Huntington Drive (formerly Bar Twist) Conditional Use Permit application no. CUP 12 -03 was filed by Mr. John Kirimis for a restaurant with alcoholic beverage service and live entertainment at the existing 2,700 square -foot commercial space (formerly Bar Twist) at 48 E. Huntington Drive — see attached aerial photo. The Development Services Department is recommending approval, subject to the conditions listed in this staff report. GENERAL INFORMATION APPLICANT: Mr. John Kirimis LOCATION: 48 E. Huntington Drive REQUEST: A Conditional Use Permit for a 2,700 square -foot restaurant at 48 E. Huntington Drive with alcoholic beverage service and live entertainment SITE AREA: 7,300 square -feet (0.17 acre) FRONTAGES: 50 feet along E. Huntington Drive 50 feet along a 20 -foot wide alley to the rear of the property EXISTING LAND USE & ZONING: The site is a 7,300 square -foot lot with a 4,370 square -foot building built in 1932 and divided into two commercial units; a 1,670 square -foot cocktail lounge at 46 E. Huntington Drive (The First Cabin) and the subject 2,700 square -foot space at 48 E. Huntington Drive. The site is zoned CBD, Central Business District. SURROUNDING LAND USES & ZONING: North: General Offices — zoned CBD, Central Business District South: Apartments — zoned R -3, High Density Residential East: General Offices — zoned CBD, Central Business District West: General Offices — zoned CBD, Central Business District GENERAL PLAN DESIGNATION: Commercial with a Downtown Overlay (1.0 FAR) — This designation is intended to permit a wide range of commercial uses which serve both neighborhood and citywide markets. The designation allows a broad array of commercial enterprises, including restaurants, durable goods sales, specialty shops, indoor and outdoor recreational facilities, and entertainment uses. Adjacent to Downtown, the Commercial designation is intended to encourage small -scale office and neighborhood - serving commercial uses that complement development in the Downtown Mixed Use areas. PUBLIC HEARING NOTIFICATION Public hearing notices for CUP 12 -03 were mailed on April 11, 2012 to the property owners and tenants of those properties that are located within 300 feet of the subject property — see the attached radius map. Pursuant to the provisions of the California Environmental Quality Act (CEQA), the use of the existing 2,700 square - foot commercial unit as a restaurant is Categorically Exempt under Section 15301 of the CEQA Guidelines, and therefore the public hearing notice was not published in a local newspaper. BACKGROUND INFORMATION The subject property was developed in 1932 with a one -story, 4,370 square -foot, two -unit commercial building — see attached site plan and photos. The 1,670 square -foot space at 46 E. Huntington Drive has been occupied as a bar or restaurant since the mid- 1980s; prior to the City's requirement of a Conditional Use Permit for such uses. The subject unit at 48 E. Huntington Drive was similarly operated as a cocktail lounge prior to the City's Conditional Use Permit requirement. However, the last tenant, Bar Twist, closed in 2010 and the space has been vacant since that time and the legal- nonconforming status has expired. CUP 12 -03 48 E. Huntington Drive April 24, 2012 — page 2 The Central Business District (CBD) zoning of the property does not allow a standalone bar or cocktail lounge use, but a restaurant with or without alcoholic beverage service and /or entertainment is allowed, subject to a Conditional Use Permit. PROPOSAL AND ANALYSIS The applicant is proposing a restaurant with alcoholic beverage service and live entertainment. The applicant, Mr. John Kirimis, is the owner of the subject property and is applying for a Conditional Use Permit with the eventual goal of turning over the approval to a tenant. Therefore, the specific type of restaurant is yet to be determined. The applicant is proposing to utilize the existing floor plan with only minor alterations — see the attached floor plan. The front of the unit would be used for sit -down dining purposes with the bar area towards the rear of the unit. The small stage would remain at the front corner of the unit for live entertainment purposes. The open seating area will be utilized to accommodate the needs of the specific restaurant tenant. No exterior changes to the building are proposed at this time. The proposed operating hours are 6:00 a.m. to 2:00 a.m., seven (7) days a week, with the intention that the actual operating hours be determined at a later date by the eventual restaurant tenant. The City encountered a number of problems with the former tenant, Bar Twist. These included noise complaints from neighboring residences, accumulations of refuse and litter at the rear of the property, entertainment without permits, and fights and other disturbances that required the Arcadia Police Department to respond. To avoid these issues, the new business is to operate as a restaurant and not a bar or cocktail lounge. Staff is recommending the following limitations and improvements: Operating hours of 10:00 a.m. to 11:00 p.m., Sunday through Wednesday, and 10:00 a.m. to 12:00 Midnight, Thursday through Saturday. • Full meal service shall be required during all operating hours. • The rear door is to remain closed, and an interior door is to be added to provide additional noise containment. • The seating area shall be restricted to dining patrons who are seated by a server. The bar shall be limited to the small area towards the rear of the unit. • D.J. music, jukeboxes, and dancing shall be prohibited at this location. • A trash and recycling enclosure with a roof shall be provided at the rear of the building for both commercial units at the subject property. CUP 12 -03 48 E. Huntington Drive April 24, 2012 — page 3 Parking The subject property has 8 on -site parking spaces that are shared between the two commercial units. The parking requirement for the existing 1,670 square - foot bar at 46 E. Huntington Drive (The First Cabin) is 13 spaces; and the parking requirement for the previous bar /restaurant (Bar Twist) was 20 spaces, for a combined requirement of 33 on -site parking spaces, which is a deficiency of 25 spaces. The proposed restaurant would not change the parking requirement or increase the parking deficiency at this property. However, a Parking Modification for 8 on -site spaces in lieu of 33 spaces required is necessary as part of this Conditional Use Permit. Although the property has a substantial parking deficiency, the proposed use would not increase this deficiency compared to the previous use. The building was constructed at a time when the parking requirements were much less stringent, and both units were legally converted to bar /restaurant uses. The City -owned public parking lots north of Huntington Drive are within a reasonable walking distance of the subject property, and there is also on- street parking along Huntington Drive and First Avenue that can be utilized by patrons and employees of the restaurant. Staff recommends signs and notices to inform patrons and employees of the locations of public parking and to indicate that parking at neighboring properties is prohibited. Also, employees of the restaurant should refrain from parking in the on -site parking lot during business hours. CODE REQUIREMENTS All City requirements regarding disabled access and facilities, occupancy limits, building safety, emergency equipment, and parking and site design are required to be complied with to the satisfaction of the Building Official, City Engineer, Community Development Administrator, Fire Marshal, and Public Works Services Director. The proposed restaurant will also be subject to Los Angeles County Health Codes, and licensing by the State Department of Alcoholic Beverage Control. CEQA Proposed projects that are not approved, are by virtue of being denied, exempt from any further environmental assessment. If approved, however, and if it is determined that no significant physical alterations to the site are necessary, then this project, as an existing facility is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Guidelines. A Preliminary Exemption Assessment is attached to this staff report. CUP 12 -03 48 E. Huntington Drive April 24, 2012 — page 4 FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. The proposed restaurant is consistent with the zoning and land use designation of the site and area, and with conditions of approval to limit the operations; it should not impact the neighborhood in the way the previous bar /restaurant use did. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. A restaurant with alcoholic beverage service and live entertainment is allowed in the CBD zones with an approved Conditional Use Permit per Section 9264.2.9 of the Arcadia Municipal Code. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. The proposed restaurant with alcoholic beverage service and live entertainment will not have a parking requirement that is greater than the previous use at this location. Additionally, the site is close to City -owned parking lots and on- street parking is available along Huntington Drive and First Avenue. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. The site fronts Huntington Drive to the north and has access to a 20 -foot wide alley at the rear of the property. The site is between Santa Anita and First Avenues, and the alley and the three streets that provide access to the site are adequate for the type of traffic that is to be generated by a restaurant use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. The proposed restaurant is a commercial use that is consistent with the General Plan Land Use Designation of the site. It is staffs opinion that this restaurant with appropriate conditions of approval does satisfy each prerequisite condition. RECOMMENDATION The Development Services Department recommends approval of Conditional Use Permit Application No. CUP 12 -03, subject to the following conditions: CUP 12 -03 48 E. Huntington Drive April 24, 2012 — page 5 1. The business shall be operated as a restaurant with alcoholic beverage service being incidental to the primary restaurant use. Full meal service shall be available during all operating hours. The main seating area shall be restricted to dining patrons who are seated by a server, and the seating arrangement shall be subject to City approval. The open bar seating shall be limited to the small, 9 -seat bar towards the rear of the unit. The maximum occupancy shall be determined by the Fire Marshal. 2. Operating hours shall be limited to 10 a.m. to 11 p.m., Sunday through Wednesday, and 10 a.m. to 12 Midnight, Thursday through Saturday. 3. D.J. music, jukeboxes, and dancing shall be prohibited at this location. Separate entertainment permit(s) and business license(s) shall be obtained for all entertainments in accordance with the City's Business License standards. 4. A trash and recycling enclosure with a roof shall be installed at the rear of the building for both commercial units at this property. The location and design of the enclosure shall be subject to Planning Services approval. The enclosure shall not interfere with the existing on -site parking spaces or the handicap accessibility of either commercial unit. 5. This approval of CUP 12 -03 includes a parking modification for 8 spaces in lieu of 33 spaces required. This is not an approval of a general reduction of the parking requirements for the subject commercial space, or the subject site, but only for the restaurant approved by this Conditional Use Permit. 6. Signs and notices showing the locations of public parking areas shall be prominently displayed near the front and back entrances and available within the restaurant. The notices shall also indicate that parking at neighboring properties is prohibited and violators are subject to towing. A draft of the notice shall be submitted to Planning Services for review and approval prior to the opening of the restaurant. 7. Employees of the restaurant shall refrain from parking in the on -site parking lot during business hours. 8. The use approved by CUP 12 -03 is limited to this restaurant, which shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 12 -03, and shall be subject to periodic inspections, after which the provisions of this Conditional Use Permit may be adjusted after due notice to address any adverse impacts to the adjacent streets and /or neighboring businesses or properties. 9. All City requirements regarding disabled access and facilities, occupancy limits, building safety, emergency equipment, and parking and site design shall be complied with to the satisfaction of the Building Official, City CUP 12 -03 48 E. Huntington Drive April 24, 2012 — page 6 Engineer, Community Development Administrator, Fire Marshal, and Public Works Services Director. 10. Noncompliance with the plans, provisions and conditions of approval for CUP 12 -03 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the restaurant. 11. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and /or land use decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and /or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. 12. Approval of CUP 12 -03 shall not take effect until the property owner(s), applicant(s), and business owner(s) and operator(s) have executed and filed an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. PLANNING COMMISSION ACTION Approval If the Planning Commission intends to approve this application, the Commission should move to approve Conditional Use Permit Application No. CUP 12 -03; state the supporting findings and environmental determination, and direct staff to prepare a resolution for adoption at the next meeting that incorporates the Commission's decision, specific determinations and findings, and the conditions of approval. Denial If the Planning Commission intends to deny this application, the Commission should move to deny Conditional Use Permit Application No. CUP 12 -03; state the finding(s) that the proposal does not satisfy with reasons based on the record, and direct staff to prepare a resolution incorporating the Commission's decision and specific findings for adoption at the next meeting. It was received on April 19th after the staff report was complete. Dear City Planning Commission: My name is Andy L. I have been an arcadia resident and living on Alta street since 2004. Today, I am writing to you on behalf of myself and several of my neighbor home owners to provide you with our comments on the matter of "A Conditional Use Permit to allow a restaurant with alcoholic beverage service and live entertainment at 48 E. Huntington Drive (formerly Bar Twist) ". First of all, we would like to remind you the facts and concerns listed on the attached class petition letter dated August 2008. In fact, most of these are facts rather than concerns before Bar Twist tried to apply for DJ, dancing and etc. license. And it had cost city fair amount of resources to control, monitor and mediate the conflicts between the business and residents in the neighborhood. Second, we are not here to specifically target the business located at 48 E. Huntington Drive, nor its owner. We are here to express our concerns and frustrations because we have been experiencing fears, frustrations and frequently interrupted night sleeps in the past by having so many bar -type (alcohol and live entertainment) businesses surrounding our homes. Our daily life and safeties were constantly affected in a negative way by the type of activities listed on the petition letter. Third, we understand that city is trying to control the situation by setting conditions on the license. However, we believe these conditions are very difficult to monitor and enforce as we had experienced in the past and it is costing a lot of city resources as well. In addition, we are seriously questioning whether such practice of putting bar -type businesses on the borderline of commercial zone and residential zone is following the best practice. As a matter of fact, there are currently 3 (used to be 4 including bar twist) bar -type businesses within one block of our neighborhood already, we certainly would greatly appreciate if there isn't going to be a 4th one. Fourth, we don't believe the vision statement in regards to noise (described in Chapter 9: Noise Element of the Arcadia General Plan) is being carefully followed if these bar -type business licenses are granted (even with certain conditions) because the business is so close to the residence. Because of such close distance, we believe and experienced that bar -type businesses are constantly in violation of Arcadia city ordinance code for sound level especially when customers are constantly going in and coming out of the business via the back door, which is facing directly to our houses. Thus, we don't believe it is in the best interest of arcadia residents and City of arcadia to have so many bar -type businesses located so close to the residential houses. We are hoping city you would put yourselves in our shoes and understand our concerns and frustrations for being so close to so many bar -type businesses. In my opinion, these bar - type businesses should have never ever been approved to be next to the residence in the first place. Instead of thinking "Oh, when you purchase a home next to a bar, you should expect certain things. ", how about "when owning a business adjacent to the residential zone in arcadia, business owner should expect not able to obtain alcohol and live entertainment license. "? Now we are depending on you, planning dept /commission, to take the proactive actions of not allowing more bar -type of business near residence. Last, I'd like to conclude by asking you again to follow the vision of "establishing a balance and mix of land uses that promote economic growth and maintain a hiah quality of life for Arcadia residents ", especially for our children.
