HomeMy WebLinkAbout4274 o " RESOLUTION NO. 4274 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY RE- QUIRE CERTAIN ACQUISITION AND IMPROVEMENTS IN THE CITY OF ARCADIA, CALIFORNIA, IN ASSESSMENT DISTRICT NO. 72-1 (ARCADIA INDUSTRIAL PARK) AND FURTHER THAT THE "SPECIAL ASSESSMENT INVESTI- GATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931" SHALL NOT APPLY. WHEREAS, a public hearing, for which reasonable notice has been given by publication and posting has been. held as to the public convenience and necessity for certain acquisition of public street and right-of-way and the construction of certain street improvements in the City of Arcadia, California in ASSESS- MENT DISTRICT NO. 72-1 (ARCADIA INDUSTRIAL PARK); and WHEREAS, this City Council has heard and considered all the evidence both oral and written relative to the public con- venience and necessity' of the construction of the aforesaid im- , '. , . , provement; aqd, WHEREAS, this City Council now is satisfied as to the improvements and acquisition as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AS. FOLLOWS: SECTION 1. , That this City Council hereby finds aqd determines that the public convenience and necessity require the following work and acquisition, to wit: The construction of certain street improvements together with acquisition and appurtenances in ASSESSMENT DISTRICT NO. 72-1 (ARCADIA INDUSTRIAL PARK). a~ set forth .in ResolQt~on No. 4266 and as amended and modif1ed by Resolut1on No. 4273. SECTION 2. This City Council further determines that the provisions and limitations of the "Special Assessment -1- 4274 ., Investigation, Limitation and Majority Protest Act of 1931- shall not be applicable to proceedings for this improvement. SECTION 3. That the City Council further intends that by no less than a 4/5s vote of all members, to fully comply with the terms and provisions of Section 2804 of the Streets and Highways Code as well as Section 17 of Article XIII of the Con- stitution of the State of California.
