RESO~UTlbN'NO. 4266 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, COVERING PRELIMINARY DETERMINATION THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE CERTAIN ACQUISITION AND IM- PROVEMENTS IN THE CITY OF'ARCADIA, CALIFORNIA, IN WHAT IS KNOWN AS ASSESSMENT DISTRICT NO. 72-1 (ARCADIA INDUSTRIAL PARK) ,-AND SETTING A TIME AND PLACE FOR HEARING THEBEON. WHEREAS, Section 17 of Article XII;r: of the Constitution of the State of California provides that the debt limitation and majority protest provisions of said section shall not apply if, after the giving of such reason~ble notice by publication and posting and the holding of such public hearing as the City Coun- cil of the City of Arcadia shall have prescribed, said Council, by not less than 4/5th vote of all members thereof, finds and determines that the public convenience and necessity require the improvement proposed to be made; and WHEREAS, Section 2804 of the Streets and Highways Code of the State of califor~ia provides that the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931- shall not apply to any proceedings otherwise subject thereto when said improvement. proceedings is by a charter city and said city has complied with the provisions of Section 1.7 of Article XIII of the Const~tution of the State of california; and WHEREAS, the City of Arcadia is a charter city of the State of California; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That it is the.preliminary determination of said City Council that the public convenience and necessity -1- , 4;<~(, require that certain improvements and acquisition in the City of Arcadia, California, hereinafter described, be made and that the cost and expense thereof be paid for by special as- sessments levied upon the property within the district benefited thereby; and that all necessary proceedings therefor be had and taken without compliance \~ith the provisions of the "Special As- sessment Investigati~n, Limitation and Majority protest Act of 1931". SECTION 2. That the following .is a description of the proposed improvement and acquisition: DESCRIPTION OF WORK FIRST: The construction of certain grading, paving, base, curbs and gutters, street lights, sanitary sewer improvements and driveway approaches and appurtenances in CLARK STREET (44 foot width) between PECK ROAD and MYRTLE AVENUE. SECOND: The construction of certain grading, paving, base curbs and gutters, sanitary sewer improvements, water line improvements, gas line improvements, street light conduits together with appurtenances in LA SALLE STREET (44 foot width) between PECK ROAD and its easterly cul-de-sac approxi- mately 1300 feet easterly from MYRTLE AVENUE; and in MYRTLE AVENUE (44 foot width) between LA SALLE STREET and CLARK STREET excluding gas line improvements; and in UNNAMED STREET A (44 foot width) between LA SALLE STREET and CLARK STREET at a point approximately 900 feet easterly of MYRTLE AVENUE ' excluding gas line improvements; and in " -1';<(Pb .. UNNAMED STREET B (44 foot width) extending northerly from CLARK STREET to cul- de-sac point approximately 400 feet northerly thereof commencing at a point approximately 250 feet westerly of MYRTLE AVENUE. . THIRD: The construction of certain grading, base and paving together with appurtenances in CLARK STREET (24 foot width) between MYRT~E AVENUE and COGS~~LL ROAD; and in MYRTLE AVENUE (25 footwidth) between LA SALLE AVENUE and RANDOLPH STREET, in- cluding drainage facilities; and in RAl'!DOLPH STREET (25 foot width) between PECK ROAD and MYRTLE AVENUE including drainage facilities. DESCRIPTION OF ACQUISITION That the public convenience and necessity require the acquisition of all necessary street right-of-way in order to accomplish the work and improvements as set forth above, and to open all streets to widths as shown on plat showing proposed improvements and acquis~tion. Refe~ence is hereby further made to the plat showing the general nature and location of the propose? acquisition and . , improvements in ASSESSMENT DISTRICT NO. 72-1 (ARCADIA INDUSTRIAL .' PARK), said plat previously appro,:,ed az:d on file in the office of the City Clerk of said City. SECTION 3. That the costs of said acquisition and im- provement shall be assessed against the lands benefited thereby and the boundaries of the district of lands proposed to be as- sessed to pay the costs and expenses of said proposed acquisi- tion and improvement are as shown upon a map entitled "Propo.sed Boundaries of ASSESSMENT DISTRICT NO. 72-1 (ARCADIA INDUSTRIAL PARK) '0, hereto approved and adopted by the City Council and on file in the office of the City Clerk of said City and referenced for further particulars. -3- nG;?0 SECTION 4. Notice is hereby given that on Wednesday the 5th day of July , 1972, at 7:30 o'clock P.M., in the Council Chambers located in the City Hall in the 'City of Arcadia, California, there shall be a public hearing before the Council of the city of Arcadia for the purpose of determining whether or not the public convenience and necessity require the above described improvement and acquisition. SECTION 5. That said improvements and the financing shall all be pursuant to special assessment proceedings as set for.th in the Streets ahd Highways Code of the State of California. SECTION 6. : The City Clerk shall publish this resolution 1 '._ '. ',- . , in the "ARCADIA TRIBUNE", a newspaper of. general circulation' in the City of Arcadia, on two successive dates, the first publica- tion to be.made not less than,ten (10) days prior to the date of the above publip,~earing. , SECTION 7. The City Clerk shall cause notice of said hearing to be posted along the line of the contemplated work and on all open streets within the district all in accordance with the PU9lic convenience and necessity determination resolu- tion adopted by the City Council of the City of Arcadia. SECTION 8. The. City Clerk is directed to mail notices of said hearing to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for the city taxes.
