ORDINANCE NO. 1847
AN ORDINANCE OF 'fHE CI'rY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA AMENDING THE
REDEVELOPMEN'f PLAN FOR THE CEL,TRAL REDEVELOPL1ENT
PROJECT
WHEREAS, S.B. 690 mandates that all redevelopment plans in
the State of California adopted prior to December 31, 1977 stipulate
the maximum amount of tax increment revenue a redevelopment agency
may receive from a redevelopment project area, establish a time
limit within which a redevelopment agency may initiate Eminent
Domain actions on properties within a project area, and establish
a length of time a redevelopment plan can be in existence; and
IvHEREAS, the Redevelopment Plan for the Central Redevelopment
Project in Arcadia, as amended, does not contain the provisions
required by S.B. 690; and
WHEREAS, the existing Land Use Map for the Redevelopment Plan
for the Central Redevelopment project in Arcadia as amended by
Ordinance 1722 on May 19, 1981 contains certain inconsistencies
with the City of Arcadia's General Plan which this Amendment Number
Two will resolve; and
WHEREAS, the Agency desires to make certain other text changes
affecting the time for processing Design Reviews and owner partici-
pation opportunities and criteria; and
WHEREAS, an Environmental Checklist has been completed finding
that no significant impacts will result due to this Amendment Number
TwO; and

WHEREAS, on October 14, 1986 the Planning Commission reviewed,
considered and approved a proposed amended Redevelopment Plan and
directed preparation of a Resolution reflecting that decision;
and
WHEREAS, the Planning Commission ratified their findings and
approved the proposed Amendment Number Two and recommended approval
by both the Arcadia Redevelopment agency and the Arcadia City
Council in Planning Commission Resolution No. 1324; and
WHEREAS, the Arcadia Redevelopment Agency after a Public Hear-
ing, notice of which was sent certified mail, return receipt re-
quested, to all property owners and taxing agencies in the Project
Area, and notice of which was placed in the Arcadia Tribune for
three consecutive weeks, reviewed and considered public comment
and adopted Resolution No. ARA-125 approving Amendment Number Two
to the Redevelopment Plan, and recommending approval of said Amend-
ment by the City Council; and
WHEREAS, the City Council after duly noticed Public Hearing
has reviewed and considered public comment and the recommendations
of the Planning Commission and Redevelopment Agency.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The Redevelopment Plan for the Central Redevel-
opment Project (the "Redevelopment Plan"), as adopted pursuant
to Ordinance No. 1490 of the City of Arcadia, California, as amended
by Ordinance No. 1722 of the City of Arcadia, California, is hereby
amended as follows:

(1) Section 100 of the Redevelopment plan is amended by sub-
stituting for the current title a new title for Section 100 to
read in its entirety, "Introduction and 'l'erm of Redevelopment Plan";
by adding a new heading immediately preceding the first paragraph
of Section 100 to read, "A [~ 101] Introduction"; and by adding
a new Subsection B. [s 102] to read in its entirety as follows:
"B. [~102] Term of Redevelopment Plan
This Redevelopment Plan shall remain in effect
until June 30, 2026.";
(2) Section 301 of the Redevelopment plan is amended by
adding thereto a new Subsection (7) to read in its entirety as
follows:
"(7) Housing assistance to low and moderate income fami-
lies as required by law.";
(3) Section 303 of the Redevelopment plan is amended by adding
thereto the following paragraph:
"'l'he Agency shall commence Eminent Domain proceed-
ings for the acquisition of property within the Project
Area no later than June 30, 1998, or such later date
as may be permitted by law.";
(4) The last paragraph of Section 307 of the Redevelopment
Plan is amended to read in its entirety as follows:
"Participation opportunities shall necessarily be
subject to and limited by such factors as the expansion
of public facilities; elimination and changing of land
uses; realignment of streets; the ability of owners to

finance acquisition and development in accordance with
the Plan; the ability of the Agency to pay for any and
all costs pertinent to participation opportunities; any
reduction in the total number of individual parcels in
the Project Area; and development of sites for commer-
cial centers, office and/or industrial parks;
(5) Section 324 of the Redevelopment Plan is amended by adding
following the phrase "prior to" and immediately preceding the words
"the time" the words "contemporaneously with, or within a reason-
able period of time after.";
(6) Section 401 of the Redevelopment Plan is amended by adding
thereto the following paragraph:
"The Map shall be deemed automatically to be
amended to conform to, and shall be deemed to include
any and all changes in, the General Plan of the City
of Arcadia as the General Plan hereafter may be amended
from time to time.";
(7) Section 406 of the Redevelopment Plan is amended by delet-
ing therefrom in its entirety the second paragraph;
(8) Section 417 of the Redevelopment Plan is amended by adding
to the first sentence of the first paragraph thereof the words,
"pursuant to Section 426.";
(9) Section 418 of the Redevelopment Plan is amended by in-
serting a comma following the word "new" and by adding following
the word "new" and immediately preceding the word "signs" the words
"revised or altered";
(10) The first paragraph of Section 424 of the Redevelopment
Plan is amended by adding thereto the following:

"These standards may impose more stringent requirements,
but may not impose less stringent requirements, than
those set forth in the City's Zoning Ordinance. The
Design Review Standards shall be adopted, or amended,
only after notice of a Public Hearing concerning the
adoption or amendment thereof is published for two (2)
successive weeks in a newspaper of general circulation
within the City and after a Public Hearing is conducted."i
(11) Section 426 of the Redevelopment Plan is amended by adding
thereto the word "building" immediately prior to the word "permit"
in each instance where the word "permit" appearSi by adding to
the first paragraph of Section 426 the following sentence:
"The applicant shall provide such information as is deemed
necessary by the Agency to permit the Agency to review
the application hereunder."i
and by substituting the word "thirty" for the word "ten" in each
instance where the word "ten" appears therein;
(12) Sction 501 of the Redevelopment Plan is amended by adding
thereto the following paragraph:
"The Agency shall not establish or incur any loan,
advance, or indebtedness to be repaid from the alloca-
tion of taxes to the Agency pursuant to Health and Safety
Code Section 33670 later than June 30, 2026."i
(13) Section 502 is amended by adding thereto the following
paragraph to:

"The total amount of dollars of tax increment which
may be divided and allocated to the Agency pursuant to
this Plan is two hundred million dollars
($200,000,000.00) .";
(14) The paragraph entitled "Traffic Circulation" in Section
900 is amended by adding the word "and" prior to the words
"Huntington Drive", by inserting a period following the words
"Huntington Drive" and by deleting the words "and Duarte Road";
(15) The Hap set forth in Exhibit "A" of the Redevelopment
Plan is deleted in its entirety and a new Map shall be substituted
therefore as set forth in Exhibit "A" attached hereto and incor-
porated herein by reference.
SECTION 2. This Ordinance shall take effect thirty (30) days
following the date of passage hereof. The City Clerk shall cause
this Ordinance to be published as required by law.

hereby certify that the foregoing Ordinance No. 1847 was passed
and adopted by the City Council of the City of Arcadia, signed
by the Mayor and attested to by the City Clerk at a regular meeting
of said Council on the 18th day of November, 1986 and that said
Ordinance was adopted by the following vote, to wit:
