HomeMy WebLinkAbout4286 - RESOLUTION NO. 4286 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA PROPOSING AN' ORDINANCE FOR ADOPTION BY THE PEOPLE OF THE CITY OF ARCADIA RELATING TO REGULATION OF DISTRIBUTION OF PRINTED MATTER TO PRIVATE PROPERTY. I BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARCADIA THAT:' SECTION 1. The City Council of the City of Arcadia hereby submits to the voters of said City a proposition for the enactment of Ordinance No. 1462 which is entitled "AN ORDINANCE OF THE PEOPLE OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 6421 OF THE ARCADIA MUNICIPAL CODE TO REGULATE THE DISTRIBUTION OF PRINTED MATTER TO PRIVATE FROPERTY." The text of said ordinance is herein- after set forth. SECTION 2. Said proposition shall be submitted to the voters at a special city election to be held in the City of Arcadia on the 7th day of November, 1972, and as set forth on the ballot shall read as follows: "Shall the Ordinance of the People of the City of Arcadia No. 1462 regulating the distribution of printed matter to private property be adopted?" SECTION 3. Said special election shall be consolidated with the statewide general election to be held on November 7, 1972. Said election shall be conducted in accordance with Resolution No. 4282 requesting the Board of Supervisors to consolidate said election and in accordance with applicable law. SECTION 4. If said proposition for the enactment of Ordinance No. 1462 receives a majority of the votes cast on said -1- 4286 - proposition at the election, said ordinance shall become effective ten (10) days .after the date upon which the City Council declares that a majority of the voters voting on said propo~ition have voted in its favor. SECTION 5. Said Ordinance No. 1462 which is proposed for adoption by the people of the City of Arcadia reads as follows: "THE PEOPLE OF THE CITY OF ARCADIA DO ORDAIN AS FOLLOWS: SECTION 1. That Section 6421 of the Arcadia Municipal Code shall hereby be amended to read as follows: 6421. DISTRIBUTING PRINTED MATTER RESTRICTED. (a) No person shall throw, distribute, deposit, place or deliver any printed matter on any premises if the occupant thereof shall have registered with the City Clerk the refusal of such occu- pant to receive such matter. Printed matter as used herein shall include writing. (b) The City Clerk shall maintain a list of premises whose occupants have registered such refusal with the City Clerk. Any premises on the list shall be removed upon request of the occu- pant or upon removal of the occupant requesting the listing. (e) The City Clerk shall give such list free of charge to any person desiring to make such distribution. (d) It shall be unlawful for any person to so distribute or cause such distribution of printed matter without having obtained such list or in violation of the provisions thereof. I ' (e) The provisions of this section shall not apply to the distribution of United States mail, a telegram, or to any matter which the occupant has expressly requested. -2- 4286 - SECTION 2. Any person'violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction shall be punishable by a fine of not more than five hundred dollars ($500.00) or by imprisonment in the City jailor County jail for a period not exceeding six (6) months or by both such fine and im- prisonment. " SECTION 6. The City Clerk shall certify to the adoption of this resolution.
