JOSEPH STREET EAST OF FRONT STREET RECOMMENDATION: ADOPT SUMMARY The Metro Gold Line Foothill Extension Construction Authority (Authority) has requested that the City vacate a portion of St. Joseph Street right-of-way for the construction of the Gold Line light rail project. The St. Joseph Street right-of-way in question is located directly east of the intersection with Front Street and is approximately 4,800 square feet (60' wide x 80' feet long). Pursuant to the provisions of Part 3 of Division 9 of the State of California Streets and Highways Code, staff proposes to summarily vacate this portion of St. Joseph Street because it has been impassible for five (5) consecutive years and no public funding has been expended for maintenance. The street vacation is subject to the reservation and exception of drainage easements due to a historical drainage course that flows from east to west under the tracks and across this portion of St. Joseph Street. On January 24, 2012, the Planning Commission made a finding that the requested vacation is consistent with the City's General Plan and recommended approval to the City Council. Staff recommends the adoption of the resolution to summarily vacate this portion of St. Joseph Street and reserve a drainage easement. BACKGROUND The Authority is responsible for the construction of the Metro Gold Line Foothill Extension and plans to extend the Gold Line light rail east from Pasadena through Azusa. The rail project will follow the old Atchison Topeka & Santa Fe Railroad right-of- way now owned by Metro. Metro has assigned the property to the Authority as a trustee for the purpose of carrying out the project to its completion. As the trustee, the Authority Staff Report March 20, 2012 Page 2 has the ability to act to purchase, obtain, accept and dispose of right-of-way on behalf of Metro. The project funding was committed in 2008 through the passage of Measure R, a half-cent sales tax for local transportation in Los Angeles County. In 2011 the Authority selected Kiewit Parsons to complete the design and construction of the Metro Gold Line. A notice to proceed was issued by the Authority in November 2011 and the design/construction is now underway. One of the Authority's responsibilities in the final design process is to obtain all the missing portions of right-of-way for the light rail alignment. The Authority has thoroughly researched the rail right-of-way to verify that all land necessary for the project is in the Authority's ownership. They have identified a few locations where either parcels appear to be rail right-of-way but were never clearly obtained or additional parcels are needed. The Authority has requested the City to vacate a portion of St. Joseph Street right-of- way between Front Street and the railroad right-of-way. Attached is a location map and an aerial map. Although this segment appears to be vacated, there is no record of a formal street vacation. This segment is outside the rail right-of-way but is necessary for a power substation to supply power for the trains. The St. Joseph Street right-of-way was blocked by the original railroad installation and Front Street and Flower Street appear to have been constructed to divert vehicular access along both sides of the railroad. It is unclear if St. Joseph Street ever existed across the tracks and there is no evidence of a roadway crossing the tracks. On January 24, 2012, the Planning Commission made a finding that the requested vacation is consistent with the City's General Plan and recommended approval to the City Council. The portion of St. Joseph Street is not part of the City's Arterial and Collector Street network and is not necessary for present or future street purposes or access. The General Plan goals and policies emphasize the City's interconnected mobility system and these vacations will enhance the interconnection of the Gold Line with the City's system. DISCUSSION Pursuant to and in accordance with provisions of Part 3 of Division 9 of the State of California Streets and Highways Code, the City Council may vacate a public roadway that is "unnecessary for present and prospective public street purposes". The California Streets and Highways Code Section 8331 allows the City to summarily vacate a street if the street has been impassible for five (5) consecutive years and no public funding has been expended for maintenance. This segment of St. Joseph Street meets the criteria for a summary vacation. Additionally, the street vacation may be subject to the reservation and exception of all easements requested by agencies or utility companies as authorized by Sections 8340 and 8341 of the Streets and Highways Code. The land is currently used by the A & A Building Material Company for the storage of materials. Metro has owned the land on both sides of the street right-of-way in conjunction with the railroad and has over the years leased their property to A & A Staff Report March 20, 2012 Page 3 Building Materials for their use. In the event of the street vacation, the Authority would become the rightful owner of the land. The Authority has terminated the lease with A & A Building Material Company and is working with them to clear the property. The vacation will not create any land-locked parcels or create any access problems for existing parcels. There is currently a drainage culvert that crosses under the railroad which connects drainage flow from St. Joseph Street on the east to St. Joseph Street on the west. The Authority is proposing to remove the culvert and install drainage improvements in the vicinity. With this proposed vacation, the City proposes to retain a drainage easement until such time as the Authority relocates and or removes the drainage flow. ENVIRONMENTAL ANALYSIS, The proposed right-of-way vacation is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c) because the action consists of a legal transfer of ownership which will result in negligible or no expansion of use beyond the project analyzed in the EIR, adopted in 2007 for the Gold Line Extension. RECOMMENDATION That the City Council adopt Resolution 6823 ordering the summary vacation of a portion of St. Joseph Street east of Front Street. JOSEPH STREET EAST OF FRONT STREET THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The City of Arcadia has received a request from the Metro Gold Line Foothill Construction Authority to summarily vacate and abandon a portion of St. Joseph Street east of Front Street in the City of Arcadia, County of Los Angeles, State of California. The location of that portion of St. Joseph Street subject to the proposed vacation ("Street Portion") is more particularly shown in Exhibit"A"and Exhibit"B"attached hereto. SECTION 2. Pursuant to Government Code 65402(a),the Planning Commission of the City of Arcadia, during its regular meeting on January 24, 2012, determined that the proposed vacation is consistent with the General Plan of the City of Arcadia. SECTION 3. The City Council does find that the vacation of the Street Portion is being made in accordance with Chapters 3, 4 and 5 of Part 3 of Division 9 of the Streets and Highways Code of the State of California (Streets and Highways Code Section 8320, et seq.). SECTION 4. Pursuant to Section 15301(c) of the California Environmental Quality Act ("CEQA"), the proposed vacation is categorically exempt from CEQA because the action consists of a legal transfer of ownership which will result in negligible or no expansion of use beyond the project analyzed in the EIR, adopted in 2007 for the Gold Line Extension. Therefore, a Notice of Exemption has been filed with the County Clerk of 1 the County of Los Angeles. SECTION 5. Pursuant to the Streets and Highways Code Section 8340 and 8341, the City Council of the City of Arcadia finds that the public convenience and necessity require the reservation and exception from the vacation of an easement to the City of Arcadia to maintain, operate, replace, remove, or renew facilities necessary to transport drainage upon or under the Street Portion. SECTION 6. Pursuant to the Streets and Highways Code Section 8331, the City Council finds from all evidence submitted that the Street Portion is unnecessary for present or prospective public use and, therefore, it is ordered that that the Street Portion be summarily vacated. SECTION 7. The City Clerk of the City of Arcadia shall certify to the adoption of this Resolution and shall cause a certified copy thereof to be recorded in the Office of the County Recorder of Los Angeles County. SECTION 8. From and after the date this Resolution No. 6823 is recorded, the Street Portion vacated will no longer constitute a public right-of-way. SECTION 9.
