FOR DECEMBER WINDSTORM DAMAGE SIDEWALK REPAIRS PROJECT IN THE AMOUNT OF $113,982 WHICH INCLUDES A 10% CONTINGENCY Recommendation: Approve SUMMARY The 2011 December Windstorm destroyed hundreds of City trees and caused damage to City infrastructure, including pedestrian sidewalks, driveway approaches, and curb and gutter. On January 23, 2012, Public Works Services staff conducted a formal bidding process to award a contract for the December Windstorm Damage Sidewalk Repair Project which involves utilizing private contractors to repair damaged sidewalks, curbs, and driveways and to remove remaining stumps along major arterial and collector streets, caused by the 2011 December Windstorm. Based on the bid results received, staff recommends that the City Council award a contract to CJ Construction, Inc. for the Wind Storm Damage Sidewalk Repairs Project in the amount of$113,982 which includes a 10% contingency. DISCUSSION The Public Works Services Department is responsible for the maintenance and repair of approximately 147 miles of roadways and approximately 17,000 trees within the public right-of-way and on City property. The 2011 December Windstorm resulted in the loss of approximately 532 City owned trees by either shearing off trees at their trunks, breaking off major limbs, or by uprooting entire trees. When these uprooted trees tipped over, the curbs and sidewalks adjacent to the trees were broken and lifted as well, obstructing the pedestrian path of travel and creating significant safety hazards. Damage along arterial streets has been assessed to include 400 lineal feet of concrete curb, 7,000 square feet of sidewalk, and the removal of 150 tree stumps (Exhibit A). Restoring the safe path of travel along major arterial and collector streets is the first priority of the repair and restoration process. Staff recommends that outside contract Page 1 of 3 Mayor and City Council February 21, 2012 services be used to accomplish this work due to the amount of work involved and the need to accomplish this work quickly along heavily travelled roadways. Utilizing private contractors for this work will allow City crews to focus their attention on repairs along secondary and residential streets and to continue with their previously scheduled work as part of their regular operations. Additionally, bidding out this work will ensure that the City receives competitive prices. The project presented in this report does not include the replacement of City trees that were lost in the Windstorm. The replacement of trees in the City's public right-of-way will be addressed as a separate project and will be presented to the City Council at a later date. Additionally, staff is currently looking into a competitive tree planting grant program through the County to plant trees in vacancies. Grant award amounts are a maximum of up to $100,000 and the deadline to submit the grant application is the end of May 2012. Staff will be coming back to the City Council in March/April to seek approval of a resolution for the grant application process. A Notice Inviting Bids was published in the adjudicated paper and bid packages were distributed to qualified contractors. South El Monte $190,425.80 Staff has reviewed the bid documents for content and has investigated the responsible low bidder's background and recent projects for competency. CJ Construction, Inc. has successfully completed similar projects for the City, performing their work in a competent, timely manner, free from unwarranted change orders. It is staff's opinion that CJ Construction, Inc. can satisfactorily perform the work required and therefore, recommends that the City Council award a contract to CJ Construction, Inc. for the December Windstorm Damage Sidewalk Repairs Project in the amount of $113,982 which includes a 10% contingency. ENVIRONMENTAL ANALYSIS This project involves the repair of existing streets, sidewalks, gutters, with no expansion of the existing use of these facilities. Therefore this project is considered to be categorically exempt per Section 15301(c), of the California Environmental Quality Act. FISCAL IMPACT The estimated cost for the December Windstorm which includes emergency response, staff time, debris removal, and restoration of City infrastructure is $2.8 million. On December 15, 2011, the City Council adopted Resolution No. 6812, appropriating $1.8 Page 2 of 3 Mayor and City Council February 21, 2012 million to the Emergency Response Fund in response to the 2011 December Windstorm. RECOMMENDATIONS 1. Award a contract to CJ Construction, Inc. for the December Windstorm Damage Sidewalk Repairs Project in the amount of $113,982 which includes a 10% contingency. 2. Waive any informalities in the bid, or bidding process. 3. Authorize the City Manager and City Clerk to execute a contract in a form approved by the City Attorney.
