HomeMy WebLinkAbout1843 ORDINANCE NO. 1843 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA ADDING CHAPTER 7 TO ARTICLE I OF THE ARCADIA MUNICIPAL CODE REGARDING ELECTION DATES WHEREAS, the City of Arcadia is a Charter City; and WHEREAS, the California State Elections Code prescribes certain regular election dates; and WHEREAS, pursuant to Elections Code Section 2503 subsection (2) the Chapter prescribing regular election dates does not apply to elections held in Chartered Cities in which the Charter provisions are inconsistent with the provisions of said Chapter; and WHEREAS, Arcadia City Charter Section 1102 states as follows: Unless otherwise provided by ordinance hereafter enacted, all elections shall be held in accordance with the provisions of the Elections Code of the State of California, as it exists or lS amended, for the holding of municipal elections, so far as the same are not in conflict with this Charter. WHEREAS, the City of Arcadia has determined that it is in the best interest of the community to be able to conduct elections at times other than as set forth pursuant to the Elections Section 2500; and -1- 1843 WHEREAS, the City of Arcadia desires to exempt itself from the limitations imposed by Elections Code Section 2500 and to avail itself of Subsection (2) of Elections Code Section 2503; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Section 1700 is hereby added to the Arcadia Municipal Code to read as follows: 1700. ELECTION DATES. Sections 2500-2563 of the Elections Code of the State of California and any amendments thereto do not apply to elections conducted under the authority of the City of Arcadia. Subject to adoption of the appropriate resolutions, municipal elections in Arcadia may be held on dates other than those set forth in Section 2500 of the State Elections Code. SECTION 2. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the official newspaper of said City within fifteen (15) days after its adoption. MILLER, CITY ATTORNEY SUB~: ORDINANCE 1843 Pursuant to direction of the City Council to provide the appropriate documentation for a Charter Election to occur on April 21, 1987, the attached Ordinance is a necessary prerequisite to exempt Arcadia from the prescribed election dates set forth in the California Elections Code. Subject Ordinance authorizes the City Council of Arcadia to conduct municipal elections at times other than those specified in the State Elections Code. As a Charter City, this is permissible as set forth in the preamble to the Ordinance. The Ordinance provides a general exemption to the Elections Code. Specific elections must still be called by appropriate Resolutions. If the City Council calls for an election on April 21, 1987 to consider a Charter amendment providing for consolidated elections with the school district the calling for that election requires a resolution of the City Council no later than January 16, 1987.
