ORDINANCE NO. 1834
AN URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA, IMPOSING
A MORATORIUM IN THE CONSIDERATION OF, AND
PROHIBITING LAND-USE, AND BUILDING PERMITS OF
ALL APPLICATIONS FOR TENTATIVE MAPS OR
TENTATIVE PARCEL MAPS RESULTING IN A DIVISION
OF LOTS OR THE CREATION OF NEW OR ADDITIONAL
PARCELS IN A SPECIFIED AREA OF THE CITY
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
HEREBY FIND, DETERMINE AND ORDAIN AS FOLLOWS:
SECTION 1. AUTHORITY/AREA EFFECTED BY ORDINANCE. This
Urgency Ordinance is necessary for the immediate preservation of
the public health, and welfare and shall take effect immediately
upon its introduction and adoption in accordance with Arcadia
Charter Section 415 and Government Code Section 65858. This
Urgency Ordinance is based on the findings set forth below
showing that there is a current and immediate threat to the
public, health, safety and welfare caused by the approval of
additional subdivisions that would be inconsistent with proposed
rezoning provisions considering rezoning to require a minimum lot
size of 30,000 square feet or a similar provision, which is
currently under review and will be the subject of a complete
study to be considered by the City Planning Commission and City
Council. The area affected (subject area) subject to this
ordinance is described as follows, and is further delineated by
Exhibit A attached and incorporated as part of this Urgency
Ordinance:

Beginning at a point which is the intersection
of the centerline of Camino Real Avenue and the
centerline of Eighth Avenue, then north along
the centerline of Eighth Avenue to its inter-
section with the westerly prolongation of the
southerly line of Tract No. 30713, thence
easterly along said southerly line to its inter-
section with the easterly right-of-way of the
Santa Anita Wash, thence northerly along said
easterly line to the Arcadia City Limit, thence
easterly along said City Limit to the centerline
of Tenth Avenue, thence southerly along said
centerline to its intersection with the centerline
of Camino Real Avenue, thence westerly along said
centerline to its intersection with the centerline
of Eighth Avenue, the point of beginning.
SECTION 2. FINDINGS.
a. Current zoning for the area subject to this Urgency
Ordinance is R-l. Based on the general character and size of the
lots in subject area, there lS nothing to preclude the division
of current lots to numerous parcels and the construction of a
number of single-family homes thereon.
b. Numerous objections have been received with regard to
subdivision proposals and substantial concern has been expressed
with regard to (1) maintaining the rural type character of the
neighborhood (2) maintaining the equestrian use attributes of the
neighborhood.
c. It is acknowledged that Arcadia is primarily a
residential community characterized by concern for maintaining
the character and quality of its neighborhoods, and property
values, so as to preserve and maintain their harmony and
character within the community.

d. Substantial concern has been expressed that the division
of lots in subject area will have a negative impact on the
neighborhood and on the City and will substantially change the
character of subject area and increase the negative impacts on
the City and neighborhood.
e. The City does not currently have zonlng provisions to
deal with the maintenance of large lots in subject area and other
provisions which would assist with regard to maintaining subject
area and precluding its division into smaller parcels.
f. Preservation of the status quo is necessary to address
the problems and the circumstances referred to above pending a
study and review so as to avoid the negative affects and
potential problems caused by the granting of tentative maps and
tentative parcel maps that would result in land usage
inconsistent with zoning proposals under study.
SECTION 3. PURPOSE. The purpose of this Urgency Ordinance
is to preclude consideration of lot divisions as set forth in
Section 4 below because it would be contrary to the findings set
forth above to allow such occurrences pending the study, review
and processing of possible code amendments to regulate such
applications. The current allowance of subdivision maps would
permit evasion of the above concerns and future regulatory
provisions of the City including zoning laws and would defeat, in
whole or in part, the ultimate objective of prospective code
amendments.

SECTION 4. EFFECT. With reference to those matters set
forth below, commencing with the effective date of this Urgency
Ordinance, the City shall not take any action or consider any
applications filed subsequent to the effective date of this
Urgency Ordinance. Neither the City Council, Planning Commission
or other agency or department of the City shall approve any
permit, license or land-use allowance applied for subsequent to
adoption of this ordinance with reference to the following:
(a) Tentative Maps
(b) Tentative Parcel Maps
(c) Applications or permits sought with reference
to the creation of new or additional parcels on any
property in subject area.
SECTION 5. VIOLATION. No person shall violate any
provision, or fail to comply with any of the requirements of this
Urgency Ordinance. Any person violating any of the provisions or
failing to comply with any of the mandatory requirements of this
Urgency Ordinance shall be guilty of a misdemeanor. Any person
convicted of a misdemeanor under any provision of this Urgency
Ordinance shall be punishable by a fine of not more than five
hundred dollars ($500.00), or by imprisonment in the City Jailor
County Jail for a period not exceeding six (6) months, or by both
such find a imprisonment. Each such person shall be guilty of a
separate offense for each and every day during any portion of
which any violation of any provision of the Urgency Ordinance is
committed, continued, or permitted by such person and shall be
punishable accordingly.

SECTION 6. NUISANCE. In addition to the penalties provided
in the preceding section, any condition caused or permitted to
exist in violation of any of the provisions of this Urgency
Ordinance shall be deemed a public nuisance and may be, by the
City, summarily abated as such, and each day such condition
continued shall be regarded as a new and separate offense.
SECTION 7.
SEVERABILITY.
If any section, subsection,
sentence, clause, phrase or portion of this Urgency Ordinance is,
for any reason, held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this
Urgency Ordinance. The City Council of the City Arcadia hereby
declares that it would have adopted this Urgency Ordinance and
each section, subsection, sentence, clause, phrase or portion
thereof irrespective of the fact that anyone or more sections,
subsections, sentences, clauses, phrases or portions be declared
invalid or unconstitutional.
SECTION 8. EFFECTIVE DATE. The City Clerk shall certify to
the adoption of this Urgency Ordinance and shall cause a copy of
the same to be published in the official newspaper of said City
within fifteen (15) days of the adoption hereof. This Urgency
Ordinance is effective immediately upon adoption. This Urgency
Ordinance is in effect for forty-five (45) days from the date of
adoption subject to extension pursuant to a noticed public
hearing.
