
WHEREAS, a text amendment was initiated by the City for the
consideration of adding and amending Sections of the Arcadia Municipal
Code pertaining to the D Architectural Design Zone, and
WHEREAS, a Public Hearing was held on February 25, 1986 before the
Planning Commission at which time all interested persons were given full
opportunity to be heard, and to present evidence, and
WHEREAS, the Planning Commission of the City of Arcadia
recommended subject amendment to the City Council, and
WHEREAS, the City Council conducted a Public Hearing concerning
this proposal on March 18, 1986 and approved the amendment.
NOW, THEREFORE, THE CiTY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 9272.2.1 of the Arcadia Municipal Code is
amended to read as follows:
9272.2.1. COMPLIANCE OF PLANS (COMMERCIAL, INDUSTRIAL). Plans
of the exterior architectural design and appearance of all buildings and
structures, plot plans, landscape plans, advertising plans, parking area
plans and building setback plans shall comply with the regulations
determined and established by the Council pursuant to Subsection 9272.2,
and no building permit shall be issued for plans which do not clearly
comply with such regulations, unless such plans are approved by the
Planning Commission.

SECTION 2. Section 9272.2.2 of the Arcadia Municipal Code is
amended to read as follows:
9272.2.2. APPEAL (COMMERCIAL, INDUSTRIAL). In the event that
the Director of Planning shall determine that any plans submitted do not
clearly comply with the regulations established by the Council pursuant
to Subsection 9272.2 hereof, the person submitting such plans may,
within thirty (30) days after such decision, appeal in writing to the
Planning Commission for approval of such plans.
SECTION 3. Section 9272.2.3 of the Arcadia Municipal Code is
added to read as follows:
9272.2.3. COMPLIANCE (RESIDENTIAL). The following areas are
subject to application of the Design Overlay Zone and the regulations
promulgated by City Council Resolutions applicable to said areas as
designated by reference to the applicable Homeowners Association. All
property, residents, and occupants within said areas are subject to this
ordinance and Resolutions Nos. 5286, 5287, 5288, 5289, and 5290.

South of Orange Grove Avenue
Specific property descriptions with reference to each respective
Association and area subject to this ordinance ad related resolutions
are on file at the City of Arcadia Planning Department.
SECTION 4. Section 9272.2.4 of the Arcadia Municipal Code is
added to read as follows:
n9272.2.4. APPEAL (RESIDENTIAL). Concerning all appeals to the
City Planning Commission or City Council pursuant to the Resolutions
referred to above, failure to comply with the procedural requirements
set forth in said resolutions shall constitute grounds for the
Commission or Council to reverse any decision of the Architectural
Review Board/Committee (ARB), or remand to the ARB any such decision
made by the ARB that has been appealed.

SECTION 5. The City Clerk shall certify to the adoption of this
Ordinance and shall cause a copy of the same to be published in the
official newspaper of said City within fifteen (15) days after its
adoption.
