HomeMy WebLinkAbout4263 RESOLUTION NO. 4263 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING A COMPENSA- TION PLAN FOR CERTAIN CLASSIFICATIONS IN THE FIRE DEPARTMENT FOR THE PERIOD FROM JULY 1, 1972, THROUGH JUNE 30, 1974. WHEREAS, Kermit Francis, Director of Personnel, and the Arcadia Firefighters' Association have been meeting and conferring pursuant to the provisions of the Meyers-Milias-Brown Act; and WHEREAS, as a result of said conferences, a memorandum of understanding has been executed and presented to the City Council for approval; and WHEREAS, said memorandum covers all matters which are subject to the "meet and confer" process for the period commencing July 1, 1972, and ending June 30, 1974; and WHEREAS, the City Council desires to make a determina- tion in relation to said memorandum that shall be effective for a period of two (2) years, commencing July 1, 1972; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DETERMINES AND RESOLVES THAT: SECTION 1. The Memorandum of Understanding and Agree- ment executed on and dated June 12, 1972, by the Director of Personnel and the Firefighters' Association is hereby approved and accepted subject to the following statements clarifying the intention of the parties to said memorandum and the City Council: 1. This resolution does not apply to any matter which relates to the merits, necessity, or organization of any service or activity provided by the City, and the City has and will retain the exclusive right to manage and direct the performance of City services and work forces performing such services. -1- 4263 2. It is the intention of this resolution to settle all matters relating to wages, hours, and other terms and conditions of employment for the period from July 1, 1972, through June 30, 1974, so that meeting and conferring with relation to such matters will not occur during said period, and no changes will be made to this resolution and the Memorandum of Understanding and Agreement during said period. It is consistent with the expression of inten- tion in the preceding sentence that the Fire Chief or his appointed representative and the City Manager, as members of the administra- tive ~taff, may discuss and consider modifications of the duty week hours of all fire personnel, or any other subject which they may choose to discuss or consider, but said discussions, or considera- tion, or anything arising therefrom, including without limitation any agreement or recommendation, shall not operate to affect this resolution or said memorandum of understanding in any way, whatso- ever. 3. For the period July 1, 1972, through June 30, 1974, all currently effective provisions of the City Council, including resolutions, minute resolutions, etc., relating to wages, hours and all other conditions of employment, as currently administered, shall remain in effect, except as modified by this resolution and the terms of said memorandum. 4. Salary step schedules which are adjusted in accordance with said memorandum shall be rounded to the nearest dollar. 5. The classifications of Fireman, Fire Engineer, Fire Captain, Fire Inspector, Battalion Chief, and Fire Dispatcher, only, are affected; provided, that the provisions relating to the Public Employees' Retirement System (the "widow's clause") -2- 4263 shall also be applicable to the Fire Chief and the Assistant Fire Chief. SECTION 2. The City Clerk shall certify to the adoption of this resolution.
